REGIS INSURANCE COMPANY'S MOTION TO MAKE RULE ABSOLUTE
AND NOW, comes plaintiff Regis Insurance Company ("Regis"),
and files the following Motion to Make Rule Absolute in the above
captioned action, and in support thereof states the following:
1. On or about September 15, 1997, Regis filed a Petition
for Consolidation of this Declaratory Judgment Action with
Bauqhman v. Adams and B&P Max. Inc.. t/d/b/a Cold Sorinqs Inn,
No. 95-3715.
2. On September 19, 1997, this Honorable Court issued a
Rule to Show Cause why petitioner, Regis Insurance Company, is
not entitled to the relief requested. The Rule granted
plaintiffs twenty (20) days from the date of service of the Rule
to file an Answer to the Petition.
3. On October 3, 1997, counsel for Regis served a copy of
the Rule to Show Cause on all counsel in both actions. A true

and correct copy of the October 3, 1997 transmittal letter is
attached hereto as Exhibit "A".
4. No parties have opposed Regis' Petition for
Consolidation.
5. No reason has been shown why Regis' Petition should not
be granted.
WHEREFORE, Plaintiff, Regis Insurance Company, respectfully
requests this Honorable Court to issue a Rule Absolute granting
Regis' petition for Consolidation and enter the proposed Order
accompanying Regis' Petition.

AND NOW, comes plaintiff Regis Insurance Company ("Regis"),
and files the following Motion to Make Rule Absolute in the above
captioned action, and in support thereof states the following:
1. On or about September 15, 1997, Regis filed a Petition
for Consolidation of this Declaratory Judgment Action with
Bauahman v. Adams and B&P Max. Inc.. t/d/b/a Cold Sorinas Inn,
No. 95-3715.
2. On September 19, 1997, this Honorable Court issued a
Rule to Show Cause why petitioner, Regis Insurance Company, is
not entitled to the relief requested. The Rule granted
plaintiffs twenty (20) days from the date of service of the Rule
to file an Answer to the Petition.
3 . On October 3, 1997, counsel for Regis served a copy of
the Rule to Show Cause on all counsel in both actions. A true

and correct copy of the October 3, 1997 transmittal letter is
attached hereto as Exhibit "A".
4. No parties have opposed Regis' petition for
Consolidation.
5. No reason has been shown why Regis' petition should not

WHEREFORE, Plaintiff, Regis Insurance Company, respectfully
requests this Honorable Court to issue a Rule Absolute granting
Regis' Petition for consolidation and enter the proposed Order
accompanying Regis' Petition.

previously thrcatcncd thc plaintiff while both wcre inside the tavern. The plaintiff contcnds that
during thc altercation betwecn the plaintiff and thc assailant, defendant Jamcs B. Adams, plaintiff
fcll into a sizable pothole locatcd on thc propcrty undcr thc control of thc dcfcndant, Cold
Springs Inn, and sevcrely injurcd his anklc.
Regis Insurancc Company is thc gencralliability carricr for thc Maxwclls. Mr. Douglas'
intcrcst has to do with dram shop liability.
Thcrc was gcncral agrccmcnt that thc casc captioncd to 95-3715 will bc tricd during this
tcrm. Mr. Hovis indicatcs that hc is not availablc on February 2nd but can scnd a rcpresentative.
Mr. Sanders cannot be prescnt on Fcbruary 6th. Mr. Douglas has a case in York County.
Needless to say. there must bc some considcration to thc schcduling of this mattcr.
Therc are various theorics of recovcry in this case. Thc jury's verdict will impact on the
action dockcted to 97-2149 and may also bc dctcrminativc with respect to an assault and battcry
exclusion in Cold Springs Inn's dram shop liability insurance. Thus. thc framing of jury
interrogatories becomes particularly critical in this casc. Thc court has asked that counsel file
proposed verdict forms togethcr with any supporting Icgal authority prior to jury selection in this
case.
This matter should take less than two days to try. It is unlikely that dcfcndant James
Adams will appear. For the timc bcing, therefore, the court dirccts thc normal numbcr of juror
challenges.

