STIPULATION AGAINST LIENS

THIS AGREEMENT made the 8 'bl-, day of Jllly, 1995, by and between,
CARL H. DUNLAP, trading and doing business as CARL II. DUNLAP BUILDER, of 10707 Shale
Road, Shippensburg, Pennsylvania. hereinafter referred to as Con/rae/or,
AND
DA VID P. PERKINS and VICTORIA N. PERKINS. husband and wife, of 606 Charles Street,
Shippensburg, Pennsylvania. hereinafter referred to as Oll'ner.
WHEREAS, the said Contractor undertook and agrccd to make ccrtain improvements to
Owner's property situate in the Borough of Shippensburg, Cumberland County, Pennsylvania,
known as 4 James Circle, Shippensburg, Pennsylvania, morc fully described in Exhibit "A" attached
hereto and made a part hereof.
NOW THEREFORE. TI-IIS AGREEMENT WITNESSETH: That the said Contractor, for
and in consideration ofthe sum of One Dollar ($1.00) to said Contractor in hand paid by Owner, the
receipt whereofis hercby acknowlcdgcd, and the further consideration mentioned in the agreement
aforesaid, for himself, and his subcontractors, and all parties acting through or under them, covenant
and agree that no mechanic's liens or claims shall bc filed or maintained by them or any of them
against the said buildings and improvements and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of them under said contract or
otherwise, for, towards, in, or about the erection and construction of the said improvements on the
lot above describcd, and the said Contractor, for himsclf, his subcontractors and others under him
hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or
claims against the said buildings or any of them, and agree that this instrument, waiving the right of
lien, shall be an independent covenant.

ALL that certain tract of land situate in the Borough of Shippensburg, Cumberland County,
Pennsylvania, more particularly bounded and described as follows:
BEGINNING at a point on the northern edge of James Circle at common comer of Lot No.5 and
Lot No.4 as shown on Subdivision Plan of Hallwood Heights West dated May 21, 1992, and
recorded in Cumberland County Plan Book 65, at Page I; thence along Lot No.5, North 41 degrees
55 minutes 06 seconds East, 154.96 feet to a point; thence along lands now or formerly of Richard
D. and Betty C. Fritz and Lot No. I of the aforesaid subdivision, South 48 degrees 10 minutes 26
seconds East, 104.40 feet to a point; thence along Lot No.3 of the aforesaid subdivision, South 41
degrees 55 minutes 06 seconds West, 155.13 feet to a point on the northern edge of James Circle;
thence along the northern edge of James Circle, North 48 degrees 04 minutes 54 seconds West,
104.40 feet to a point the place of BEGINNING.
BEING all of Lot No.4 on Subdivision Plan of Hallwood Heights West dated May 21, 1992, and
recorded in Cumberland County Plan Book 65, Page I.
CONTAINING 0.3716 acres more or less.
BEING the same real estate which H. Scott Garling and Michael J. Cassidy, co-partners, t/dlb/a G
& C Associates, by their deed dated August 17, 1993, and recorded in Cumberland County Deed
Book "L", Volume 36, at Page I 065, conveyed to David P. Perkins and Victoria N. Perkins, husband
and wife, the Owners herein.
UNDER AND SUBJECT, nevertheless, to such agreements, conditions, and restrictions as appear
of record, including deed restrictions numbered 1-13 inclusive, and subject to a ten (10) foot wide
easement extending along all lot lines for utilities and drainage easements as more fully set forth in
Deed Book "L", Volume 36, at Page 1065.
