motor vehicle accidentll. The firat wall November 19, 1993 for a follow.
up vimit after being aeen at Harrillburg HOllpita1. Reviev hill chart, the
patient atated that he had mild but perllilltent left upper back
dillcomfort after hill accident. On examination at that time he
complained of dillcomfort in the left paravertebral area and at the level
of the scapula, He stated at that time that there vas discomfort vith
rotation of t.he r,eck. III". l1archi'lI exsminatioll at that t.lme vall
easent.ially normal. Pin prick, muscle IItrength and deep tendon reflexes
vere normal, also. The rest of the examination af lungs, heart and
abdomen vaEl negative. Impression for that original vlsit of November
1993 vas that of ~eft upper back strDin and dillcomfort status post I1V^.
l1anagement prescribing Lodine 400 mg 1 b,i.d., Skelaxin 400 mg and
precautions vith additive effects vit.h Transderm-Scop, whlch patle"t
vould be taking for upcoming Caribbean cruise.
The next notat.ion on the chart is an on-cell stlcker vit.h illeglble
signat.ure regarding call from I1rs. l1archi reporting a mot.or vehlcle
eccident on January 22, 1994, The patient vas seen by Or. David Long on
January 22, 1994 for this. Furt.her entries by Dr. Vernon Preston are
recorded on F'ebruary 3rd, l1arch 28th, ^pril 11t.h, ^prll 18th and July
11t.h, 811 in 1994.

He wa5 dlagn05ed with left C-6 radlculopathy. The patient has been treated at 5evel'al phY51cal
therapy 51le5, The patient wa5 at Harrl5burg H05pltalln 1994 and at Capital Recovery for three
rnonth5. The patient did complete a traditional phY51callherapy program and al50 he had multiple

left arm WIlS bruisl!d and he did hove II seatbelt on and his seat was throWll

scopula ond intermittent, pain in hill left ann with numbneas in the thumb,
index',and long finUer, lie hOIl increased pain with coughing and he hns
difficulty with sleepinu IInl\ nl1eus to Bel up and change pOll it ions and walk.
lie has hnd trigger point injectionll with only l11inil1l111 relief. lie hns hod
phyaical therllpy with l11inil11111 re!ld.
Examination reveals full extenalon uf hla neck ond rotation with pllin when
he rotates to the left and right, lie is tender in the left trapezius and
he ill tender alonB the l1Iedin 1 \xJrllc,: of hill scopula. lIill ROM in his left
Bhoulder is limited to about 100 den roes due to pain, He hss no deformities
of his upper extremities, however on examination he has weakneBs of his
biceps and triceps. lie hos decreosed sensation over the index, long and
ring finBer, lie has re(lexel> however they are hard to eXBm but appeal: to
be +1 tlu:oughout. X-rays were revealed ond revenl minimol degenerative joint
disease and his MIll wus reviewed.
Because of hia prolonged BymptolllB, 1 huve ordered another MIll and E1J:l/NCS

status post tho injury he h,ld BOllin sl ight achr!s but not severe.

SUldle First Care and was evaluiltnd and truiltud with medications
for a necll st.l'ain, The pains HI his uppor back and n,'ell incl'cased
such that he had upper bilcll paIn, headolC:hns, and pain with a
tingling sensation radiating down his left radial Bidf! of his arm
into the thumb, index, and middlo finger. Original x-rays showed
,1 possibi I ity of a haid ino fracUll'e at C-3, 4 but after further
f1valuat.iflll no fracture was found, 'I'he pal1ent then underwent
physical therapy at lIarnsbul'\l Hospital f,)r fivf! to SIX weoks,
stopped physical therapy thrf!l! to four weeka, re-started physical
therapy without significant 11<.'lp. lie took off five d,lYS of wOl'k
to seD if taking his medication", Nortab and l:l'lXOI'll, l'egularly,
since they cilused significant fatigue, which lwlped with only
slight benefit. He self refer rod himself to The Capital Recovery
Center for which he received four wnoks of therapy wit.h some slight
help, took off some time due to work and other reasons, and is now
coming for physical therapy again and trigger points.
The patient complains of upper back pain whlch radlates up to the
mid neck area and loft posterior lateral shoulder discomfort with
occallional radiation of discomfort and tingl ing s<:nsation as
previously dascribed, The diacolnforts are increased by activity
or increased use of his extremities and help(!d by physical therapy,
8tretchin or after sleeping, Both Plexoril and Nortabs cause the
patient significant fatigue such that he can only take them when
he is not going to be working. overall the character and nature
of the pain has not changed Significantly since it deveioped in
2/94.
Personal I married, two children alive and well, no smoking,
occasional alcohol use, works for Keystone, has not had more than
five days off since the onset of this diBcomfort except for
possibly at the initial evaluation.

Trigger point injections were explained to the patient, both the
advantages and disadvantages and side effects, consent form was
read, all questions were answered, and he signed it voluntarily.
The bilateral uppel' tl'apezius muscle area6 and bilateral mid to
upper trape:z ius muscle areas as previous Iy stated had tender
trig\Jer point like areas, cleaned with Betadine x3, wiped with
alcohol, injected with 2 cc of Duranest 1% with reproduction of the
local pain without significant radiation of weakness, numbness,
tingling. The areas were cleaned with alcohol and bandalled. The
patient tolerated the trigger point injections well.

