Plaintiffs Jay Richard Miller and Carol Jean Miller are husband and wife and citizens of the Commonwealth of Pennsylvania who reside at 4010 Mountainview Road, Mechanicsburg, Cumberland County, Pennsylvania 17055. 2. Defendant J. C. Ehrlich Company, Inc. is a corporation conducting business at 500 Spring Ridge Drive, Wyomissing, Berks county, Pennsylvania. 3, Defendant Edward James Murphy is an adult individual and citizen of the Commonwealth of Pennsylvania who resides at 11 Red Barberry Drive, Etters, York County, Pennsylvania. 4, The facts and occurrences herein related took place on or about January 26, 1994 at approximately 3:44 p.m. on SR 641 (Trindle Road), Hampden Township, Cumberl3nd County, Pennsylvania, 64644/HLH r , \ \ 5, At that time and place, Plaintiff Jay Richard Miller was operating his motor vehicle, a 1985 Chevrolet Silverado, in an easterly direction on SR 641, 6. At that time and place, Plaintiff Jay Richard Miller was traveling in the right lane of travel for eastbound traffic on SR 641, Cumberland County, Pennsylvania. 7. At that time and place, Defendant Edward James Murphy was operating J. C. Ehrlich Company Inc.'s 1991 Chevrolet 510 also in an easterly direction on SR 641 directly behind Plaintiff Jay Richard Miller's vehicle. 8. At that time and place, an unknown vehicle sharply pulled out from Brian Road onto SR 641 causing Plaintiff to apply his brakes. 9. At that time and place, Defendant Edward James Murphy operated the aforementioned vehicle in the course and scope of his employment with Defendant J, C. Ehrlich Company, Inc. 10. At that time and place, Defendant Edward James Murphy failed to apply his brakes causing the front portion of his vehicle to violently collide with the rear portion of Plaintiff Jay Richard Miller's vehicle. 2 COl1N'1' I Jav Richard Miller and Carol Jean Miller v. Edward James MurDhv 11. Paragraphs 1 through 10 of Plaintiffs' Complaint are incorporated herein by reference. 12. The foregoing accident and all of the injuries and damages set forth hereinafter sustained by Plaintiffs Jay Richard Miller and Carol Jean Miller are the direct and proximate result of the negligent, careless, wanton and reckless manner in which Defendant Edward James Murphy operated his motor vehicle in the course and scope of his employment as follows: (a) failure to have his vehicle under such control as to be able to stop within the assured clear distance ahead; (b) failure to keep alert and maintain a proper watch for the presence of other motor vehicles on the highway; (c) failure to apply his brakes in sufficient time to avoid striking the rear of Plaintiffs' vehicle; (d) failure to travel at a safe speed; (e) failure to keep a proper watch for traffic on the highway; (g) failure to drive his vehicle with due regard for the highway and traffic conditions which were existing and of which he was or should have been aware; (h) failure to keep proper and adequate control over his vehicle; and 3 (i) driving his vehicle upon the highway in a manner endangering persons and property and in a reckless manner with careless disregard to the rights and safety of others and in violation of the Motor Vehicle Code of the Commonwealth of Pennsylvania, COUN'!' II Jav Richard Miller and Carol Jean Miller v. J. C. Ehrlich ComDanv. Inc. 13. Paragraphs 1 through 12 of Plaintiffs' Complaint are incorporated herein by reference. 14. The foregoing accident and all of the injuries and damages set forth hereinafter sustained by Plaintiffs Jay Richard Miller and Carol Jean Miller are the direct and proximate result of the negligence of J. C. Ehrlich Company for entrusting Defendant Edward James Murphy with the J, C. Ehrlich Company's 1991 Chevrolet S10 as follows: (a) permitting Defendant Edward James Murphy to operate the 1991 Chevrolet S10 although it knew or should have known that Defendant Edward James Murphy did not have the proper training, experience and judgment to adequately control the vehicle; permitting Defendant Edward James Murphy to drive the Chevrolet S10 although it knew or should have known that Edward James Murphy was careless or reckless in the operation of the vehicle; failing to properly supervise Defendant Edward James Murphy's operation and use of the vehicle; permitting Defendant Edward James Murphy to operate the vehicle although it knew or should have known he was not qualified to do so; (b) (c) (d) 4 (e) permitting Defendant Edward James Murphy to operate the vehicle in violation of the Motor Vehicle Code of the Commonwealth of Pennsylvania; and permitting Defendant Edward James Murphy to drive the vehicle although it knew or should have known that Defendant Murphy was not physically or emotionally responsible to the degree necessary to operate and control the vehicle upon the accident. (f) CLAIM I Jav Richard Miller v. Edward James MurDhv and J. C. Ehrlich ComDanv. Inc. 15. Paragraphs 1 through 14 of Plaintiffs' complaint are incorporated herein by reference. 16. Plaintiff Jay Richard Miller sustained painful and severe injuries which include but are not limited to cervical strain syndrome, upper thoracic syndrome, periscapular strain syndrome, bilateral cervical paraspinal muscle tenderness, bilateral anterior sternocleidomastoid tenderness, posterosternocleidomastoid tenderness, upper middle and lower trapezius tenderness, cervical thoracic and lumbar strain syndrome secondary to flexion extension mechanism of injury, 17, By reason of the aforesaid injuries sustained by Plaintiff Jay Richard Miller, he was forced to incur liability for medical treatment, medications, hospitalizations and similar miscellaneous expenses in an effort to restore himself to health, and claim is made therefor. 5 18, Because of the nature of his injuries, Plaintiff Jay Richard Miller has been advised and, therefore, avers that he may be forced to incur similar expenses in the future, and claim is made therefor, 19. As a result of the aforementioned injuries, Plaintiff Jay Richard Miller has undergone and in the future will undergo great physical and mental suffering, great inconvenience in carrying out his daily activities, loss of life's pleasures and enjoyment, and claim is made therefor, 20, As a result of the aforesaid injuries, Plaintiff Jay Richard Miller has been and in the future will be subject to great humiliation and embarrassment, and claim is made therefor, 21. As a result of the aforementioned injuries, Plaintiff Jay Richard Miller has sustained work loss, loss of opportunity and a permanent diminution of his earning power and capacity, and claim is made therefor, 22. Plaintiff Jay Richard Miller continues to be plagued by persistent pain and limitation and, therefore, avers that his injuries may be of a permanent nature, causing residual problems for the remainder of his lifetime, and claim is made therefor, 6 CLlloIM II Carol Jean Miller v. As a result of the aforementioned injuries sustained by her husband, Plaintiff Jay Richard Miller, Plaintiff Carol Jean Miller has been and may in the future be deprived of the care, companionship, consortium, and society of her husband, all of which will be to her great detriment, and claim is made therefor. WHEREFORE, Plaintiffs Jay Richard Miller and Carol Jean Miller demand judgment against Defendants Edward James Murphy and J. C. Ehrlich Company, Inc. in an amount in excess of Twenty-Five Thousand Dollars ($25,000,00), exclusive of interest and costs and in excess of any jurisdictional amount requiring compulsory arbitration.
