THIS AGREEMEN'r, made the) : 'I day of .June,. 19% by and
between JOHN FOGAR'l'Y CUSTOM BuH,r-l1oMEll, INC., a ,cor~ation
organized and existing under the lawB of the commonwtJI'lth of
Pennsylvania, with officos at 4701 North Front street,
Harrisburg, Pennsylvania 17110 (hereinafter referenced as
"contractor")
AND
GARY I. WHITE and DENISE R. WHITE, husband and wife, of 250 Easy
Road, CarliSle, Pennsylvania 17011 (hereinafter referenced as
"Owner"), whereby the former undertook and agreod to erect and
construct a single family residential dwelling on that certain
lot of ground situate in Dickinson Township, Cumberland county,
Pennsylvania, more pal.ticularly bounded and described as Lot No.
1 on the Final subdivision Plan of Green Hill as recorded in Plan
Book 55, Page 17.
NOW, THEREFORE, THIS AGREEMENT \HTNESSE'l'H: That the said
contractor, for and in consideration of the sum of One and No/lOa
($1.00) Dollar to it in hand paid by Owner, the receipt whereof
is hereby acknowledged, and tho further consideration mentioned
in the agreement aforesaid, for themselves and their
subcontractors, and all parties acting through or under them,
covenant and agrea that no mochanic's liens or claims shall be
filed or maintained by them or any of thom against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or matoria1s furnished by them or any of
them under said contract or otherwise, for, towards, in or about
the erection and construction of the said buildings on the lot
above-described, and the said Contractor, for themselves, their
subcontractors and othors under thorn hereby expressly waive and
relinquish the right to have, tile and maintain any mechanic's
liens or claims against the said buildings or any of them, and
agree that this inclrument, waiving tho right of lien, shall be
an independent covenant.
