COMPLAINT
1. plaintiff NATIONAL PENN BANK, f/k/a NATIONAL BANK OF
BOYERTOWN ("NPB"), is a pennsylvania banking corporation with its
principal place of business at Philadelphia and Reading Avenues,
Boyertown, Berks County, Pennsylvania 19512.
2. Defendants, JAMES W. SAUVE, JR. and JUDITH A. SAUVE, his
wife, are adult individuals residing at 282 St. John's Drive, Camp
Hill, Cumberland County, Pennsylvania 17011.
3. On or about May 28, 1987. Defendants made, executed and
delivered to the NATIONAL BANK OF BOYERTOWN. a mortgage recorded on
June 5. 1987. in the office of the Recorder of Deeds for Cumberland
County in Mortgage Book Volume 867, Page 811, securing the sum of
Fifty Thousand Dollars ($50,000.00).
4. The premises subject to said mortgage is situate in Camp
Hill. County of Cumberland, Commonwealth of Pennsylvania and is
more fully described and set forth in the true and correct copy of
the original mortgage attached hereto and made a part hereof by
this reference and marked as Exhibit "AU.
5. pursuant to the terms and conditions of the mortgage
Defendants are in default by reason of their failure to timely pay
the monthly installments of principal and interest from January 15,
1995, to the present.
6. Under the terms and conditions of the aforedescribed
mortgage, Defendant's failure to make monthly payments of principal
and interest as hereinabove set forth, shall result in acceleration
of payment of all principal of said mortgage and all interest and
other amounts due thereunder.
7. As of June 9, 1995, the following amounts were due on said
mortgage:

8. NPB has fully complied with Section 403 of Act 6 of 1974
Sessions of the General Assembly of the Commonwealth of
Pennsylvania (41 P.S. Section 403) and with Section 1680.403(c) of
the Homeowner's Emergency Assistance Act of 1983 (35 P.S. Section
1680.403(c)) by mailing to the Defendants, JAMES W. SAUVE, JR. and
JUDITH A. SAUVE, Notice of Intention to Commence Foreclosure
proceedings against them and Notice that they might be eligible for
financial assistance toward their mortgage payments. A true and
correct copy of these notices are attached hereto and made a part
hereof by this reference and collectively marked as Exhibit liB".
9. Despite the repeated demands of NPB, Defendants have
failed and refused and continue to fail and refuse to make the
aforedescribed requisite payments.
WHEREFORE, NATIONAL PENN BANK, f/k/a NATIONAL BANK OF
BOYERTOWN requests judgment be entered against the Defendants,
JAMES W. SAUVE, JR. and JUDITH A. SAUVE, in the amount of Forty-
Nine THousand Six Hundred Seventy-Four and 30/100 ($49,674.30) plus
accumulating interest at the contractual per diem rate of Twelve
and 98/100 Dollars ($12.98) plus costs, and for the foreclosure and
sale of the aforesaid premises.

Dear Ms. Sauve:
The MORTGAGE held by National Bank of Boyertown (hereinafter, "we, us, or
our") on your property located at 282 St. John's Drive, Camp Hill, Pennsylvania
17011, IS IN SERIOUS DEFAULT because four monthly payments have not been made
for the months of September 14, October 15, November 14. and December 15, 1993.
Late charges (end other charges) have also accrued to this date in the
amount of $103.48. All amounts due and owing pursuant to the terms of the debt
instrument and the mortgage must now be paid. The total amount now required to
cure this default or, in other words, get caught up on your payments as of the
date of this letter is $1,773.06.
This amount was computed by adding the principal amount of $1,669.58 and
accrued late charges of $103.48.

You may cure the default within THIRTY (30) DAYS of the date of the
receipt of this letter bv pavin~ to us the above amount of $1.773.06. plus any

check. or money order and paid to Natione1 Bank of Boyertown, P. O. Box 547,
Boyertown, PA 19512. You must cure any other default noted above within the
same time period.

If you do not cure the default within THIRTY (30) DAYS. we intend to
exerciae our riRht to accelerate the mortRaRe paYments. This means that
whatever is owing on the original amount borrowed will be considered due
immediately, and you may lose the chance to payoff the original mortgage in
monthly installments. If full payment of the amount of default is not made
within THIRTY (30) DAYS, we also intend to instruct our attorneys to start a
lawsuit to foreclose your mortRaRed property. If the mortRaRe is foreclosed.
your mortRsRed property will be sold by the Sheriff to payoff the mortRsRe
debt. If we refer your case to our attorneys but you cure the default before
they begin legal proceedings against you, you will still have to pay the
reasonable attorney's fee actually incurred up to $50.00. However, if legal
proceedings are started against you, you will have to pay the reasonable
attorney's fees even if they are over $50.00. Any attorney's fees will be
added to whatever you owe us, which may also include our reasonable costs. If
yoU cure the default within the thirty-day period. you will not be required to
pay attorney's fees.
We may also sue you personally for the unpaid principal balance and all
other sums due under the mortgage.
If you have not cured the default within the thirty-day period and
foreclosure proceedings have begun, you still have the riRht to cure the
default and prevent the sale at any time up to one hour before the Sheriff's
foreclosure sale. You may do so by payinR the total amount of the unpaid
monthly paYments plus any late or other charRes then due. as well as the
reasonable attorney's fees and costs connected with the foreclosure sale (and
perform any other requirements under the mortRaRe). It is estimated that the
earliest date that a Sheriff's sale could be held would be approximately Hay 9,
1994.
A notice of the date of the Sheriff's sale will be sent to you before the
sale. Of course, the amount needed to cure the default will increase the
longer you wait. You may find out at any time exactly what the required
payment will be by calling us at the following number: (215) 369-6138. Thia
payment must be in cash, cashier' a check, certified check, or money order and
made payable to us at the address stated above.
You should realize that a Sheriff's sale will end your ownership of the
mortgaged property and your right to remain in it. If you continue to live in
the property after the Sheriff's sale, a lawsuit could be started to evict you.
You have additional rights to help protect your interest in the property.