Recentlf' counsel for Defendants B. Green & company and Allen
Dale Hall f led a Motion to compel discovery responses in the
above-captioned action. On October 23, 1995 you issued an Order
giving Plaintiffs 30 days to provide answers to Defendants'
discov~ry. Please be advised counsel inaccurately reported that
Plaintiffs had not responded to his Request for Production.
Plaintiffs filed a response to Defendants' Request for Production
on September 27, 1995. Additionally, in compliance with your
order, PlaintiHs provided Mr. Whel1han with Answ8l:s to Defendants'
Interrogatories on october 27, 1995.
In the Motion to compel, Mr. Whelihan also failed to report
that he had not yet answered W sets of PlaintiHs'
Interrogatories. Interrogatories addressed to Defendant Hall were
served on septelllber 7, 1995 and Interrogatories addressed to B.
Green & compa~y were served on September 27, 1995.

and wife, adult individuals, who roside at 109 south 2nd street
Dillsburg, York county, Pennsylvania.
2. Defendant Carol A. nabinowiti/: is an adult individual, who
resides at 1007 Annapolis Road, P.O. Box 127, Gambrills, Maryland
21054.
3. Defendant Allen Dale Hall is an adult individual, who
resides at 7968 Kavanagh Road, Baltimore, Maryland 21222.
4. Defendant B. Green & company, Inc. is a Maryland
corporation licensed to do business in the Commonwealth of
Pennsylvania.
Defendant B. Groen & company, Ino. maintains a
business address of 10075 Red Run Road, suite 575, owings MillS,
Maryland 21117.
5. The facts and occurrenoes hereinafter related took place
on or about January 22, 1994, at approximately 1140 p.m., on SR 83
northbound, Lower Allen Township, Cumberland County, Pennsylvania.

6. At that time and place, Plaintiff H~rio E. Harohi wa.
operatin9 a 1992 Chevrolet Tracker and was travelling north in tho
right lane of BR 83, Lower Allen 'l'ownship, Cumberland county,
Pennsy I van ill .
7. At that time and plllce, Defendant Carol A. Rabinowitz was
operating a 1987 Niesan PUlsar and was travellil1g north in the
right lane of IlR 83, Lower Allen 'rownship, Cumberland county,
Pennsylvania.
8. At that time and place, Defendant Carol A. nabinowitz was
operating her vehicle in traffic bohind the vehicle being operated
by Plaintiff Mario E. Marchi.
9. At that time and place, Defendant Allen Dale Hall was
operating a 1986 Hack truck owned by Defendant B. Green & Company,
Inc., and was travelling north in the left lane of SR 83, Lower
Allen Township, Cumber.land County, Pennsylvania.
10. At that time and place, Defendant Allen Dale Hall
operated the 1986 Hack truck in the course and scope of his
employment with Defendant B. Green & Company, Inc.
11. At that time and place, Defendant Carol A. Rabinowitz
operated her vehicle at a high rate of speed and suddenly pulled
into the left lane of northbound SR 83, directly in the path of
Defendant Allen Dale Hall.

12. T\t that time and plaoe, a violent collision oocurred
between Detendant nabinowitz's vehiole and the 1986 Maok truok
being operated by Defendant Allen Dale Hall, in the course and
scope of his employment with Defendant B. Green & company, Ino.
13. Because of the violent impact, the vehiclos being driven
by Defendant carol A. Rabinowitz and Defendant Allen Dale Hall spun
and traveled out of control.
14. At that time and place, the front portion of Defendant
Hall's vehicle strUck the left side of Plaintiff Mario E. Marchi's
vehiole.

16. The aforementioned accident and all of the injuries and
damages set forth hereinafter sustained by Plaintiffs Mario E.
Marchi and Gayle Marchi are the direct and proximate result of the
negligent, careless, wanton, and reckless manner in which Defendant
Carol A. Rabinowitz operated her motor vehicle as follows!
(a) failure to have her motor vehicle under such
control as to be able to stop within the assured
cle~r distance ahead;
(b) failure to apply her brakes in sufficient time to
avoid the accident;

did not have any training, experience and jUdgment
to adequately control and operate it,
(d) hiring, instructing and retaining its operator and
maintaining ita truck in a manner which endangera
persona and property without due regard for the

violation of the Pennsylvania Motor Vehiole Code,
(e) permitting Defendant Hall to operate the tractor-
trailer although it knew or should have known that
he was careless or reckless in the operation of
trucks or other motor vehiclea, and
(f) failing to properly teat, train and supervise the
operation of ita vehicle in accordance with the
duty a oommeroial vehicle owes to the safety of
other motorista on the highway.

medical treatment, medications, hospitalizations and similar
miscellaneous expenses in an effort to restore himself to health,

6. On September 14, 1996, Plaintiffs replied to Defendant
Carol A, Rabinowitz's New Matter,
7, On Septenwer 27, 1995, Plaintiffs responded to Defendant
Carol A. Rabinowitz's Request far Production of Documents, and on
October 27, 1995, Plaintiffs filed Answers to Defendant Carol A.
Rabinowitz'a Interro~atories.
B, By letter dated November 6, 1995, Plaintiffs' counsel
wrote to couns~l for Defendant Carol A. Rabinowitz and requested
responses to the Interrogatories and Request for Production of
Documents,
9. On January 3, 1996, Plaintiffs' filed a Motion to Compel
Discovery for the outstanding Interrogatories and Request for
Production of Documents of Defendant Rabinowitz.
10. On January 4, 1996, a Court Order mandated that Defendant
Carol A, Rabinowitz provide the Answers and requested documents
within 20 days. A copy of the Order is attached hereto as Exhibit
A.
11. On January lB, 1996, Plaintiffs received Defendant's
Response to Plaintiffs' Request for Production of Documents.
12. To date, Plaintiffs have not received Defendant
Rabinowitz's Answers to Interrogatories,
13. Nearly a year has passed since the Court Order, and
Defendant Rabinowitz has not yet answered Plaintiffs'
Interrogatories.