AND NOW, TO WIT, this 12th day of July 1995, comes the
Plaintiff, JAMES M. BAUGHMAN, by his attorney, Harrison L.
Sanders, Esquire, and for his causes of actions states as
follows:
1. Plaintiff I JAMES M. BAUGHMAN, is an adult
individual residing at 9770-B carlisle Road, Dillsburg,
York county, Pennsylvania, 17019.
2 . Defendant I JAMES B. ADAMS I is an adult individual
residing at 315 Hemlock Road, Mechanicsburg I Cumberland
county, Pennsylvania, 17055.
3. Defendant, B & P MAX, INC., to the best of
Plaintiff 's knowledge, information and belief, at all times
relevant hereto, owned, maintained, and operated a place of
retail trade consisting of a tavern or public drinking
establishment known as "The Cold Springs Inn", located at
258 Park Place Lane, Mechanicsburg, cumberland county,
pennsylvania I 17055, and registered with the pennsylvania
Department of state, corporation Bureau, as COLD SPRINGS
INN, with the same corporate address as stated above.
4. At all times relevant hereto, Defendant, B & P
MAX, INC" t/d/b/a COLD SPRINGS INN, was a pennsylvania
corporation subject to the licensing and regulation of the
Pennsylvania Liquor Code at 47 P.S. section 1-101 et.seq.
5. At all times relevant hereto, Defendant, B & P
MAX, INC., t/d/b/a COLD SPRINGS INN, acted through its
authorized agents, servants I and employees, who were acting
within the scope of their employment.
6. The acts and occurrences hereinafter stated took
place on March 25, 1994, between approximately 1:45 a.m.
and approximately 2:30 a.m., at or near the Cold springs
Inn, at its aforesaid location.
7. At the aforesaid time and place I Defendant, JAMES
B. ADAMS, was a patron of the Cold springs Inn, where he
had been served alcoholic beverages by agents, servants,
and employees of Defendant I B & P MAX, INC., COLD SPRINGS
INN, during and after which he had become visibly
intoxicated I loud, boisterous, and combative.
8. At the aforesaid time and place, Plaintiff was

involved in breaking up a fight between Defendant, JAMES B.
ADAMS and another patron. At that time, Defendant, JAMES
B. ADAMS, pushed Plaintiff and loudly stated that he would
be "waiting for" Plaintiff when he left the premises.
9. When Plaintiff walked out of the door of the Cold
Springs Inn, Defendant, JAMES B. ADAMS, attacked him
violently, pushed him against a guardrail, struck him
repeatedly with his fists, and shoved him into a large
pothole along the berm of the roadway directly abutting the
Cold Springs Inn.
10. As a direct and proximate result of the aforesaid
actions of Defendant, JAMES B. ADAMS, Plaintiff suffered
severe injuries which include but are not limited to:
a. a bimalleolar fracture dislocation of the left
ankle.
11. As a direct result of his injuries I Plaintiff
has undergone in the past and will in the future continue
to undergo great pain and sUffering.
12. As a direct result of his injuries, Plaintiff
may have suffered a permanent disability and permanent
impairment of his earning power and capacity.
13. As a direct result of his inj uries, Plaintiff
may have sustained a permanent diminution in his ability to

enjoy life and life's pleasures.
14. As a direct result of his injuries, Plaintiff
has incurred and may hereafter incur medical expenses and
income losses.
15. paragraphs 1 through 14 are incorporated herein
by reference and made a part hereof.
16. The aforesaid actions of Defendant, JAMES B.
ADAMS, were intentional, willful, reckless, and directly
caused Plaintiff to be in grave fear for his life and for
his own personal safety.
17. The aforesaid actions of Defendant, JAMES B.
ADAMS, were committed against the will and consent of
Plaintiff.
18. The aforesaid injuries of Plaintiff were caused
solely by the recklessness and willfulness of Defendant I
JAMES B. ADAMS, and in no way were caused by Plaintiff.
WHEREFORE, Plaintiff, JAMES M. BAUGHMAN I demands
judgment of Defendant, JAMES B. ADAMS, for general damages
in an amount in excess of Twenty Five Thousand Dollars

