Kelley, Esquire 132-134 Walnut street Harrisburg, PA 17101 Dear Mr. McDermott and Mr. Kelley: By order of Court of President Judge Harold E. Sheely dated June 26, 1996, the full-time Master has been appointed in the above referenced divorce proceedings. A divorce complaint was filed on July 10, 1995, raising grounds for divorce of irretrievable breakdown of the marriage. No economic claims were raised in the divorce complaint nor have any other pleadings been filed raising economic issues. The motion for appointment of Master indicates, however, that distribution of property and costs and expenses are at issue. However, as noted, no pleadings have been filed raising those claims. The Plaintiff filed an affidavit under section 3301(d) averring that the parties have been separated for a period of at least two years, since April 1988. Mr. Richardson filed a counter-affidavit on February 16, 1996, indicating that he opposed the entry of a divorce decree because the marriage is not irretrievabley broken and stating that he wished to claim economic relief. However, as indicated, no economic claims have been raised. If there is no issue with respect to the date of separation and the parties have been separated for a period of at least two years, then I need to know from counsel if there - , . Mr. McDermott and Mr. Kelley, Attorneys at Law 1 July 1996 Page 2 are issues with respect to economic matters. I will give counsel two weeks from the date of today's letter to respond to my inquiry regarding the grounds for divorce and whether or not economic issues are going to be raised. I do not consider the statement in Defendant's counter-affidavit that he wishes to claim economic relief the formal filing of any claims. Kelley, Esquire 132-134 Walnut street Harrisburg, PA 17101 Dear Mr. McDermott and Mr. Kelley: By order of Court of President Judge Harold E. sheely dated June 26, 1996, the full-time Master has been appointed in the above referenced divorce proceedings. A divorce complaint was filed on July 10, 1995, raising grounds for divorce of irretrievable breakdown of the marriage. No economic claims were raised in the divorce complaint nor have any other pleadings been filed raising economic issues. The motion for appointment of Master indicates, however, that distribution of property and costs and expenses are at issue. However, as noted, no pleadings have been filed raising those claims. The Plaintiff filed an affidavit under Section 3301(d) averring that the parties have been separated for a period of at least two years, since April 1988. Mr. Richardson filed a counter-affidavit on February 16, 1996, indicating that he opposed the entry of a divorce decree because the marriage is not irretrievabley broken and stating that he wished to claim economic relief. However, as indicated, no economic claims have been raised. If there is no issue with respect to the date of separation and the parties have been separated for a period of at least two years, then I need to know from counsel if there Mr. McDermott and Mr. Kelley, Attorneys at Law 1 July 1996 Page 2 are issues with respect to economic matters. I will give counsel two weeks from the date of today's letter to respond to my inquiry regarding the grounds for divorce and whether or not economic issues are going to be raised. I do not consider the statement in Defendant's counter-affidavit that he wishes to claim economic relief the formal filing of any claims.
