ANP NOW, coma a Farmers Trust company, through its attorney,
William A. Duncan, Esquir-l, and files this Complaint in
Mortgage poreclosure, of which the following is a statement I
1. plaintiff is Farmers Trust company, B corporation
organi~ed and existing under the laws of the commonwealth of
pennsylvania with its main office and principal place of
business located at 1 West High streett carlisle, cumberland
county, Pennsylvania 17013.
2. Defendants/ Robyn G. Darr n/k/a Robyn G. K~rstetter, an
adult individual, who resides R.D. #2 BoX 182A, Dillsburg,
cumberland county, Pennsylvania 17019, and Glenn A. Trostle. an
adult individual, who resides at R.P. #2 Box 165, Dillsburg,
Cumberland county, Pennsylvania 17019.
3. on or about December 7, 1991, Defendants made, executed
and delivered to Plaintiff Ii note and security agreement and a
real estate mortgage financing Eighteen Thousand Four Hundred
sixty-four Dollars and 88/100 ($lB/464.BB) a copy of said note
and security agrenment and said real estate mortgage being
attached hereto as Exhibits "A" and "13"/ respectively, and are
incorporated herein by reference as though fully set forth.
4. Said note and security agreement and said real estate
mortgage have not been assigned.
~. Robyn G. Darr n/k/a Robyn G. Kerstetter Ls the sole
record owner in foe simple of said premises subject to said
mortgage, by virtue of a Peed dated and recorded on November n,
1990/ and recorded in the York County Recorder'a Office in Peed
Book" ", Volume , Pago , more apecifically set forth in
Exhibit "c", attached hereto and made a part hereof by
reference.
6. Said note and security agreement and said real estate
mortgage are in default because Pofcndants herein have failed
to pay the paymenta that were Que and owing for the months of
Maroh 25, 1995, April 25, 1995, May 25, 1995, .Tune 25, 1995
7. The Plaintiff has given to the Defendants written
notice of intontion tc foreclose on said mortgage as required
by law under Act 6, dated April 3/ 1995 and June 2, 1995, a
copy of which is marked Exhibits "D", and att.ached hereto and
made a part hereof by reference.
B. The Plaintiff has given written notice of default as
required by the Homeowner's Emergency Assistance Act of 19B3,
dated April 3/ 1995 and June 2, 1995, a copy of which is marked
Exhibits tiE", and attached hereto and made a part hereof by
reference.
9. ay reason of the afores~id default, the entire
prinoipal balanoe of Seventeen Thousand Three Hundred
Seventy-four Dollars and 09/100 ($17/374.09), with interest
ther.eon at the rat.e of thirteen and one half (13.50%) percent
per annum computed from July 10, 1995, accruing insurance
premiums / attorney's fees in the amount of Eight Hundred
Twenty-aix Doll.ara and 47/100 Dollars ($8,,6.47) are noW due and
payal:lle.
10. 'l'ho Defendants are liable to the Plaintiff for the
following on said mortgage loan:
A. Principal amount and intereat
due through July 10, 1995: $16/529,53
B. Interest at 13.50% from
7/10/95 to 7/13/951
C. Attorney's collection feel
$ 18.09
$ B26.47

WHEREFORE/ plaintiff prays the Court to enter judgment in
favor of plaintiff and to order the foreclosure and sale of the
mortgaged property and for the amount of Seventeen Thousand
Three Hundred Seventy-four Dollars and 09/100 ($17,374.09)
together with interest thereon/ costs and all other amounts
advanced by Plaintiff.
