that she had breached her lease with Plaintiff. that Plaintilf demanded rents due and owing
and possession of the real estate in question, A hearing was set tor June 16, 1995 at the
District Justice's office, (A true and correct copy of the Notice is all ached hereto and

8, On June 16, 1995 aller the noticed hearing, District Justice Farner found in
favor of Plaintiff in the amounl of back rent of 1,030,21 plus costs of 74, 50 and also

9, Defendant has continued not to pay her rent. fees and costs in breach of her
lease with Plaintiff and the breach continues 10 this date,

ANSWER
COMES NOW the defendant, Elizabeth Lee Cochran, a/k/a
Elizabeth Lee Townsend, by counsel, Philip c. Briganti, Esquire,
Legal Services, Inc., and as her Answer to Plaintiff's Complaint,
states as follows:
1. Admitted.
2. Admitted. However, Defendant has changed her name to
Elizabeth Lee Townsend.
3. Denied. Defendant leases from Plaintiff an apartment
known as 1 East Main street, ~rtment #1, New Kingston, PA
17072. By way of further answer, Defendant avers that the
parties' lease incorrectly identifies her unit as Apartment #2.
4. Admitted.
5. Admitted in part and denied in part. Defendant admits
that she received the letter attached to Plaintiff's complaint as
Exhibit "C". However, Defendant denies that she owes the amounts
claimed by Plaintiff.
6. Admitted. Defendant admits that she has not paid the
amounts claimed. However, as set forth below in Defendant's New
Matter, she denies that she owes Plaintiff theae amounts.
7. Admitted in part and denied in part. Defendant admits
that on or about June 1, 1995, she was served wJ.th a district
justice complaint filed in the office of District Justice Glenn
R. Farner, as well as the hearing notice attached to Plaintiff's
complaint as Exhibit "E". She also admits that the district
justice complaint indicated that Plaintiff demanded rents which
Plaintiff alleged were due and owing, and possession of the real
estate in question. However, Defendant denies that on or about
June 1, 1995, District Justice Farner notified he~ that she had
beached her lease with Plaintiff.
8. Admitted.
9. Admitted in part and denied in part. Defendant admits
that she has continued not to pay her rent, fees and costs.
However, for the reasons set forth below in her New Matter,
Defendant denies that she is in breach of her lease with
Plaintiff.
10. Defendant repeats and incorporates by reference her
averments set forth in paragraphs 1 through 10 herein.
11. Admitted in part and denied in part. Defendant admits
that she has not paid the rent, fees and costs set forth in
paragraph 11 of Plaintiff's Complaint. However, because of
Plaintiff's breach of the implied warranty of habitability and
other reasons as set forth below in Defendant's New Matter, she
denies that there is a total presently due to Plaintiff of
$1,594.71.
NEW MATTER
I. >>reach of the ImDlied Warrantv of Habitabilitv
12. From in or about February, 1994, to the present,
numerous defects have existed at the rental premises, which
endanger the health and safety of Defendant and her family.
These conditions include, but are not limited to, the followingl
a. repeated seepage of raw sewage from the septic system
into Defendant's yard.
b. exposed electrical sockets and wiring defects.
c. no steps leading from tho front door and inadequate
steps leading from the back door, causing Defendant and other
members of her household to fall and suffer injuries while
leaving the dwelling.
d. no locks on the windows, and storm windows which are
faUing out.
e. bathtub drains extremely slowly, and toilet must be
flushed repeatedly (7 or 0 times) before it will empty.
f. windows will not stay up. One window came down on
Defendant's arm, causing deep bruising and soreness.
g. no weather stripping around the doors, allowing water to
enter the dwelling during periods of rain, and causing Defendant
and other occupants to slip and fall.
h. the heating system at the premises, over which Defendant
has no control, caused the temperature inside her apartment to
fluctuate between extreme cold and sweltering heat during the
winter months.
13. Defendant has repeatedly informed Plaintiff of these
conditions, but he has failed to have them correoted.
14. Plaintiff has breached the implied warranty of
habitability by failin~ to correct these conditions, thus
relieving Defendant from all or part of any alleged obligation to
pay rent.
II. ImDroper Eviction No~
15. Plaintiff's eviction notice to Defendant dated May 8,
1995 states that t "If [$640.21] is not paid in full by the 15th
of May, we will consider this an eviction notice and you will
have until May 30th, 1995 to vacate the premises." This notice
is attached to Plaintiff's Complaint as Exhibit "C", which is
incorporated horein by reference.
16. Because this eviction notice is conditi.onal, and is not
clear and unequivocal, it is not an effective notice to quit
under the Landlord and Tenant Act of 1951 (68 P.S. Sections
250.101, ~ ~.).
IV. Late Charaes are Une~forceable aa a Penaltv
17. The parties' Rental Agreement provides that there is a
"$1.00/ day charge for rent paid after the first of the month."
See Plaintiff's Exhibit "A".
18. Because these late fee provisions impose charges which
are excessive and bear no relationship to any losses incurred by
Plaintiff as a consequence of late payment of rent, they are
unenforceable as a penalty.
WHEREFORE, Defendant respectfully requests that judgment be
entered in her favor, and that the relief requested by Plaintiff
be denied.
COUNTERCLAIM
I. Breach ot the Im91ied Warrantv ot Habitabilitv
19. Defendant repeats and incorporates by reference her
averments set forth above in paragraphs 12 through 14.
20. Defendant paid to Plaintiff monthly rent in the amount
of $490.00 for the month a of February 1994 through April 1995, a
total of $73~O.00.
21. Because of the substantial reduction in the use of the
rental premises to Defendant and her family due to Plaintiff's
breach of the implied warranty of habitability, Plaintiff was
only entitled to pay one-half of the contract rent for these
months, for a total of $3675.00.
22, Accordingly, Plaintiff wrongfully collected $3675.00 in
rent from Defendant, to which Plaintiff was not entitled.
WHEREFORE, Defendant requests jUdgment in her favor and
against Defendant in the amount of $3675.00, and such alternative
or further relief as this Court may deem reasonable and just.
II. Conversion
23. Plaintiff, or an agent of the plaintiff under his
supervision and control, without Defendant's consent, removed
from the basement of the building in which Defendant resides, and
has failed to return to Defendant, the following items of her
personal property, which have a total value of approximately
$700.00: a large box of clothes, ~ baby walker, a crib, a high
chair, a bicycle, two boxes of dishes and a box of books.
24. Plaintiff has wrongfully converted these items.
