discovery.

AND NOW, this 29th day of September, 1997, comes the
Plaintiff, James Robinson, by his attorney, Darrell C. Dethlefs,
Esquire, and files the following Complaint against the Defendant
and in support thereof avers aa follows:
1. The Plaintiff, James Robinson, is an adult individual
residing in Harrisburg, Dauphin County, Pennsylvania.
2. The Defendant, Clarence A. Keefer, is an adult individual
residing at 10561 Tanyard Hill Road, Orrstown, Pennsylvania 17244.
3. On or about June 30, 1993, at approximately 11:10 a,m.,
the Plaintiff was operating a vehicle northbound on Interstate 1-81
in Cumberland County, Pennsylvania, approximately nine (9) miles
South of Carlisle and just North of mile post 37.
4. On or about June 30, 1993, the Defendant was operating
a vehicle behind the vehicle being operated by the Plaintiff on
Interstate r-81 in Cumberland County, Pennsylvania.
5. At the time of the accident, the Plaintiff, James
Robinson, was working for the Pennsylvania Department of
Transportation.
6. As the Plaintiff was traveling North, he slowed the
vehicle he was operating to turn into a construction site on
Interstate 1-81.
7. As the Plaintiff, James Robinson, slowed to turn into the
construction site, the Oefendant, Clarence Keefer, struck the rear
of the vehj,cle being operated by the Plaint if f, James Robinson.
8. When the vehicle being operated by the Plaintiff, James
Robinson, was struck by the vehicle being operated by the
Defendant, Clarence Keefer, the Plaintiff suffered serious and
permanent injuries.
9. As a result of the accident, the Plaintiff, James
Robinson, suffered serious injuries to his neck, and back,
10, The accident which occurred on June 30, 1993, and the
injuries suffered by the Plaintiff, James Robinson, were caused
solely and directly by the negligence of the Defendant, Clarence
Keefer, as follows:
a. In failing to stop his vehicle prior to striking the
vehicle being operated by the Plaintiff, Mr. Robinson;
b. In driving his vehicle at a speed which was too fast
for prevailing road conditions;
c. In operating his vehicle at a speed and in a manner
which prevented him from colliding with the vehicle being
operated by the Plaintiff;
d. In failing to observe the vehicle being operated by
the Plaintiff; and,
e. In following the Plaintiff's vehicle too closely
11. As a result of the negligence of the Defendant, Clarence
Keefer, the Plaintiff, James Robinson, suffered serious injuries to
his neck and back for which a claim is made.

AND NOW, this 31st day of December, 1997, comes the Plaintiff,
James RObinson, and replies to New Matter of the Oefendant as
follows:
17. Denied. The averments contained in Paragraph 17 state
conclusions of law to which a response is not required. If it is
determined that a response was required, the Plaintiff denies that
his Complaint fails to state a claim with cause of action against
Mr. Keefer upon which relief may be granted. Proof to the contrary
is demanded at time of trial.
18. Denied. The averments contained in Paragraph 18 state
conclusions of law to which a response is not required. If it is
determined that a response was required, the Plaintiff denies that
his injuries and damage were the result of actions or inactions of
individuals or entities over which the Defendant, Mr. Keefer, his
agents, servants, or employees neither exercised nor had the right
or. duty to exercise control, and for whose actions or inactions
that Defendant, Mr. Keefer, is not responsible or otherwise legally
liable, Proof to the contrary is demanded at time of trial.
19. Denied. The averments contained in Paragraph 19 state
conclusions of law to which a response is not required. If it is
determined that a response was required, the Plaintiff. denies that
the cause of action set forth in his Complaint is barred by the
operation of the contributory/comparative negligence of the
Plaintiff as may be developed during the discovery. Proof to the
contrary is demanded at time of trial.

determined that a response was required, the Plaintiff denies that
