At a pre-trial conference held August 27, 1997,
before Edgar B. Bayley, Judge, present for the Plaintiff was
John L. Perry, Esquire; and for the Defendant, Miriam Lehman,
was Roger M. Morgenthal, Esquire; and for the Defendant, Century
21 Associates was Lori Adamcik Kariss, Esquire; and for the
Defendant, Real Estate Enviornmental Services was Linus E.
Fenicle, Esquire.
Plaintiffs purchased a property which they claim
had inadequate water supply for normal household use. They sued
the owner, Mariam Lehman, the listing agent, century 21
Associates, and a water testing company Real Estate
Environmental Services. Since the suit was entered, Plaintiffs
fortunately have been able to secure municipal water service,
Plaintiffs acknowlege that this has resulted in a mitigation of
their damages below arbitration limits. The case is therefore
stricken from the trial list and Plaintiffs should petition for
a board of a~bitrators.
Plaintiffs' demand is $5,000.00. This Court
strongly urges the parties to settle before arbitration.

40. Paragraphs 1 through 39 are incorporated herein by
referenoe.
41. Oenied. REAL ESTATE ENVIRONMENTAL SERVICES retrieved
water samples at the above-reference property. Samples were taken
to a DER approved analytical laboratory for testing of total
coliform bacteria, pH, nitrate, iron, surfactant and total
dissolved oolids.
42. Denied. REAL ESTATE ENVIRONMENTAL SERVICES installed a
reverse osmosis, ultra-violet light and iron filter system
connected to the domestic water system of the home on the above-
referenced property,
43. Denied. At the time of this installation there was no
indication from the home owner, the Lehmans, or any physical
evidence, to indicate that there was not enough water supplied to
the domestic water syst$m by the well that would not sustain the
proper function of the above-mentioned equipment. In fact, there
was a water softener in place that would use substantially more
water than any of the above installed pieces of water equipment.
The Ultra-violet Light does not use any water at all. It only
allows water to pass through the unit as the ultra-violet rays
sterilize the water on its way to the point of use.
The reverse osmosis is only capable of producing and storing
2.5 gallons of purified water at a time. Through its production of
2.5 gallons of water it uses 10 gallons of water supplied by the
source. The time production of 2.5 gallons of useable water is
approximately six(6) hours. In order, to produce a complete 2.5
gallons of purified water from start to finish, it would take over
six(6) hours and have required 10 gallons of water from its source.
The iron filter is a pass through aystem whioh filters out the
iron particulates as the water is forced through. As water is
demanded, the water passes through the filter on its way to the use
point. The only water that is filtered is that water that is
demanded at the use point. However, the unit does use water,
approximately 80 gallons, to regenerate the filter bed. This is
set to regenerate every four(4) days, and is usually set to be done
in the early morning hours, usually between 1-3 a.m.
To summarize the systems. If there was no demand for domestic
water in the home for a four(4) day period, the only water that
would be used by these systems is 80 gallons. This would be an
average of 20 gallons per day used by the installed systems, or
0.83 gallons of water per hour, less than that of a dripping
faucet.
44. Denied. As per ordered by the owners of the property,
the Lehmans' s, REAL ESTATE ENVIRONMENTAL SERVICES was asked to
install the stated water systems.
WHEREFORE, the Defendant, REAL ESTATE ENVIRONMENTAL SERVICES
respectfully requests this Count be dismissed by this Honorable
court, as REAL ESTATE ENVIRONMENTAL SERVICES did provide safe and
adequate drinking water for the residence, as requested by the
Lehman's and as referenced in guarantee letter of July 3, 1994,

warranted that the water system was in satisfactory operating condition "as of the date of this
Agreement. "

Lehman believes and therefore avers that said water system was in satisfactory operating
condition, and that any difficulties experienced with the same by Plaintiffs occwed as a result of

