AND NOW, this 23rd day of February, 1996, after
hearing and consideration of the testimony presented, we do find
the Defendant to be in contempt of our Order of July 20, 1995.
We specifically find that the Defendant did follow Jeseica A.
Rupp on February 13, 1996, in his automobile for an extended
period of time, all in violation of our prohibition against
such. He also followed the victim to her residence at 718 Longs
Gap Road, all of which is in violation of our Order.

AND NOW, this day of February, 1996, this Court
certifies that the attached complaint has been properly completed
and verified, and there is probable cause for the issuance of
process. In consideration of the attached commonwealth's
Petition, a WARRANT IS ISSUED FOR THE ARREST of the Defendant,
DIAUNTA EVANS.
If the defendant is found during normal courthouse hours,
the defendant is to be brought immediately before the Court. If
not found during courthouse hours, the defendant is to be taken
to the on-call District Justice and bail set pursuant to the
Rules of criminal Procedure, Furthermore, after appearing before
the District Justice the defendant is advised to appear before

Michael S, Schwoyer, Chief Deputy District Attorney of
Cumberland County, Pennsylvania brings the following Petition for
a hearing on charges of Indirect Criminal Contempt I
1. A Protection from Abuse Order was issued by the Court.
A true and correct copy of the Order is attached.
2. The defendant's violation of this Order is averred in
the attached criminal complaint,
3. The victim requests the filing of an Indirect Criminal
Contempt charge upon information received.
4. The District Attorney's Office approves the filing of
this private criminal complaint.
5. The Commonwealth is requesting a trial on the charges
of Indirect criminal Contempt pursuant to 23 Pa.C,S,A, S61l3.
6. The plaintiff and the defendant may seek modification
of the Order based on the filing of this petition as the Court
deems appropriate following the trial in addition to any other

2. The Cumberland County Sherlfrs Department attempted to serve the defendant
several time.! with a certified copy of the Temporary Protection Order and Petition for Protection
Order at his residence, but the Sherlrrs Department has not effected service since the defendant
was not at home.
3, The plaintiff reque'ts that the hearing be rescheduled In this matter.
4, The plaintiff requests that the Temporary Protection Order remain In effect until
modified or tennlnated by the court after notice or hearing.

The defendant violated the Order issued under the Protection From Abuse Act in No.95-3658
on 20th day of July, 1995, by the 1I0norable George E. 1I0ffer,Judge, ,,,hich Order directed the
defendant not to: physically abuse or place her in fear of abuse, have direct contact with
Jessica Rupp, or to harass Jessica A, Rupp in that he did run up to a car that Jessica Rupp
was seated in and try to get in the car putting ~ls. Rupp in fear of being abused and then he
did throw a full 40 oz. St. Ides Nalt Liquor bottle at the driver's door ",indo", that ~ls, Ru~p

AfFIDAVIT RIDER CONTAINING PROBABLE CAUSE FOR THE ISSUANCE OF A WARRANT OF ARREST
FOR Diaunta S, Evans 130 North Pitt St. C.lrlisle. Pn. 17013 O.O,B.HOC,/lOI7C,
On 02/17/96 at 21:40 IIrs. Jessica A, Rupp was sitting in a car she had borrowed from
a friend waiting for her boyfriend to come out of his house. She hod parked the 1981
Toyota Corolla bearing Pa.#MB-lllO in the tvest locust St, Nunicipal Parking lot facing in
o westernly direction towards the alley to the rear of her boyfriends house,
While she was sitting in the car she observed Diaunta Evans who she has a Protection
From Abuse Order on running towards the car. She became scared that he was going to hurt
her so she attanpted to put the car in drive. Evans reached the car and started pulling
on the drivers' door handle which was locked. Ms, Rupp started to pull away as Evans was
pointing to open the door. She didn't and started to pullout at which time Diaunta Evans
threw a 40 oz. St. Ides Malt liquor bottle at the driver's window shattering the door's
window with the full bottle of malt liquor, The glass from the window and the bottle flew
against ~~. Rupp's head, body and hands. Glass fragments were throughout her hair and she
sustained small lacer~.ions on both her hands three of which were on the thumb, pinky, and
middle finger of her left hand and one on the thumb of her right hand.
Ns. Rupp was able to drive away and headed towards the Police Station but located this
officer in the 100 block of S. Hanover St. Upon seeing ~~. Rupp the glass fragments were
still in her hair and about her clothes. She was bleeding from several small lacerations
on her hands. She was taken to the Police Station where we attended the lacerations on
her hands and removed the glass from her hair.
A glass fragment was recovered from the car that belonged Albert Crowl Jr. The glass
was from the St. Ides bottle and still had the label in part on the fragment. Damage to
the window is estimated at approx. $100,00, The glass fragment was lying on the front floor
of the car when it I~as recovered,
I feel that this is sufficient probable couse for the arrest of Diaunta S. Evans 130
North Pitt St. Carlisle, Pa, 17013 D.O.B.#06/10/76 for Indirect Criminal Contempt for
violating Order No.95-3658 issued on July 20, 1995 by the Honorable Geroge E, 1l0ffer,Judge.

The plaintiff moves lhe Court for an Order rescheduling lhe hearing In the above-
captioned case on the grounds that:
1. A Temporary Protection Order was issued by this Court on July 7, 1995,
scheduling a hearing for Thursday, July 13, 1995, at 9: 15 a,m.
2, The Cumberland County Sheriff's Department allempled to serve the defendant
several times with a certified copy of lhe Temporary Protection Order and Petition for Protection
Order at his residence, but the Sherifrs Department has not effected service since Ihe defendant
was not at home.
3, The plaintiff requests thai the hearing be rescheduled in this mailer.
4, The plaintiff requests that the Temporary Proteclion Order remain In effect until
modified or terminated by the court after notice or hearing,
5, Certified copies of the Order for Continuance will be delivered to the North
Middleton and Sliver Spring Township Pollee Departments and to the Carlisle Pollee Department
by the allorney for the plaintiff.

IN REI DEFENDANT FOUND GUILTY & SENTENCING
ORDER OF COURT
AND NOW, this 27th day of February, 1996, after
hearing and consideration of the testimony presented, we do find
the Defendant to be in contempt of our Order of July 20, 1995.
We specifically did find that on February 17, 1996, in the late
evening hours, that the Defendant did throw a beer bottle
through the victim's car window, shattering the window and
causing glass to land on the victim, causing some cutting on her
fingers.
And further, the Court having previously found the
Defendant to be in contempt on February 23, 1996, and that being
a contempt for following the victim without any physical
contact, the sentence of the Court is that the Defendant shall
be placed on probation for a period of six months less one day
on the condition that he abide by our Contempt Order of July 20,
1995.
And further, the Court having found the Defendant
to be in contempt today, in that we found the Defendant did
throw a 40-ounce beer bottle through the window of the vehiole
that the victim was driving on February 17, 1996, and the victim
did sustain injuries by way of cuts to her fingers from the
shattered window, we sentence the Defendant to a term of
imprisonment in the Cumberland County Jail of three months for
this contempt. The sentence is effective today and may run
concurrently with any other sentence the Defendant is currently
serving.