19. Paragraphs 1 through 18 are incorporated herein
by reference and made a part thereof.
20. At the aforesaid time and place, Defendant, B &
P MAX, INC., t/d/b/a COLD SPRINGS INN, through its
authorized agents, servants, and employees, acting within
the scope of their employment, sold and served alcoholic
beverages to Defendant, JAMES B. ADAMS, when Defendant I
JAMES B. ADAMS, was visibly intoxicated, loud, boisterous,
and combative, contrary to the provisions of the
Pennsylvania Liquor Code at 47 P.S. 4-493.
21. As a direct and proximate result of the aforesaid
actions of Defendant, B & P MAX, INC" t/d/b/a COLD SPRINGS
INN, Plaintiff suffered the aforesaid injuries.
WHEREFORE, Plaintiff, JAMES M. BAUGHMAN, demands
judgment of Defendant, B & P MAX, INC., t/d/b/a COLD
SPRINGS INN, jointly and severally with the Defendant I
JAMES B. ADAMS, for general damages in an amount in excess
of Twenty Five Thousand Dollars ($25,000.00), for costs of

22. Paragraphs 1 through 21 are incorporated herein

23. At the aforesaid time and place, Defendant I
B & P MAX, INC. I t/d/b/a COLD SPRINGS INN, through its
authorized agents, servants I and employees, acting within
the scope of their employment I had reason to believe that
Defendant, JAMES B. ADAMS, was a person of known violent
propensities, and despite that knowledge, took no measures
whatsoever to evict Defendant, JAMES B. ADAMS I from the
subject premises, or to take whatever security measures
that were necessary to prevent the aforesaid actions of
Defendant, JAMES B. ADAMS, which directly and proximately
caused the aforesaid injuries to Plaintiff.
WHEREFORE, Plaintiff I JAMES M. BAUGHMAN I demands
judgment of Defendant, B & P MAX, INC., t/d/b/a COLD
SPRINGS INN, jointly and severally with the Defendant,
JAMES B. ADAMS, for general damages in an amount in excess

AND NOW. TO WIT. this 5th day of February 1996, comes the Plaintiff, JAMES M.
BAUGHMAN, by his attorney. Harrison L. Sanders, Esquire. and for his causes of actions states
as follows:
1. Plaintiff, JAMES M. BAUGHMAN, is an adult individual residing at 9770-B
Carlisle Road. Dillsburg. York County, Pennsylvania, 17019.
2. Defendant, JAMES B. ADAMS. is an adult individual residing at 315 Hemlock
Road, Mechanicsburg, Cumberland County. Pennsylvania, 17055.
3. Defendant, B & P MAX, INC.. to the best of Plaintiff's knowledge, information
and belief. at all times relevant hereto, owned, maintained. and operated a place of retail trade
consisting of a tavern or public drinking establishment known as "The Cold Springs Inn", located
at 258 Park Place Lane, Mechanicsburg, Cumberland County. Pennsylvania. 17055. and registered
with the Pennsylvania Department of State. Corporation Bureau, as COLD SPRINGS INN, with
the same corporate address as stated above.
4. At all times relevant hereto. Defendant. B & P MAX, INC.. t/d/b/a COLD
SPRINGS INN, was a Pennsylvania corporation subject to the licensing and regulation of the
Pennsylvania Liquor Code at 47 P.S. Section 1-101 et.seq.
5. At all times relevant hereto, Defendant, B & P MAX, INC., t/d/b/a COLD
SPRINGS INN, acted through its authorized agents, servants, and employees, who were acting
within the scope of their employment.
6. The acts and occurrences hereinafter stated took place on March 25, 1994. between
approximately 1:45 a.m. and approximately 2:30 a.m., at or near the Cold Springs Inn, at its
aforesaid location.
7. At the aforesaid time and place, Defendant, JAMES B. ADAMS, was a patron of
the Cold Springs Inn, where he had been served alcoholic beverages by agents, servants, and
employees of Defendant, B & P MAX, INC., t/d/b/a COLD SPRINGS INN. during and after
which he had become visibly intoxicated, loud, boisterous, and combative.
8. At the aforesaid time and place, Plaintiff was involved in breaking up a fight
between Defendant, JAMES B. ADAMS and another patron. At that time. Defendant, JAMES
B. ADAMS, pushed Plaintiff and loudly stated that he would be "waiting for" Plaintiff when he
left the premises.
9. When Plaintiff walked out of the door of the Cold Springs Inn. Defendant. JAMES
B. ADAMS, allacked him violently. pushed him against a guardrail, struck him repeatedly with

