COMPLAINT
Plaintiff, by and through his attorney, MURREL R. WALTERS,
III, ESQUIRE, respectfully represents as follows:
1. Plaintiff, LOUIS B. MICHAELS, is an adult individual who
resides at 864 Hilltop Road, Lemoyne, Cumberland County,
Pennsylvania 17043.
2. Defendants, WILLIAM F. DODSON, JR. and CONNIE M. DOBSON,
are adult individuals who reside at 210 South Second street,
Wormleysburg, Cumberland County, Pennsylvania 17043.
3. On Hay 15, 1993, Defendant, WILLIAM F. DODSON, JR., agreed
to convey to Plaintiff, LOUIS B. MIC:HAELS, real estate improved
with a service station known and numbered as 104 North Front
Street, Wormleysburg, Cumberland County, Pennsylvania. Plaintiff
gave Defendant a down payment of $5,000.00 toward the purchase
prioe of $80,000.
The agreement was conditioned upon Defendant
obtaining certification that the underground fuel oil ~torage tanks
were not an environmental hazard through the year 1998.
4. Defendant subsequently gave Plaintiff information that
there would be a cost of about $10,000 to remove the tanks and
certify that there wam no environmental hazard.
Plaintiff
requested Defendant to remove the tanks but Defendant refused.

F. Dodson, Jr. orally agreed to sell to Louis B. Michaels real estate
improved with a service station, known and numbered as 104 North Front
Street, WonnleY>lburg, Cumberland County, Pennsylvania, f<1r the sum of
$80,000.00. On that same date, Plaintiff gave Defendant $5,000.00 as
a downpayment on tho purchilse price. Contrary to whilt Plaintiff has
averred, however, there was never a condition of certification that
the underground fuel tmlks wore not an environmentill hazard as part of

under the original agreement.
6. Denied. ~'o the contrary, in response to Plaintiff's
attelli>t to tlnter into a new agrc~nt, Defendant rejected the offer
and insisted that Plaintiff J?Elrform on the original agreement.
Plaintiff refused to do SO, in breach of the original agreement.
WHEREf'ORE, Defendant respectfully requests this Court to
enter an Order dismissing Plaintiff's Complaint with prejudice.
