RETURN WHEELS FOR A REFUND..

RESPONSIBILITY FOR RETURNS, SINCE WE FULFILLED ORDER ONLY
AT COSTUMER REQUEST. COSTUMER CHOSE AGAINST COMMONSENSE,

COMPLAINT
AND NOW, this 18th day of July, 1995, comes the
Plaintiff, Caroline Mosley, respectfully avers the followingl
1. The Plaintiff herein is Caroline Mosley, an adult individual,
who currently resides at 2131 King Arthur Ct. Harrisburg, Pa. 17110.
2. The Defendant, Alex DeLay, is an adult individual, who currently
does business at 632 Enola Road, East Pennsboro Twp., Cumberland Co.
3. The events hereinafter complained of occurred on April 12, 1995,
when the Plaintiff and Defendants entered into the following oral
agreement I Plaintiff requested 4 wheels for her 1983 Nissan Maxima.
The Defendants assured Plaintiff that the wheels would be the correct
size and agreed to sale her the 4 wheels for $284.00.
4. On April 12, 1995, the above agreement was entered into orally
between the parties and at that time, Plaintiff paid the Defendants
the sum of $284.00 and Defendants agreed to order and deliver ths
proper wheels.
5. Approximately five days after April 12, 1995, the wheels arrived.
6. On April 21, 1995, the plaintiff had Tire America place the
wheels on her vehiCle.
7. The Defendants have breached said sales agreement in that they
have failed to secure the right size wheels for Plaintiff's vehicle.
8. The Plaintiff has expended the following cost as a result of
the Defendants' breachl
(a) Cost of wheels 1284.00
(b) Cost of Installation of wheels $38.12
(c) District Justice costs $54.60
(d) Loss of 2 tires $119.96
9. plaintiff has expended the sum of $75.00 for legal assistance
as a result of Defendants breach.
WHEREFORE, Plaintiff demand judgment against the Defendants
in the amount of $571.68, plUS all costs in connection with this suit
and interest from April 12, 1995.
