Thomas A. Placey, Assistant District Attorney of Cumberland
County, Pennsylvania brings the following Petition for a hearing
on charges of Indirect Criminal Contempt:
1. A Protection from Abuse Order was issued by the Court.
A true and correct copy of the Order is attached.
2. The defendant's violation of this Order is averred in
the attached private criminal complaint.
3. The victim requests the filing of an Indirect Criminal
Cont~mpt charge upon information received.
4. The District Attorney's Office approves the filing of
this private criminal complaint.
5. The Commonwealth is requeEting a hearing on the charges
of Indirect Criminal Contempt pursuant to 23 Pa.C.B.A. 56113.
6. The plaintiff and the defendant June seek modification
of the Order based on the filing of this petition as the Court
deems appropriate following the trial in addition to any other

16. The fuets of the most recent incident ofubuse lIre us follows:
On or about August J, 2001, Defendant became en railed because PlalntU'f
could not account for 12 miles of total mileage on her vehicle, and later that
evening after Plalnllff and Defendant were III bcd, Defendant hit Plalnllff
causing a laceration under her eye, Fearhlll for her safety, Plolnllff yelled for
her chlldrcn. Defendant straddled l'lalnllff, put his hand over her mouth, and
threatened to kllJ her, The children came Into the bedroom and their daughter
told Defendant to stop It. ()efendanttold the children that everythhlll was okay
and ordered them to go back to bed. Defendant saw the lacerallon and told
Plalnllff to go put Ice on It.
17. Prior incidents of ubuse thutthe Detcndunt hus eOl1ll1lilled aguinst PluintitT or the
minor ehildJren. (including uny threats, injuries. or incidents of stulking) ure as
follows:
On or about August 1,2001, Defendant called Plalnllffvlle names, followed
her out to the car, and while stlll enraged threw a shoe In her direction causing
her to fear for her safety.
On or about June,20, 200 I, In front of the parlles' son, Defendant became
enraged, screamed, and Interrogated Plaintiff 1'01' over an hour about a
conference she had aUended, and threw a glass of water on hel' exacerbating
her fear.
On or about May 20, 2001, J>efendant forcefully kicked Plalnllff In her leg
causing pain.
On June 28, 1995, Plalnllff med for a Petition for Protecllon from Abuse at the
above-caplloned case and a Temporary Protecllon Order was granted. On
July 5, 1995, the parties entered Into a Consent Agreement which was entered
as a Protccllon Order, On July 5,1996, an Indirect Criminal COllltempt
Complaint was med and on July to, 1996, an Order was entered nndlng the
Defendant In Contempt, sentencing him to six months unsupervised probation,
