1. We, Samuel and Carol Reeser, are the defendants in the
above-captioned action, which is an appeal from a judgment
rendered by District Justice Susan K. Day on June 9, 1995,
awarding Plaintiff possession of the mobile home lot on which we
reside and alleged back rent.
2. The rent for our mobile home lot, located at 5H Hill Top
Drive, Carlisle, Cumberland County, Pennsylvania, is $295.00 per
month, and becomes due on the 7th day of each month.
3. Our next rent payment will be due on or before the 7th
day of August, 1995.
4. We verify that the statements made in this Affidavit are
true and correct. We understand that false statements herein are
made sUbject to the penalties of 18 Pa. C.S. 4904, relating to
unsworn falsification to authorities.

COMPLAINT
AND NOW, this
day of July, 1995, comes the Plaintiff,
Frank T. Perano, t/d/b/a Country Manor West, by his attorneys,
Cleckner and Fearen, and files the within Complaint and in support
thereof avers the following:
1. The Plaintiff is Frank T. Perano, an adult individual,
t/d/b/a Country Manor West, a mobile home park (hereinafter
"Country Manor") with its principal place of business located at 2
Apple Alley, Carlisle, Cumberland County, Pennsylvania, 17013.
2. The Defendants Samuel C. Reeser and Carol A, Reeser, are
both adult individuals who reside at 5-H Hill Top Drive, Carlisle,
Cumberland County, Pennsylvania.
3, The Defendants have leased a mobile home lot from
Plaintiff in Country Manor, which lot is known and numbered as 5-H
Hill Top Drive, Carlisle, Pennsylvania (hereinafter "Premises")
under an oral, month-to-month lease,
4. The agreed upon rent for the Premises was $280.00 per
month. By notice contained in a Newsletter delivered to Defendants
on or about April 27, 1995, Plaintiff increased the rent to $295.00
per month effective June 1, 1995, A true and correct copy of said
notice is marked Exhibit "A," attached hereto and incorporated
herein by reference.
5. As part of their lease agreement with Plaintiff,
Defendants agreed to comply with Country manor West Rules,
Regulations and Agreements (hereinafter "Tenant Agreements"), A
true and correct copy of said Tenant Agreements is marked Exhibit
"B," attached hereto and incorporated herein by reference.
6. Pursuant to the aforesaid Tenant Agreements, Defendants
agreed to pay $1.00 per day for each day rent remains unpaid, plus
a $10.00 billing charge if full late charges are not paid with a
late rent payment.
7 . Despite their obligations under their lease and the Tenant
Agreements, and despite demand by Plaintiff, Defendants have failed
to pay Plaintiff any rent since March 14, 1995.
8. On or about January 20, 1995, Plaintiff notified
Defendants of their breach of their lease and Tenant Agreements due
to non-payment of rent, in the manner prescribed by the Mobile Home
Park Rights Act, 68 P.S. ~398.1 ~ ~ A true and correct copy of
said notice is marked Exhibit "C," attached hereto and incorporated
herein by reference.
9. On or about February 22, 1995, Defendants paid Plaintiff
the sum of $1,007,00 to pay overdue rent and late charges to
February 28, 1995, plus a filing fee of $77.00.
10. On or about March 14, 1995, Defendants paid Plaintiff the
sum of $296.00 representing rent and late charges for March, 1995.

11. Defendants have failed to make any rental payments or pay
any late fees since March 14, 1995.
These non-payment of rent
violations have occurred within six (6) months of the Notice sent
Defendants on or about January 20, 1995. (~Exhibit "B").
12, Defendants have failed to pay the amounts due and owing
to Plaintiff and have failed to remove their mobile home from the
Premises despite Plaintiff's demands that they do so.

13, The averments of paragraphs 1 through 12 above are
incorporated herein by reference as though fully set forth.
14. Defendant owes Plaintiff the following sums as of July
31, 1995:

WHEREFORE, Plaintiff demands judgment in his favor and against
Defendants, Samuel C. Reeser and Carol A, Reeser, in the amount of
$1,487.50 plus continuing unpaid rent and late charges as they
accrue, interest and the costs of this suit.
COUNT II
ACTION IN EJECTMENT
15. The averments of paragraphs 1 through 14 above are
incorporated herein by reference as though fully set forth.
16. Plaintiff is the record owner of real estate of which the
Premises is a part, having acquired title from Taylor Enterprises,
Inc, by deed dated May 16, 1994, which was recorded in the Office
for Recording of Deeds in Cumberland County on May 17, 1994, in
Record Book 105, page 547. The real estate owned by Plaintiff is
more fully described in the legal description which is marked
Exhibit "0," attached hereto, and incorporated herein by reference.
17. Despite Plaintiff's notice as averred above in paragraph
8, Defendants have failed and refused to vacate and surrender
possession of the Premises to Plaintiff,
WHEREFORE, Plaintiff requests that Your Honorable Court enter
judgment in favor of the Plaintiff and against the Defendants for
possession of the Premises here described, 5-H Hill Top Drive,

Carlisle, Cumberland County, Pennsylvania, and, further, order
Defendants to remove their mobile home from the Premises.