NOW CO/~E, Plaintiffs, Joel E. and Katherine Trolinger, by and
throl.lgh their attorney, John L. Perry, Esquire, and state the
following:
1. plaintiffs, Joel E. and Katherine Trolinger, are adult
individuals residing at 1121 Rebecca street, Carlisle, PA 17013.
2. Defendant, Meriam Lehman, is an adult individual
currently residing at pine Ridge Mobile lIome Park, Carlisle, PA.
3. Defendant, Century 21 Associates, is a licensed real
estate brokerage firm managed by Dick coon, Broker, located at 322
South Hanover street, Carlisle, PA 17013.
4. Defendant, Real Estate Environmental Services, is a
Pennsylvania business located at 31 East Main street, New
Kingstown, PA 17027-1921.
5. It is believed and therefore averred, that sometime prior
to May I, 1994, Defendant, Meriam Lehman, and her late husband,
Glenn Lehman, entered into a Listing Agreement with Defendant,
century 21 Associates, whereby Century 21 Associates would act as
an agent for the Lehmans in an attempt to sell a parcel of land and
a residential dwelling known as 1121 Rebecca street, Carlisle, PA.
6. On or about May 1, 1994, Meriam Lehman and her late
hl.lsband, Glen Lehman, acting through Century 21 Associates as their
listing agent, entered into an agreement to sell Plaintiffs the
parcel of land improved with a resid~ntial dweiling known as 1121
Rebecca street, Carlisle, PA 17013. A copy of this agreement is
attached as Plaintiff's "Exhibit A".
7. SeUers, the late Glen Lehman and, Defendant, Meriam
Lehman warranted, at paragraph 7 of the aforementioned agreement,
that the property was serviced by a well which was in satisfactory
operating condition.
8. Plaintiffs also received a disclosl.lre statement from
Defendant, century 21 Associates, signed by sellers, the late Glen
Lehman and Defendant, Meriam R. Lehman, dated March 31, 1994, a
copy of which is attached herein as Plaintiff's "Exhibit B".
9. Sellers indicated, at questions 8 (a) and (b) of the
disclosure statement, the source of drinking wat~r was a well on
the property which had been tested 5 to 6 years ago and "everything
alright" .
10. SeUers further indicated, at question 8 (b) of the
disclosure statement, that the pumping system for this well was in
working order.
11. In answer to question 6A of the disclosl.lre statement:
"Are you aware of any past or present water leakage in the house or
other structures?" Sellers replied "No".
12. When Plaintiffs inquired regarding the presence of water
in the basement during their inspection of the property, they were
told by employees of Defendant, century 21 Associatos, acting as an
agent of the Sellers, that any water in the basement was the result
of a malfunctioning refrigerator.
13. On May 1, 1994, Plaintiffs and Sellers, the late Ghm
Lehman and Defendant, Meriam Lehman, signed a Private Water/Septic
Addendum to Agreement of Sale which was incorporated as part of the
above-referenced sales agreement pursuant to paragraph 10 of that
agreement.
14. Pursuant to the terms of that Private Water/Septic
Addendum, Sellers were to secure, at their expense, a written
bacteriological and chemical analysis of the well water performed
by a water testing laboratory certified by the pennsylvania
Department of Environmental Resources.
15. Sellers did secure such a test of the well water by
Defendant, Real Estate Environmental Services.
16. The results of this testing indicated that the water did
not meet minimum standards established by the Environmental
Protection Agency.
17. In order to secure a mortgage guaranteed by the Veteran's
Administration, Plaintiffs were required to present a report from
a licensed laboratory indicating that the well water was acceptable
for both bacteriological and chemical levels as established by the
E.P.A.
18. In order to comply with the requirement, Real Estate
Ehvironmental Services, installed a reverse osmosis water system,
an I.lltra-violet light water system and an iron filter on the well.
19. By a letter of gl.larantee dated July 5, 1994, attached
herein as Plaintiff'5 "Exhibit C", Real Estate Environmental
services gl.laranteed that the I.lltra-violet light water system wOl.lld
redl.lce the total chloroform level to "0".
20. By the aforementioned letter of guarantee, Defendant,
Real Estate Environmental services, guaranteed that the reverse
osmosis water system would reduce the levels of dissolved solids to
within the standards prescribed by the Environmental Protection
Agency.
21. By the aforementioned letter of guarantee, Defendant,
Real Estate Environmental Services, guaranteed that the iron filter
system would reduce the iron levels to the recommended safe levels
established by the Environmental Protection Agency.
22. On or about July 15, 1994, Plaintiffs closed on the
purchase of the above referenced real estate.
23. Plaintiffs subsequently occupied the residence at 1121
Rebecca street, Carlisle, PA.
24. wi thin twenty minutes after Plainti ffs began to draw
water, the well ceased to provide sufficient supply for normal
household use.
25. From this initial failure I.lntil the present time, the
well has failed to provide adeql.late water for normal household use.
26. plaintiffs have been advised that the water flow is
insuff icient for the proper operation of the aforementioned reverse
osmosis water system, ultra-violet light water system and iron
f 11 ter.
27. In order to provide adequate water for normal household
use, Plaintiffs must either drill a new weli or extend city water
service at their expense.
28. During periods of heavy rain, Plaintif fs have experienced
significant infiltration of water into their basement through the
foundation at and near the ouside entrance to the basement.

