1. Plaintiff is Sheritta A. Richardson, who currently
resides at 155 Lincoln Street 1 Carlisle 1 Cumberland County, PA
17013.
2. Defendant is Carl W. Richarc;son, who currently resides
at 2016 North Street, Harrisburg, Dauphin County, PA.
3. Plaintiff and Defendant have been bona fide residents
in the Commonwealth for at least six months immediately previous
to the filing of this Complaint.
4. The plaintiff and defendant were married on November 8,
1980 in Cumberland County 1 Pennsylvania.
5. There have been no prior actions of divorce or for
annulment between the parties.
6. The marriage is irretrievably brOken, and the parties
are proceeding under Section 3301(c) of the Divorce Code.
7. Neither Plaintiff or Defendant are members of the
United States Armed Forces.

who resides at 155 Lincoln Street, Carlisle, Cumberland County 1
Pennsylvania.

custody of the children to the Plaintiff.

Dear Mr. McDermott and Mr. Kelley:
By order of Court of President Judge Harold E. Sheely
dated June 26, 1996, the full-time Master has been appointed in
the above referenced divorce proceedings.
A divorce complaint was filed on July 10, 1995, raising
grounds for divorce of irretrievable breakdown of the marriage.
No economic claims were raised in the divorce complaint nor have
any other pleadings been filed raising economic issues. The
motion for appointment of Master indicates, however, that
distribution of property and costs and expenses are at issue.
However, as noted, no pleadings have been filed raising those
claims.
The Plaintiff filed an affidavit under section 3301(d)
averring that the parties have been separated for a period of at
least two years, since April 1988. Mr. Richardson filed a
counter-affidavit on February 16, 1996, indicating that he
opposed the entry of a divorce decree because the marriage is
not irretrievabley broken and stating that he wished to claim
economic relief. However, as indicated, no economic claims have
been raised.
If there is no issue with respect to the date of
separation and the parties have been separated for a period of
at least two years, then I need to know from counsel if there

are issues with respect to economic matters. I will give
counsel two weeks from the date of today's letter to respond to
my inquiry regarding the grounds for divorce and whether or not
economic issues are going to be raised. I do not consider the
statement in Defendant's counter-affidavit that he wishes to
claim economic relief the formal filing of any claims.
I am sending a copy of this letter directly to Mr.
Richardson, the Defendant, inasmuch as Mr. Kelley has not
entered his appearance on the record, although he has accepted
service of documents on behalf of the Defendant

Dear Mr. McDermott and Mr. Kelley:
By order of Court of President Judge Harold E. sheely
dated June 26, 1996, the full-time Master has been appointed in
the above referenced divorce proceedings.
A divorce complaint was filed on July 10, 1995, raising
grounds for divorce of irretrievable breakdown of the marriage.
No economic claims were raised in the divorce complaint nor have
any other pleadings been filed raising economic issues. The
motion for appointment of Master indicates, however, that
distribution of property and costs and expenses are at issue.
However, as noted, no pleadings have been filed raising those
claims.
The Plaintiff filed an affidavit under Section 3301(d)
averring that the parties have been separated for a period of at
least two years, since April 1988. Mr. Richardson filed a
counter-affidavit on February 16, 1996, indicating that he
opposed the entry of a divorce decree because the marriage is
not irretrievabley broken and stating that he wished to claim
economic relief. However, as indicated, no economic claims have
been raised.
If there is no issue with respect to the date of
separation and the parties have been separated for a period of
at least two years, then I need to know from counsel if there

are issues with respect to economic matters. I will give
counsel two weeks from the date of today's letter to respond to
my inquiry regarding the grounds for divorce and whether or not
economic issues are going to be raised. I do not consider the
statement in Defendant's counter-affidavit that he wishes to
claim economic relief the formal filing of any claims.
I am sending a copy of this letter directly to Mr.
Richardson, the Defendant, inasmuch as Mr. Kelley has not
entered his appearance on the record, although he has accepted
service of documents on behalf of the Defendant
