Scheduling of Arbitrators
Dear Gentlemen:
Please be advised that on Friday morning, February 9th, I had an
opportunity to review your Notice of Hearing by Board of
Arbitrators dated January 29, 1996. The purpose of this instant
correspondence is to request that this matter be vacated and
rescheduled so as to better accommodate my schedule,
Currently, my largest impediment to moving forward to arbitration
on Friday, March 8th, is the fact that I am scheduled for a jury
trial in the County Court of Routt County, ColOl'ado, in Case No,
95T644, ~lli Y-t. Charles Clark, on March 7, 1996. Because it is
impossible to gauge when a jury verdict can be expected to be
received in that case, it simply is not possible for me to make
any arrangements on that day for travel, Assuming, roughly four
hours of air travel from Colorado to Pennsylvania, as well as the
fact that Steamboat Springs is Bome 200 miles from Denver
International Airport, reasonably expecting my appearance on
Friday, March 8th, is unrealistic under these circumstances,

As a general matter, my month of March is essentially "booked" at
this juncture. However, because of settlement of other matters,
my calendar in April is fairly open. The resetting of
arbitration on any of the following days is acceptable I April 1
through 3/ April R through 12/ April 18 or 19, April 29 or 30.
It would be appreciated if you could review your schedules to see
whether these a 1 tern,1t ille diltes olrc accl~rtuble t.:l you. Because I
have extended family in the Philadelphia area, the rescheduling
this matter around the Easter holiday (Sunday, April 7th) would
work best into my schedule, assuming such is acceptable to all
the other parties.
I would be more than happy to arrange for a conference call
between all the parties if such would facilitate the rescheduling
of this arbitration, Your prompt attention to this matter ie

C. Plaintiff's claims are barred by the Doctrine of Waiver,

Plaintiff's knowing and voluntary acts or omissions, and
Piaintiff is accordingly estopped from requesting the relief
asserted herein,
E, Plaintiff has failed to mitigate her damages, if any, as
required by law and Plaintiff is, therefore, barred from recovery
against Defendants,
F, Plaintiff does not have "clean hands" in the matter in
question herein, nor is Plaintiff attempting to fair or equitable
and Plaintiff should be denied any relief by this Court,
Q, Defendants may not be the party concerning the claimed
damages of Plaintiff,
H, Any of the injuries or damages claimed by Plaintiff, if
any, were the result of actions of Plaintiff or other third
parties which neither preclude or diminish any right of recovery
by Plaintiff.
I. The injuries and damages claimed by Plaintiff are the
result of third persons or other persons over whom Defendants
have no control or right of control.
J, All of the injuries or damages sustained by Plaintiff,
if any, were the result of circumstances which were
uncontrollable and which Defendants could not have reasonably
anticipated,
K, Plaintiff's Cause of Action is groundless and frivolous
such that Defendants should be awarded their reasonable
attorneys' fees and costs in defending this claim.
WHEREFORE, Defendants respectfully request that this Court
enter Judgment in favor of Defendants and against Plaintiff, that
the claims of Plaintiff be dismissed with prejudice, that
Defendants be awarded their costs, attorneys' fees as provided by
common law or statute, and request other and further relief as
this Court deems pt"oper under the circumstances.