30. Defendant, Mer iam l,ehman, knew or should have known, t.hat
the water sl.lpply produced by the well in question was inadequate to
produce suff icient flow for normal household use and that the
basement of the residence was subject to water infiltration.
31. Defendant, Mpriam Lehman, was under a dut.y to inform any
perspecti ve purchaser of her property of these condi tions regarding
water supply and water infiltration.
32. Defendant, Meriam Lehman, directly and through her agent,
century 21 Associates, failed to disclose these conditions to
Plaintiffs
33. Defendant, Mer iam [,ehman, di rectI y and through her agent,
centl.lry 21 Associates, talsely and materialiy misrepresented the
water sl.lppl y and water inti L trat Lon into the basement at the above-
referenced property.
34. PLaLntllts reLLed on the false and misleading
representations of Defendant, Meriam Lehman, in purchasing the real
estate in question.
WHEREFORE, Plaintiff prays this Honorable Court award the
actual costs of providing safe and adequate water suppiy for their
residence and correcting the water infiltration problem or in the
aiternative, award the reduction in market value of the property
caused by the lack of adeql.late wator supply and the infiltration of
water to the basement, as well as reasonable compensation for the
distress and inconvenience during their residence without adequate
water supply and such other. reI ief as this Honorable COl.lrt may deem
appropriate.
COUNT II
JOEL E. & KATHERINE TROLINGER vs CENTURY 21 ASSOCIATES
35. Paragraphs 1 through 34 are incorporated herein by
reference.
36. Pursuant to the Listing Agreement entered into by
Defendant, Meriam Lehman and her late husband, Glen Lehman, and
Defendant, Century 21 Associates, at all times relevant hereto,
Century 21 Associates acted as an agent for Defendant, Miriam
Lehman.
37. The false and misleadinq misrepresentations concerning
the availabil i ty of water supply and water inf il tration at the
above-referenced property were provided to Plaintiffs by Defendant,
Century 21 Associates, acting as an agent of Defendant, Meriam
Lehman,
38. At the time Defendant, Century 21 Associates, made the
representations described above, Defendant, Century 21 Associates,
knew they were talse or made the representations with a reckless
disregard for their truth or falsity.
39. Plaintiffs relied on the representations of Century 21
Associates acting as an agent of Defendant, Meriam Lehman, in their
purchase of the above-referenced property.
WHEREFORE, Plaintiffs, pray this Honorable Court award the
actual costs of providing safe and adequate water supply for the
residence and correcting the water infiltration problem or in the
alternative, award the reduction in market value of the property
caused by the lack of adequate water supply and the infiltration of
water into the basement, as well as reasonable compensation for the
distress and inconvenience during their residence without adequate
water supply and such other relief as this Honorable Court may deem
appropriate.
COUNT II I
JOEL E. & KATHERINE TROLINGER vs REAL ESTATE ENVIRONMENTAL
SERVICES
40. Paragraphs 1 through 39 are incorporated herein by
reference.
41. Defendant, Heal ~atate ~nvironmental Services, condl.lcted
tests of the water quali ty on the well located on the above-
referenced property.
42. Defendant, Real Estate Environmental Services, installed
the aforementioned Reverse Osmosis Water system, Ultra-Violet Light
Water System and iron filter on the well located on the above-
referenced property.
4.1. At the time of this installation, Defendant, Real ~state
~nvironmental services, failed to adequately test these water
systems to ascertain if thore was sufficient flow to sustain their
effective I.lse during normal household demands.
44. Vlaintiffs relied on the guarantees and representations
of Defendant, Real ~state ~nvironmental Services, in the purchase
of the above mentioned real estate.
WHEREFORE, Vlaintiffs pray this Honorable courc award actual
costs of providing safe and adequate water supply for the residence
or, in the alternative, award the reduction in market value of the
property caused by the inadequate water supply as well as
reasonable compensation for the distress and inconvenience dur.ing
their residence without adequate water supply and sl.lch other relief
as this Honorable Court may deem appropriate.