his fists, and shoved him into a large pothole along the berm of the roadway dircctly abulling the
Cold Springs Inn.
10. As a direct and proximate result of the aforesaid actions of Defendant. JAMES B.
ADAMS. Plaintiff suffered severe injuries which include but are not limited 10:
a. a bimalleolar fracture dislocation of the left ankle.
11. As a direct result of his injuries, Plaintiff has undergone in the past and will in
the future continue to undergo great pain and suffering.
12. As a direct result of his injuries, Plaintiff may have suffered a permanent disability
and permanent impairment of his earning power and capacity.
13. As a direct fesult of his injuries, Plaintiff may have sustained a permanent
diminution in his ability to enjoy life and life's pleasures.
14. As a difect fesult of his injuries, Plaintiff has incuffed and may hefeaftef incuf
medical expenses and income losses.
COUNT I
JAMES M. BAUGHMAN v. JAMES B. ADAMS
ASSAULT AND BATTERY
15. Pafagraphs 1 thfoUgh 14 afe incorpofated hefein by fefefence and made a pari
hefeof.
16. The aforesaid actions of Defendant, JAMES B. ADAMS, wefe intentional. willful.
feckless, and difectly caused Plaintiff to be in grave feaf for his life and for his own pefsonal
safety.

17. The afofesaid actions of Defendant, JAMES B. ADAMS, wefe commilled against
the will and consent of Plaintiff.
18. The aforesaid injuries of Plaintiff wcre caused solely by the recklessness and
willfulness of Defendant, JAMES B. ADAMS, and in no way were caused by Plaintiff.
WHEREFORE, Plaintiff. JAMES M. BAUGHMAN, demands judgmcnt of Defendant,
JAMES B. ADAMS. for general damages in an amount in excess of Twenty Five Thousand
Dollafs ($25.000.00), fOf punitive damages in an amount in excess of Twenty Five Thousand
Dollars ($25,000.00), for costs of suit, and fOf whatever fUfthef felief the Court may deem
appfopfiate.

20. At the aforesaid lime and place. Defendant, B & P MAX, INC.. I/d/b/a COLD
SPRINGS INN. through its authofized agents. scrvants, and cmployees, acting within the scope
of their employment, sold and served alcoholic beveragcs 10 Defendant. JAMES B. ADAMS,
when Defendant, JAMES B. ADAMS, was visibly intoxicatcd, loud, boisterous. and combative,
contrary to the pfovisions of the Pcnnsylvania Liquor Codc at 47 P.S. 4.493.
21. As a difect and pfoximate rcsult of Ihc aforcsaid actions of Dcfendant. B & P

23. At the afofesaid time and place. Defendant,
B & P MAX, INC.. t/d/b/a COLD SPRINGS INN, through its authofized agents. sefvants, and
employees, acting within the scope of their employment, had feason to believe that Defendant,
JAMES B. ADAMS. was a person of known violent propensities, and despite that knowledge,
took no meaSUfes whatsoevef to evict Defendant, JAMES B. ADAMS, from the subjcct pfemises,
or to take whatever security measures that were necessary to prevent the aforesaid actions of
Defendant, JAMES B. ADAMS. which directly and proximately caused the aforesaid injuries to
Plaintiff.
WHEREFORE, Plaintiff, JAMES M. BAUGHMAN. demands judgment of Defendant.

