AND Lynrord K, Donlvan of 116 We.t Hillcrest Drive, Carli.le. Pennsylvania 17013, purty of the second
pan. (hereinafter called Contmclor).
WHEREAS the .aid purties hove by 0 duly executed Agreement under seal. bearing even dote herewith,
enlCred into 0 wrillen contract for the excavation, the construction andcompletion of 0 single family residence to
be erecled on the lot of ground situale in Dickinsun Thwnship, Cumberland County. Pennsylvania, Cumberland
County. Pennsylvania, known lIS Pine Rood (Lot 17 Cold Springs Meadows),
NOW THIS AGREEMENT WITNESSETH I That the Conlraetorfor and in consideration of the
contract aforesaid and the consideralion mentioned thereunder, as well lIS the funherconsideration of One ($1.00)
Dollar 10 him in hand paid by the Owner at or before the sealing and delivery of Ihese presents, the receipt
whereof is hereby llCknowledged. does hereby covenant, promise, and agree that no mechanics' lien or claim or
other lien or claim of any kind whatsoever sholl be med or maintained against the said building or buildings or
the cunilage or cunilages appunenantthereto. by Contractor or by any sub-conlrllCtor, materialmen, or laborers
for work done, or materials fumishcd under said conlract or by any othcr purty acting through or under them or
any of them for and about said building or buildings or any port thereof. or on credit thereof. lIIld that all sub-
contraclors, materialmen and laborers on said work sholl look 10 and hold Contraclor personally liable for all sub-
contrllCts. materials furnished and work and labor done, so that there sholl not be any legal or lawful claim of lIIlY
kind whatever against Owner for any work done or labor or materials furnished under said contracl for and about
the erection, construction, andcompletion of said buildings as aforesaid, or under any contract for extra work or
for work supplementallhereto or otherwise.
AND this agreement waiving the right of lien shall be on independent covenant and shall operale and be
effective as well with respect to work done and materials furnished under any supplemental contract for extra
work in the erection. construclion, and complelion of Ihe said building or buildings lIS any work lIIld labor done
lIIld materials furnished under the contract aforesaid,
AND, in order 10 give the Owner full power ondauthorily to proteclhimselfand the lot or lots of ground
against any wid all claims filed by the Contractor or anyone acting under or Ihrough him or it in violation of the
foregoing covenanl. the said Conlraclor for himself, themselves, itself. hereby irrevocably authorizes ond
empowers any Allomey of any Coun of Common Pleas of Ihe Commonwealth of Pennsylvania, to appear for
him. them, it or any of Ihem, in any of the said Courts of Common Pleas lIS Allorney for him. Ihem, or it ond
in him, their, its, name, mark satislied of record al the cost and expense of the Contraelor or of any Sub-
Contractor or Materialman. or Malerialmen, any and 011 claims or claim. lien or lien, med by or for the
Conlnlctor, or any Sub-Contractor or Malerialman. or in his or their nome against said building or buildings. lot
or lots of ground or any port thereof and for such acl. or acts this sholl be good and sufficient warrant ond
authority, and 0 reference to the Court, Tenn and Number in which and where this Agreemenl sholl hove been
med sholl be 0 sufficient exhibit of Ihe Authorily herein contained to warrant such aClion. and the Contractor for
himself, Ihemselves, itself. do hereby remise. relellSe and quit-claim 011 rights and all manner of errors, defc.:ts
and imperfections whatsoever in enlering such satisfaelion or in anywise touching or concerning the some,
