That the Movant is a secured creditor of Debtors by vlrtue of a promissory note and mortgage dated April IS, 1992 in the original principal amount of $68,000.00. Copies of the promissory note and mortgage are atlD.ched hereto. made part hereof and marked Exhibit A, sald copies being true and correct reproductions of the originals. 4. That Debtors are indebted to the Movant on the mongage referred to in paragraph 3 in the amount of $72,131. 82 calculated as follows: Principal Interest through 3/17/96 Late charges Total: $66,063.09 5,750.29 318.44 $72,131.81 5. That interest will continue to accrue on the mortgage referred to in paragraph 3 from March 18, 1996 at the rate of $17.26815 per day. 6. That the instruments marked E)(hibit A provide that Debtors are responsible for payment of the Movant's attorney's collection fees. 7. That the instruments marked Elthibit A are in default because monthly payments due May 15, 1995, June 15, 1995, July 15.1995. August 15, 1995, September IS, 1995, October 15, 1995, November 15. 1995, December 15, 1995, January IS, 1996, February 15, 1996 and March 15. 1996 were not made. 8. That in addition to the mortgage referred to in paragraph 3. Debtors have also executed a mortgage payable to Movant in the amount of $35,000.00 dated September 13, 1993 and recorded in Cumberland County Mortgage Book 1165, Page 1030. Duncan, Esquire, and files this Complaint in AND NOW, comes Farmers Trust Company, through its attorney, Mortgage Foreclosure, of which the fOllOWing is a statement I 1. Plaintiff is Farmers Trust Company, a corporation organized and existing under the laws of the Commonwealth of Pennsylvania with its main office and principal place of business located at 1 West High Street, Carlisle, Cumberland County, Pennsylvania 17013. 2. Defendants, ROBERT M. SMILEY, JR. and CRYSTAL S. SMILEY, adult individuals, who resides at 255 W. Middlesex Drive, Carlisle, Cumberland County, Pennsylvania 17013. 3. On or about September 13, 1993, Defendants made, executed and delivered to Plaintiff a note and a real estate mortgage financing THIRTY FIVE THOUSAND DOLLARS and NO CENTS ($35,000.00) a copy of said note and security agreement and said real estate mortgage being attached hereto as Exhibits "A" and "B", respectively, and are incorporated herein by reference as though fully set forth. 4. Said note and said real estate mortgage have not been assigned. S. ROBERT M. SMILEY, JR. and CRYSTAL S. SMILEY, are the sole record owners in fee simple of said premises Bubject to said mortgage, by virtue of fl, Deed dated and recorded on April 16, 1992, and recorded in the Cumberland County Recorder's Office in Deed Book "PH, Volume 35, Page 866, more specifically set forth in Exhibit "C", attached hereto and made a part hereof by reference. 6. Said note and said real estate mortgage are in default because Defendants herein have failed to pay the payments that were due and owing for the following months, February, March, April, and May of 1995, said payments being due and payable the 26th day of each month. 7. The Plaintiff has given to the Defendants written notice of intention to foreclose on said mortgage as required by law under Act 6, dated May 4th, 1995, a copy of which is marked Exhibits "D", and attached hereto and made a part hereof by reference. 6. The Plaintiff has given written notice of default as required by the Homeowner's Emergency Assistance Act of 1963, dated May 4th, 1995, a copy of which is marked Exhibits "E", and attached hereto and made a part hereof by reference.