25. At the afofesaid time and place Plaintiff was on thc pfemises of Defendant B &
P MAX. INC., tld/b/a COLD SPRINGS INN, for a purpose directly connected with the business
dealings of Defendant, B & P MAX. INC., t/d/b/a COLD SPRINGS INN and Plaintiff was,
thefefofe, a business invitee of Defendant, B & P MAX, INC., t/d/b/a COLD SPRINGS INN. as
that term is defined in ~ 332 of the Restatemcnt of TOfts, Second.
26. At the afofesaid time and place. on the aforesaid pfemises of Defendant, B & P
MAX, INC.. t/d/b/a COLD SPRINGS INN, or on land owned Of undef the control of Defendant,
B & P MAX, INC.. tld/b/a COLD SPRINGS INN, at the southeast corner of the building of the
afofesaid pfemises and on the befm abulling 258 Pafk Place Lane, thefe existcd a pothole which
was appfoximately two (2) fcet in circumference and approximately eight (8) to ten (to) inchcs
deep.
27. At the afOfesaid time and placc, Defendant B & P MAX. INC., t/d/b/a COLD
SPRINGS INN, knew, Of by the exercise of feasonable cafe should have known. of the aforesaid

pothole and should have realized that the afofesaid pothole involved an unfeasonable fisk of harm
to business invitees such as Plaintiff. and should have expected that such pefsons would not
discovef Of fealize the afofesaid dangerous condition and would fail to protect themselves against
it.
29. At the afofesaid time and place, Defendant, B & P MAX, INC.. t/d/b/a COLD
SPRINGS INN, failed to exefcise feasonable cafe to pfotect business invitees such as Plaintiff
ffom the afofesaid dangerous condition, namely, the afofesaid pothole.
30. As a difect and proximate fesult of Ihe failure of Defendant, B & P MAX, INC.,
tld/b/a COLD SPRINGS INN, to exercise feasonable cafe to protect business invitees such as
Plaintiff ffom the afofesaid dangefous condition, Plaintiff suffered the afofesaid injuries.
WHEREFORE. Plaintiff. JAMES M. BAUGHMAN. demands judgment of Defendant,
B & P MAX, INC.. t/d/b/a COLD SPRINGS INN, jointly and sevefally with the Defendant.
JAMES B. ADAMS, fOf general damages in an amount in excess of Twenty Five Thousand
Dollars ($25.000.00), fOf costs of suit, and for whatever fUfthef relief that the Court may deem

Baughman and in suppOrl of his Motion To Strike Case Ffom Tfial List. states the following:
1. James M. Baughman, is the Plaintiff in the above-captioned action which is a
claim fOf pefsonal injufies afising out of an incident that occurred on Mafch 25, 1994.
2. On June 1996. Plaintiff filed a Pfaecipe FOf Listing Case FOf Trial and the case
was placed on the Tfial List fOf tfials commencing on September 16, 1996.
3. At the time Plaintiff placed the case on the Tfial List, Plaintiff anticipated that
all discovery would be completed pfiof to the call of the Civil Tfial List, pUfsuant to
Cumberland County Local Rule 213,2.
4. Since that time, howevef, Plaintiff has detefmined that fUfthef discovery.
specifically. Plaintiff's doctOf'S videotaped deposition. cannot be scheduled befofe the date
that tfials commence undef the pfesentterm of COUft, namely, Septembef 16. 1996.

PETITION OF REGIS INSURANCE COMPANY
FOR CONSOLIDATION OF ACTIONS
Petitioner, Regis Insurance Company ("Regis"), by and
through its attorneys, White and Williams, respectfully requests
that this Honorable Court consolidate the above-captioned actions
for purposes of discovery and trial, and in support thereof
states the following:
1. On or about May 31, 1995, James M. Baughman
("Baughman") filed a Complaint against James Adams ("Adams") and
B&P Max, Inc. t/d/b/a Cold Springs Inn. ("Underlying Action") .
2. On February 5, 1996, Baughman filed an Amended
Complaint, adding another Count to the Complaint. A copy of said
Amended Complaint is attached hereto and marked Exhibit "A".
3. In the underlying action, Baughman seeks damages for
bodily injury as a result of an incident which allegedly occurred
on March 25, 1994 at the Cold Springs Inn.
4. On April 24, 1997, Regis Insurance Company brought a
declaratory judgment action seeking a judgment that it has no
duty to defend or indemnify Bradley D. Maxwell, patricia A.
Maxwell or B&P Max, Inc. t/a Cold Springs Inn under a policy of
general liability insurance, No. RL 103953, effective February
15, 1994 to February 15, 1995, in the personal injury action
brought by James Baughman. A copy of said declaratory judgment
complaint is attached hereto and marked Exhibit "B".
5. In the underlying action, Baughman alleges that, on
March 25, 1994, he was a patron of the Cold Springs Inn. He
alleges that he sustained bodily injuries as the result of an
incident that occurred at the Inn in the early morning hours of
March 25, 1994. ~ Exhibit "A" at paragraphs 9 and 10.
6. In the declaratory judgment action, Regis seeks a
judgment that it has no duty to defend or indemnify Bradley D.
Maxwell, Patricia A. Maxwell or B&P Max, Inc. t/a Cold Springs
Inn, pursuant to an Assault and Battery Exclusion contained in
Policy No. RL 103953, because the personal injury complaint
alleges claims falling within that exclusion.