actual costs of providing a safe and adoquate water supply for
their residence or, in the al ternati ve, award the reduction in
market value of the property caused by the lack of adequate water
supply and the infiltration of water into the basement, as well as

A motion to approve the June 19. 1995. minutes was made by Mr.
DeRemer, Mr. Stewart seconded the motion, and It paulld
unanlmoullly.
~ YISITORS.
~ Mr. and Mrs. Joel Trollnqer of 1121 Rebecca Street. stated
that their home III presently uslnq unsafe well water. The
well Is not capable of produclna enouah water to supply their
home. and thev sometimes are without water for davs. Mr.
Trollnqer has Ilome health prohlems that are aaQravated by lack
of water. Some well-drllllnq companies have provided
estimates to drill further down. but the cost Is too
excessive, so the Trollnqers would prefer not to drIll for a
new well. They are 250 teet from Carlisle Borough water
lines. The Borouqh advised them to talk to the Authority
ber:ause the water lines are actually located In North
Middleton Township. The Trollnqers have petitioned their
nelqhborhood to hook up. but no one else Is Interested. Their
request to the Board was to reqUire the rest of the nulqhbors
(five homes) to hook up. Hr. Koch reviewed costs of tapplnq
fees which would be Involved should they be allowed to hook
up. A dlecusslon took clace Involvlna the Authority taklnq

Indicated they had not. Mrs. Trollnqer did not think that was
a feasible option. Hr. Gilroy asked to review their well test
results. Mrs. Trol1nqer had test results with her. and
prOVided caples to Hr. Koch. Mrs. Trollnqer asked If there
was a law requlrlnq water to be provided to homes. and Hr.
Smith said It basically Is up to the homeowner to Insure that
they have water. Hr. Gilroy aqreed. Mr. Smith said he'd like
the Board to look Into the matter and then approach the
Borouqh on behalf of the Trollnqers. but that no answer would
be forthcomlnq tonlqht.
Later. more discussion amonqst members of the Board concernlnq
this matter centered on Possible health problems caused by the
contaminated well water and various alternatives were
dlscuued concernlnq how to effect hooklnq up for Rebecca
Street. Mr. GIlroy,stressed the health urqency Involved. and
suqqested dolnq a detailed report to present to the Borouqh
and ask for the necessary capacity for five homes.
Hr. Smith made a motion that Hr. Koch pursue neqotlatlons With
the Borouqh of Carlisle reqardlnq water line responsibilities
relatlnQ to speCific streets to upQrade the system. Hr.
DeRemer seconded the motion and It passed unanimously. A
report should be tendered to the Board before the October
meetlnq.

