Mechanicsburg, Cumberland County, Pennsylvanill 17055,
2, Defendant, Daniel S, Beaver. is an adult individual who resides at J Hood Cove, East
Berlin, Pennsylvania 17316,
J, On or about July 6. 1993. PlaintilTwas a passenger in a 1991 Eagle Summit owned
and operated by Victoria L. Beaver.
4. On or about July 6. 1993. Plaintitl: while a passenger in aforesaid Eagle Summit. was
traveling on Route 641 (East Trindle Road) in ClImp Hill, Cumberland County, Pennsylvania.
5, On or about July 6, 1993. Defendant, Daniel S, Beaver. was operating a 1986
Fleetwood Cadillac on Route 641 (East Trindle Road) in Camp Hill, Cumberland County.
Pennsylvania,
6, On or about July 6, 1993. the aforesaid Eagle Summit in which PlaintilT was a
passenger was involved in II collision with the 1986 Fleetwood Cadillac being operated by
Defendant while the vehicles were on Route 641 (East Trindle Road),
7. At the aforesllid time and place, Plaintiffwns caused to sustain severe injuries to her

c, foraminal compression; and
d, pain and restrictions in the cervical spine,

and undergo medical attention, care, and expenses for the injuries she has sulTered and may be
obligated to continue to incur such expenses for an indefinite time in the future,

I, The above-captioned action arises out of an automobile accident which occurred on
July 6, 1993.
2, Plaintiff initiated this action by filing a writ of summons and subsequently filed a
Complaint on or about May 10. 1996,
J, The parties have exchanged extensive wrilfen discovery, including all medical
records and background information surrounding Plaintiffs claims,
4, On or about November 5, 1996, Plaintitl's counsel was contacted by the PlaintilTwho
advised that she wns no longer desirous of having Plaintiffs counsel represent her.
5, Plaintiffs counsel was then contacted by his client who ndvised that she was not
desirous of discharging Plaintifl's counsel but simply wanted to try and negotiate a selflement

6, On or about December 5. 1996, Plaintifl's counsel was again contacted by his client
who advised that she wished to terminate the representation and would be retaining new counsel.
Plaintiffs counsel provided her with all original me materinls,
7, On or about December 13, 1996, Plaintiffs counsel received a call from Richard
Freeburn, Esquire, an alforney in Harrisburg, advising that he had reviewed Ms. Spahr's case with
her and the contents of the flIe, but indicated that he was unwilling to assume handling of the file
and would not be entering his appearance,
8, Plaintiffs counsel believes that he can no longer adequately represent his client for
various reasons under the Rules of Professional Conduct, Rule 1,16,
9, Plaintiffs counsel has also been discharged on two occasions by the Plaintiff, and
hereby seeks court approval to withdraw his appearance for I'laintin~

I. The above-captioned action arises out of an automobile accidcnt which occurred on

2. Plaintilf initiated this action by filing. a writ of summons and subsequently tiled a
Complaint on or about January II. 1996.
3. The parties have exchanged extensive wrillen discovery, including all medical
records and background information surrounding Plaintill's claims.
4. This case was previously subject to a discovery motion and order compelling the
Plnintilfto provide various discovery. A copy of Judge Oler's Order of August 20, 1996 is hereby
all ached as Exhibit "A".
5. In allempting to comply with that Order. Plaintill's deposition was originally
scheduled for Tuesday. November 19. 1996.
6. On or about November 5, 1996, Plnintill's counsel was contacted by the PlaintilTwho
advised that she was no longer dcsirous of having Plaintill's counsel rcpresent her. This
communication was promptly transmilled to counsel for the Defendant. A copy of the Defendant's
confirming leller of Novembcr II. 1996 to Plaintitl's counsel is hereby all ached as Exhibit "B".
7. Plaintill's counsel was thcn contactcd by his client who advised that she was not
desirous of discharging Plaintitl's counsel but simply wanted to try and negotiate directly with
Defendant's insurance company. If that settlement tidied, she desired counsel to allend the
deposition with her.
R. Therefore. Plaintitl's deposition was rescheduled for Monday. December 9. 1996 at
9:30 a.m.
9 On or about December 5. 19%. l'laintitl's counsel was again contactcd by his client
who advised that shc wishcd to terminate the representation nnd would bc rctaining new counscl.
Plaintitl's counsel provided her with nil originallile materials.
10. On or about December 13, 19%, Plaintill's counsel rcccivcd a call from Richard
Freeburn, Esquirc, an allorncy in Harrisburg, advising that hc hnd rcviewcd Ms. Spahr's casc with
her and the contents oftilc IiIc, but indicated that he was unwilling to assumc handling of the file
and would not bc entering his appearance.
II. On or about Dccembcr 13, 1996, l'laintill's counsel rcccivcd a call and dcposition
noticc Irom counsel for the Defendant selling Plaint ill's deposition for December 20, 1996.
12. Plaintitl's counsel believes that he can no longer adequately represent his client for
various reasons under the Rules of Professional Conduct, Rulc I. 16.
13. Plaintitl's counsel has also been discharged on two occasions by the Plaintiff. and
hereby seeks court approval to withdraw his appcarance for Plaintiff.
14. Since Defendant's allorney has scheduled the deposition for December 20, 1996 at
10:00 a.m., PlnintilTalso seeks a protective order prohibiting the scheduling ofPlaintitrs deposition
until January 20, 1996.
15. Plnintitl's counsel bas faxed a copy of this Motion to Defendant's counsel and orally
advised the PlaintilTthat he will be filing the Motion.
WHEREFORE, Plaintitl's counsel requests that he be granted court approval to withdraw
his appearance and that the court issue a protective order prohibiting Plaintitl's deposition until
January 20, 1997.