7. Pursuant to Pennsylvania Rule of Civil Procedure
215(a), consolidation of actions is appropriate when the actions
involve the same factual questions and arise from the same
occurrence.
8. The above-cited actions involve common questions of
fact regarding the nature of the incident giving rise to the
personal injury action.
9. The above-cited actions arise from the same incident
that allegedly took place at the Cold Springs Inn in the early
morning hours of March 25, 1994.
10. Consolidation of these two actions will not prejudice
any right of any party to the actions and is desirable because:
(a) It will prevent needless expense to the parties in
pleadings, motions and discovery;
(b) It will prevent duplication of effort by the
Honorable Court; and
(c) It will prevent the potential for inconsistent

verdicts.
11. In the interest of justice, these two actions should be
consolidated and joined for purposes of discovery and trial.
WHEREFORE, Petitioner, Regis Insurance Company, respectfully
requests that this Honorable Court grant its Petition for
Consolidation of Reais Insurance ComDanv v. Maxwell. et al., No.
97-2149 and Bauahman v. Adams. et al., No. 95-3715, and enter the

MEMORANDUM OF LAW IN SUPPORT OF
PETITION OF REGIS INSURANCE COMPANY FOR CONSOLIDATION OF ACTIONS
I. FACTS
This petition to consolidate involves two lawsuits filed in
connection with an alleged tortious assault that occurred in
March, 1994. Both actions were filed in the Court of Common
Pleas of Cumberland County. The first action was brought by
James Baughman against James Adams and B&P Max, Inc. t/d/b/a Cold
Springs Inn. In that action, Mr. Baughman seeks damages for
bodily injury as a result of an alleged incident involving Mr.
Adams at the Cold Springs Inn in the early morning hours of March
25, 1994. ~ Exhibit "A".
The second action is a declaratory judgment action brought
by Regis Insurance Company. Regis issued a policy of general
liability insurance, No. RL 103953, to Bradley D. Maxwell,
Patricia A. Maxwell and B&P Max, Inc. t/a Cold Springs Inn,
effective February 15, 1994 to February 15, 1995. Regis was
notified of Mr. Baughman's claim against Cold Springs Inn and has
defended its insured under a reservation of rights. On April 24,
1997, Regis filed a declaratory judgment complaint, seeking a
judgment that it has no duty to defend or indemnify the named
insureds under Policy No. RL 103953 in the personal injury action
brought by James Baughman. ~ Exhibit "B".
In the personal injury complaint, James Baughman alleges
that, on March 25, 1994, he was a patron of the Cold Springs Inn.
Mr. Baughman claims that he sustained bodily injuries, including
"a bimalleolar fracture dislocation of the left ankle" as the
result of an alleged assault by Mr. Adams upon him. ~ Exhibit
"A" at Paragraph 10(a). Mr. Baughman alleges that Adams
"attacked him violently, pushed him against a guardrail, struck
him repeatedly with his fists, and shoved him into a large
pothole along the berm of the roadway directly abutting the Cold
Springs Inn." ~ Exhibit "A" at Paragraph 9.
The basis for Regis' declaratory judgment action is an
Assault and Battery Exclusion endorsement contained in the policy
issued to Cold Springs Inn. ~ Exhibit "B" at Paragraph 8. In