5. A second statement by Dr. Hatleberg dated February 10, 1997 Is attached as Exhibit
"C." Said statement referenced her hospitalization for recurrent symptoms of transient Ischemic
attack symptoms and specifically stated that her deposition should be postponed Indefinitely
because of her poor health.
6. Attorney Perry was afforded the opportunity to speak directly with Dr. Hatleberg, and
Petitioner understands that he has done so and Is therefore well informed as to her condition.
7. Because of the nature of the case, involving a claim for damages resulting from
alleged misrepresentation and/or withholding of relevant Information pertaining to her former
residence which was sold to Plaintiffs, Petitioner's testimony at trial Is essential to her defense.
8. Based upon Dr. Hatleberg's statements, Petitioner's condition may never improve to
the point that she may attend and participate In a court trial; but It Is possible that with proper care,
she may be able to give a deposition at some point, or participate in a limited way.
9. As set forth in Pa. R.C.P. Rule 16(A)(2), Illness of a party constitutes grounds for
continuance.
10. Petitioner will be continuing under the care of Dr. Hatleberg, and periodic reports of
her condition will be available, and counsel for Plaintiff has already been granted on-going
permission to speak directly with Dr. Hatleberg as noted above.

NOW COMES, Plaintiffs, Joel E. and Katherine TrOlinger, by and
through their attorney, John L. Perry, Esquire. and, in response to
Defendant/Peti tioner, Miriam Lehman's, Motion for Continuance,
states the following:

Denied:
'rhis action was commonced by the filing of a
writ of Summons on June 29, 1995. Counsel for Plaintiffs was first
notified of Petitioner's medical condition on May 20, 1996. By way
of further Answer, on September 27, 1996, Counsel for Petitioner
Lehman represented to Counsel for Plaintiffs that his client was
"ready, willing, and able to submit to the deposition and to
proceed with litigation". A copy of this letter is attached as
Exhibit A.
4. Denied in part, Admitted in part: It is denied that the
Petitioner was scheduled to participate in a deposition on April
Petitioner was scheduled to participate in a deposition on April
20, 1996. Petitioner was scheduled to part icipate in Ii deposition
at the office of Plaintiff's counsel on May 20, 1996. Less than
one hour before that deposi tJ.on was scheduled to take place,
counsel for Plaintiffs received a call from Petitioner's counsel
informing him that she could not participate in the deposition due
to her physical and emotional condition at that time. Plaintiff's
counsel was provided with a copy of the note from Doctor Hatleberg
attached to Petitioner's Motion for Continuance as Exhibit B.

6. Admitted in part, Denied in part: It is admitted that
counsel for Plaintiff may speak directly wi th Dr. lIatleberg and has
done so. By way of further answer, Counsel for Plaintiffs did
discuss briefly w.tth Dr. Hatleberg the definition of transient
ischemic attack and his opinion regarding possible causes.
However, Plaintiff's Counsel is not "well informed" as to
Petitioner's present condition.
7. Denied: Plaintiffs never spoke or otherwise communicated
directly with Petitioner or her late husband. The alleged
misrepresentations were contained in written documents and/or oral
statements from real estate agents based upon information provided
by Petitioner and her late husband. The facts regarding any
misrepresentations conGerning the real estate transaction can be
developed at trial through Exhibits and testimony of real estate
agents working on behalf of Petitioner and her late husband.

Envlrorunental Services (contributing $500.00), Payen, the receipt whereof Is hereby
acknowledged, have released and discharged, and by these presents do for ourselves, our
heln, executors, adm1nlstrators and assigns release and forever discharge the said Payers,
their Insurance companies and all other persons, firms and corporations, both known and
unknown, their heirs, executors, admlnlstrators, affiliates, successors and assigns, of and from

magazines, Journals, radio or television, the facts, tenns or conditions of this Release and
settlement. All parties to this Agreement expressly agree to decline comment on allY aspect
of the Release and settlement to any member of the news media. Thls paragraph Is Intended
to become pan of the consideration for the settlement of this claim.
The undersigned hereby declare for themselves that the tenns of this settlement have
