CCMPLAINT
Plaintiff's, David E. Nye and Susan E. Nye, by their attorneys
Broujos, Gilroy & Houston, P.C., set forth the following:

Plaintiffs, David E. Nye and Susan E. Nye, are adult individuals
residing at 165 Dowling Drive, Kingsland, Georgia 31548.

Defendants, Chester L. Deitch and Kathy M. Deitch, are adult
individuals residing at 1668 West Lisburn Road, Mechanicsburg, PA
17055.

Plaintiffs and Defendants entered into a Lease Agreement dated
April 30, 1994 whereby Plaintiffs leased real estate from the
Defendants at 117 Sinunons Road, Mechanicsburg, PA 17055. A copy of
said Lease Agreement is attached hereto and marked Exhibit "A".

Pursuant to the mentioned Lease Agreement, Plaintiffs deposited the
sum of $400.00 with the Defendants as security deposit.

Plaintiffs fulfilled all terms of said Lease Agreement and vacated
the mentioned real estate in a timely fashion under the Lease
Agreement and after giving appropriate notice to the Defendants.

At the time Plaintiffs vacated the real estate, the real estate was
returned to the Defendants in a substantially same or better
condition than the condition it was in at the time of the
commencement of the lease. There was no damage to the real estate.

Despite repeated demands, Defendants have failed to return to
Plaintiffs the $400.00 security deposit which is properly owing to
them.

Plaintiffs demand double the security deposit pursuant to
Pennsylvania Law based upon Defendant's wrongful failure to return
the security deposit to Plaintiffs in a timely fashion.
WHEREFORE, Plaintiffs demand judgment in the amount of $800.00
against Defendants plus Court costs.

I, Hubert x. Gilroy, Esquire, verify that the facts set for in the
foregoing complaint are true and correct. This verification is
given based upon information that I have received from the
Plaintiffs. This verification is being given by the undersigned
attorney rather than the Plaintiffs themselves based upon the fact
that the Plaintiffs are out of the Cumberland County jurisdiction
at this time and not available to sign a verification. I
understand that false statements herein are made subject to the
penalties of 18 PA. C.S. Section 4904 relating to unsworn
falsification to authorities.

Deitch, through their attorney, Murrel R, Walters, III, Esquire,
and file this Answer and Counterclaim and in support thereof aver
as follows:

5. It is admitted that the Plaintiffs gave Defendants 30 days
notice of their intention to vacate on March 1, 1995 and they did
vacate on March 31, 1995, It is denied that Plaintiffs fulfilled
all terms of the lease and that they did not maintain the property
in an appropriate manner, causing significant damage thereto.

The property was in worse condition when
possession was returned to Defendants,
7. It is admitted that the security deposit was not returned
to Plaintiffs because of the substantial damage to the premises.
A copy of the written repair statement which was mailed to
Plaintiffs on April 27, 1995 is attached hereto, incorporated
herein and marked as Defendants' Exhibit "A",'
8. Denied, Defendants properly and timely notified
Plaintiffs of the significant damage to the property against which
was offset the security deposit and, therefore, the Landlord/Tenant
statute is not applicable.
WHEREFORE, Defendants request this Honorable Court to dismiss
Plaintiff'S complaint with prejudice.

9, Paragraphs 1 through 8 are incorporated herein as if set
forth in length.
10. On April 27, 1995 when the list of repairs as set forth in
Defendants' Exhibit "A" was mailed, there were damages to the
property in the amount of $963.08,
11. After Plaintiffs moved from the property , additional
damages were discovered for a total of $195,50, which are set forth
in more detail in the list which is attached hereto, incorporated
herein, and marked Defendants' Exhibit "B".
12. The total due and owing to Defendants under the lease is
the total of Exhibits A and B, which is $1,158.58, less the
security deposit of $400,00, for a final total due and owing of
$758,58,