the declaratory judgment action, Regis seeks a determination that
it has no duty to defend or indemnify Cold Springs Inn, because
the personal injury suit alleges injuries arising from an assault
and battery, which claims are clearly excluded under the policy.
The instant petition asks the court to consolidate the
personal injury action with the declaratory jUdgment action.
II. ARGUMENT
Consolidation of the instant two actions is appropriate
because it satisfies the requirements of the Pennsylvania Rules
of Civil Procedure and because it furthers the goals of that
rule. The decision whether to consolidate rests soundly within
the discretion of this trial court. Roznowski v. Pennsvlvania
National Mutual Cas. Ins. Co., 343 Pa. Super. 7, 493 A.2d 775
(1985); 20 Appleman, Insurance Law and Practice ~ 11371, p. 408.
The court may order consolidation at any time, regardless of
whether the pleadings are closed, discovery is completed, or both
cases are at issue. Financial Enterorises. Inc. v. Radnor
Indus.. Ltd., 13 D. & C.3d 600 (1980).
A. CONSOLIDATION IS APPROPRIATE UNDER PA. R. CIV. P.
213(a)
Rule 213 (a) of the Pennsylvania Rules of Civil Procedure
provides for consolidation of actions when the actions involve
the same factual questions and arise from the same occurrence:
In actions pending in a county which involve
a common question of law or fact or which
arise from the same transaction or
occurrence, the court on its own motion or on
the motion of any party may order a joint
hearing or trial of any matter in issue in
the actions, may order the actions

consolidated and may make orders that avoid
unnecessary cost or delay.
This declaratory judgment action brought by the insurer of
one of the parties to another action is suited to consolidation
with th~ underlying action, pursuant to Rule 213(a). The
declaratory judgment action and the underlying action involve the
same factual issues surrounding the incident that is the subject
of the litigation. The personal injury action will involve
questions of fact regarding liability for Mr. Baughman's alleged
injuries, and the declaratory judgment action will involve
questions of coverage as they relate to the liability for Mr.
Baughman's injuries.
A determination of whether the insurer owes the insured a
defense or indemnification rests on the allegations of the
underlying complaint. Aetna Cas, and Sur. Co. v. Roe, 437 Pa.
Super. 414, 650 A.2d 94 (1994). If the complaint against the
insured makes allegations unambiguously outside coverage of the
policy, the insurer has no duty to defend or indemnify. Britamco
Underwriters. Inc. v. Stokes, 881 F. Supp. 196 (E.D. Pa. 1995).
The instant declaratory judgment action will involve factual
issues regarding Mr. Baughman's allegations of assault and
battery, to determine whether the policy exclusion encompasses
the allegations. The personal injury suit will naturally involve
the same questions of fact surrounding the incident that gave
rise to these two actions.
Thus, substantially the same evidence would be introduced in
both cases: evidence about the incident for which Mr. Baughman

seeks to hold Cold Springs Inn liable and for which Cold Springs
Inn seeks indemnification from Regis. Furthermore, the two
actions clearly arise from the same occurrence, as Regis would
have had no cause to bring the declaratory judgment action absent
the incident giving rise to the personal injury action.
Because the declaratory judgment action and the personal
injury action involve common questions of fact and arise from the
same occurrence, they are amenable to consolidation under Rule
213 (a) .
B. CONSOLIDATION WILL FURTHER THE POLICIES BEHIND PA. R.
CIV. P. 213(a)
Pennsylvania courts have approved the practice of
consolidation of actions under Rule 213(a). Azinaer v.
Pennsvlvania Railroad Co., 262 Pa. 242, 105 A. 87 (1918);
Acauaviva v. Hartman, 203 Pa. Super. 505, 201 A.2d 239 (1964);
Sisk v. Duffv, 201 Pa. Super. 213, 192 A.2d 251 (1963). In
support of the rule, the cases cite certain policy
considerations. Consolidation of the instant personal injury
suit and declaratory judgment action will further the policies
behind Rule 213(a).
The Pennsylvania Superior Court has noted that consolidation
avoids unnecessary delay, expense and duplication of effort,
resulting in benefits to the court and all parties to the
actions. Acauaviva v. Hartman, suora. Consolidation also
prevents the possible rendering of inconsistent verdicts. ~
v. Duffv, suora.

