WAIVBR OF RIGHT TO FILE MBCBAHICS' LIBN
WBBRBAS, the undersigned Contraotor has entered into a
contract with the hereinafter mentionod Owners to provide
mat.rials and perform labor necessary for the construction of
improvements upon the real estate herein dsscribed for a good
and valuable consideration.
AND NOW TBBRBFORB, it is hereby stipulated and agreed by
and between the said partios, as part of the daid contraot
and for the consideration therein set forth, and intending to
be legally bound hereby, that neither the undersigned
Contractor, nor any subcontractor or materialman, nor any
other person furnishing labor or materials to the said
Contractor under this contraot shall file a lien, commonly
called a mechdnics' lien, for work done or materials
furnished to the building or any part thereof or any part of
any improvement on the real estate.
This stipulation is made and intended to be filed in the
office of the Prothonotary either prior to the commencement
of the work upon the ground, or within ten days after the
execution of the said contract, in accordance with the
requirements of the Act of Assembly of Pennsylvania, in such
case made and provided.
The Owners are Steven A. DiDomenico and Terry L.
DiDomenico.
The Contractor is Stephen P. Kanagy, whose principal
place of business is at 1411~ Paxtown Run Road, Shippensburg,
PA 17257.
The real estate on which the improvements are to be
erected is described as follows 1 Located at Lot 19, 266
Richland Road, Carlisle, Cumberland County, Pennsylvania:
Beginning at a point on southern dedicated right-
of-way line of Richland Road at corner of Lot No.
18 of Richland Meadows; thence along Lot No. 18,
South 38 degrees 09 minutes 10 seconds East 813.55
feet to a point; thence along lands of Linwood B.
Phillips, Jr., South 47 degrees 21 minutes 30
ssconds West 300.00 feet to a point; thence along
Lot No. 20, North 27 degrees 52 minutes 50 seconds
West 838.64 feet to a point on southern dedicated
right-of-way line of Richland Road; thence along
said right-of-way line of Richland Road, North 47
degrees 19 minutes 30 seconds East 150.00 feet to a
point, the place of beginning.