COMES NOW the defendants, Samuel C. Reeser and Carol A.
Reeser, by counsel, Philip C. Briganti 1 Esquire, Legal Services,
Inc., and as their Answer to plaintiff's Complaint, state as
follows:
1. Admitted.
2. Admitted.
3. Admitted in part and denied in part. Defendants admit
that they have leased from plaintiff a mobile home lot known and
numbered as 5-H Hill Top Drive, carlisle, Pennsylvania. However 1
they deny that they lease this premises under an oral, month-to-
month lease, but rather pursuant to the written "country Manor
West Rules, Regulations and Agreements" which is attached to
Plaintiffls Complaint as Exhibit "B" and incorporated by
reference. Defendants further aver that their lease is of
indefinite duration and only terminable upon conditions set forth
under the Mobile Home Park Rights Act.

6. Admitted in part and denied in part. Defendants admit
that the Tenant Agreements provide for the stated late charges.
However, Defendants aver that such provisions are unconscionable
and unenforceable as a penalty, as set forth below in Defendants'
New Matter.

8. Admitted in part and denied in part. Defendants admit
that they received the notice attached to Plaintiffls Complaint
as Exhibit "C". However, to the extent it is averred, Defendants
deny that they are in breach of the lease or Tenant Agreements
for reasons set forth below in their New Matter.
9. Admitted.
10. Denied. However, on March 13, 1995, Defendants paid
Plaintiff the sum of $286.00 for March rent and late charges
demanded by Plaintiff.
11. Denied. Defendants have paid rent for July 1995 and
August 1995 into escrow with the Prothonotary.
12. Admitted in part and denied in part. Defendants admit
that they have failed to remove their mobile home from the
premises. Defendants deny that they have failed to pay the
amounts due and owing to Plaintiff. By way of further answer,
and as set forth below in their New Matter, Defendants aver that
a portion of their payments have been improperly credited toward
late charges rather than rent, and they are uncertain as to what
amounts, if any, are owed to Plaintiff.
13. Defendants repeat and incorporate by reference their
averments contained above in Paragraphs 1 through 12.
14. Denied. Defendants deny that they owe Plaintiff rent
for April, May and June 1995 in the amounts claimed, because

Defendants have made substantial payments to Plaintiff which
Plaintiff has improperly credited toward late charges rather than
rent. They deny that they owe rent for July 1995 ($295.00),
because it has been paid into escrow with the Prothonotary.
Defendants also deny that they owe any of the late charges
indicated (see Defendants' New Matter), and therefore that they
owe any of the alleged totals. Defendants further deny that they
owe Plaintiff the alleged filing fees.
15. Defendants repeat and incorporate by reference their
averments contained above in Paragraphs 1 through 15.

NEW MATTER
18. The late fees of $1.00 per day and late fee billing
charge ($10.00) assessed by Rule 3 (under "Registration and
Rent") of Plaintiff's Rules, Regulations and Agreements (see
Plaintiff's Exhibit "B"), are unconscionable 1 bear no rational
relationship to any losses suffered by Plaintiff because of the
alleged late payment of rent, and are unenforceable as a penalty.
19. Rule 3 (under "Registration and Rent") of Plaintiff/s
Rules, Regulations and Agreements (see Plaintiff's Exhibit "B"),
which assesses late fees of $1.00 per day and a late fee billing
charge of $10.00, violates Section 398.4 of the Mobile Home Park
Rights Act (68 P.S. Section 398.4), in that it is not a fair or
reasonable rule or regulation reasonably related to the health or
safety of residents in the park or to the upkeep of the park.
20. Defendants have paid amounts to plaintiff, at this
point undetermined, which were wrongfully credited toward
improper late fees and late fee billing charges, and which should
be applied toward Defendant's rent.
21. Following the district justice hearing on June 9, 1995,
from which this appeal was taken, Plaintiff served Defendants
with an eviction notice dated June 23, 1995, which gave
Defendants thirty days to pay the alleged overdue rent, and
effectively waived all prior notices and Plaintiff's right to
pursue these eviction proceedings. A copy of this notice is
attached hereto, incorporated by reference and marked as
Defendants' Exhibit "A".
22. Plaintiff's eviction notice dated January 20, 1995 (see
Plaintiff's Exhibit "A"), on which it relies in bringing this
action, did not state that an eviction proceeding may be
commenced if Defendants failed to pay the alleged overdue rent
within 30 days from the date of service, and demanded that
Defendants pay late charges as well as alleged overdue rent to
avoid eviction 1 in violation of Section 398.3(b) (2) of the Mobile
Home Park Rights Act [68 P.S. 398.3(b)(2)).
WHEREFORE, Defendants respectfully request that judgment be
entered in their favor, and that the relief requested by
Plaintiff be denied.