In Clark v. Khan, 52 Erie 96 (1969), the court granted a
petition to consolidate where there were common defendants,
stating: "[tlhis, in our opinion, weighs heavily in favor of
consolidation . ConsolidaLion of these cases will not only
save time and expense for the parties involved, and cost to the
county, but will prevent the rendition of inconsistent verdicts."
~ at 99; ~ slaQ Hare v. American General Life Ins. Co., 43 D.
& C.2d 126 (Pa. Com. Pl. 1967) (permitting consolidation of suit
by beneficiary for life insurance benefits and suit by insurer to
rescind insurance policy for misrepresentation) .
In the instant action, the commonality of parties is in
favor of consolidation. Cold Springs Inn is a defendant in both
actions, and James Baughman is a defendant in the declaratory
judgment action and a plaintiff in the personal injury action.
Consolidation will thus prevent needless expense to the parties
in repetitive pleadings, motions and discovery. To twice
litigate the issues surrounding the incident and Mr. Baughman's
injuries would waste the resources of all parties. All parties
are likely to benefit from the consolidation through the
reduction of expense attendant to a consolidation of actions.
Moreover, the Court will benefit from consolidation, which
is the main focus of Rule 213. "It is the savings in total time,
total expenses and total effort . that are the desired
objectives of the rule." Financial Enterorises, suora, at 604.
Consolidation will prevent duplication of effort by this

Honorable Court. Time taken in discovery, pretrial motions and
conferences will be substantially reduced.
Additionally, consolidation will prevent the potential for
inconsistent verdicts, which is another purpose of the rule
allowing consolidation. sisk v. Duffv, SUDra. If the cases were
tried separately, one of the actions might result in a finding
that an assault and battery caused Mr. Baughman's injuries, and
the other might find the injuries were due to another cause.
Such an undesirable inconsistency is avoided by consolidation of
the two actions.
In Financial EnterDrises. Inc. v. Radnor Indus.. Ltd., 13 D.
& c.3d 600 (1980), the court stated that "[a]voiding unnecessary
delay, expenses and duplications of effort is the laudable
objective of the rule, beneficial to the court and to the
litigants." ~ at 603. In that case, the court allowed the
consolidation in the absence of a clear showing that prejudice
would result from the consolidation. Id. Consolidation of the
two actions at bar will not prejudice any right of any party to
the actions.
The fact that a determination of coverage is requested in
the declaratory judgment action, whereas a determination of tort
liability is requested in the personal injury action, is not a
bar to consolidation. In Azinqer v. pennsvlvania Railroad co.,
262 Pa. 242, 105 A. 87 (1918), the Pennsylvania Supreme Court
held that:
where separate actions in favor of or against
two (2) or more persons have arisen out of a

single transaction, and the evidence by which
they are supported is largely the same,
althouqh the riqhts and liabilities of the
oarties mav differ, it is within the
discretion of the trial judge to order all to
be tried together, though in every other
respect the actions remain distinct and
require separate verdicts and judgments.
~ at 87 (emphasis supplied).
Consolidation of the instant declaratory judgment action and the
underlying personal injury suit is thus proper because the two
actions possess common questions of fact, regardless of the
difference between the judgments the facts support. Therefore,
the instant two actions should be consolidated for purposes of
discovery and trial, although the court will ultimately render
two verdicts: one on coverage and one on tort liability.
The consolidation of these declaratory judgment and personal
injury actions furthers the purposes of the rule permitting
consolidation, because it will conserve the resources of all
parties and the court, and because it will avoid delay and
potential inconsistency of verdicts.
III. CONCLUSION
Consolidation of the instant declaratory judgment action and
personal injury suit is proper and warranted under Pennsylvania
Rule of Civil Procedure 213(a) and the policies behind the Rule
articulated by Pennsylvania courts. In the interest of justice,
because the two actions share questions of fact, involve the same
parties, and arise from the same occurrence, they should be tried
together. Consolidation will conserve valuable court time and
resources, as well as benefitting all parties concerned. For

requests this Honorable Court to consolidate the declaratory
judgment action, Reais v. Maxwell. et al., with the underlying
personal injury suit, Bauahman v. Adams. et al.
