I. Plaintiff Ls Elalne D. Connolly, an adult individual
residing at 6 Oak Park Circle, Mechanicsburg, CUlllberland county,
Pennsylvania,
2. Defendant is Tholllas J, Connolly, an adult individual
residing at 2342 Kensington Street, liarrisburg, Dauphin County,
Pennsylvania.
3. Parties are the parents of one son, Jordon Connolly, born
March 8, 1995. Child was born in wedlock.
4. Tho partien were married on January 19, 1995.
5. After marriage the plaintiff contlnued to live at her
parent~ residence at 6 Oak Park Circle, Mechanicsburg,
Pennsylvania for two months.
6. The plaintiff moved into the marital home where Defendant
resided in March, 1995.

7, on JUne 16, 1991; the plaintiff voluntarily and without
consent of defendant left the marital home and returned to her
parenta' home.
8, The plaintiff and defendant resided together in the
marital home as husband and wife for only nine weeks.

9. On July 13, 1995, plaintiff filed in Cumberland County a
Petition for Divorce unde~ Section 3301(c) of the Pennsylvania
Pivorce Code, a copy of which is attached hereto and incorporated
herein as Exhibit A,
10. The Divorce Complaint states and is duly verified by
plaintiff's sworn statement that the mar~iage is irretrievably
broken.
II. Over ninety(90) days from the filing have passed.
12. On June 26, 1996 the defendant filed his Affidavit of
Consent and Waiver of Notice of Intention to Request Entry of
Divorce Oecree to divorce as stated under Pa. R.C.P. 1920.42 as
required by Section 3301(c) of the Pennsylvania Divorce Code.
(Copies are attached hereto as EKhibit B).
13. The plaintiff has not consented to the divorce as
~equired under Section 3301(c) of the Pennsylvania Divorce Code,
14. On May 29, 1996 the plaintiff filed a Petition fox'
Alimony Pondente Lite and Interim Counsel Fees. Hearing has been
scheduled for alimony pendente lite and interim counsel fees for

by the plaintiff in irretrLevably broken divorce actions.
"ay v. way, 35 P. & C. 3d 653(1985). The record before the court
shows ample evidence of these three factors.
A. Plaintiff filed an action in divorce under Section
3301(C) of the Divorce Code and over 90 days have passed since
her filing.
The plaintiff filed for a divorce on July 13, 1995. The 90
days required by Section 3301(c) of the Divorce Code has passed.
In fact, II months have passed. "Plaintiff must be prepared to
proceed in a divorce action under the minimum time." Mellot v.
M!tlM, 1 P. & c. 4th 61B (19B!!). In this case the 90 day limit
is well past and the plaintiff has not signed the necessary
consent to finalize the divorce six months after the end of the
statutory period.
B. Defendant has consented to the plaintiff's divorce under
Section 3301(c) of the Divorce Code.

Defendant haa consented to the pLaintiff's divorce. All
relevant facts have boon admitted that the marriage La

C. The plaintiff has not consented to divorce action she
began under Section 330l(c).
In delaying this divorce action the plaintiff is moving
against the intent of the legislature in enacting the divoroe
code. IllU:k v. l3urli, 38 D. Ii. C, 3rd at 560 (1986). 'rhe
legislature gives prLmary consideration to the welfare of the
family, over private rLghts. Morrison v. Morrison, 36 D. Ii. c, 3d
at 51B (19B3). The court has a duty once the defendant consents
that the marriage is irretrievably broken not to let the
plaintiff delay the proceeding. ~~ at 562. The plaintiff has
not given any reason as to why she does not wish to consent to
the divorce which she started. The longer this proceeding
continuos the more economic stress and harm the plaintiff imposes
upon defendant.
Any support the plaintiff gains by delaying the divorce with
defendant has been found as an insufficient reason to delay a
Section 3301(c) divorce. 1!1. at 561. In the current case the
plaintiff who has the most to gain by delaying the divorce and
collecting support payments cannot use ". . . the delay to gain
an economic advantage ovor tho other spouse." .W. at 562.

The plaintiff must be preparad to consent to the dLvorce after
the defendant consents Ln thq statutory tlme p~rlod or lose her
action in divorce. Such actLon maintaLns the lntegrLty of the
courts, complies with intent of the legislature, and relievell any
economic harm that could be caused on the defendant,

7. Therefore, Plaintiff cannot receive alimony pendente
lite and support simultaneously.
8, Plaintiff's failure to understand the relevant laws have
reBulted in Respondent incurring attorney cOBtB in reBponding to
the claim of alimony pendente lite and interim counBel feeB.

attorney's fees in the amount of $487.50 of which the entire

10. Had Plaintiff known the law regarding spousal Bupport
and alimony pendente lite not being in effect Bimultaneously,
none of theBe costB to Defendant would have occurred.

Order, Plaintiff had the opportunity to file an appeall instead
Plaintiff iB attempting to 'double dip' by collecting Bpousal

4. Agreed in part and denied in part. The plaintiff has
not reached a sattlement in this caBe although plaintiff haB made
an offer for Bettlement. Tho plaintiff and dofendant were
married in January 1995 but plaintiff refused to move in with
defendant until March 1995. plaintiff: left the reBidence on her
own accord without consent of defendant in May 1995. Plaintiff
lived with defendant two months of their five-month marriage.
There are no equitable distribution issues, however, plaintiff
haB been feverishly litigating to incur additional legal cOBts by
filing frivolous claims (plaintiff throe timeB has raiBed or
filed B change of venue claim).
6. Pllnisd. Pll.lintlff ia fully aware that dufendant'B
annual income iB approximately $38,000, Plaintiff repoatedly
stateB thllt plaintiff III/lkua in UXCllSI-i of $40,000, although uhe
has no proof nor Was plaintiff able to produce any Hvidunce of
defendant's incollle of $40/000 in court or of tho al Logathm of
defendant's income of $40,000 in court. PLaintiff's annual income
is statud as undor $6,000 as plaintiff refuBes to work to support
horsel! or her child.
6. Denied. Plaintiff seoks alimony pendente lito to
financially punish defondant. Plaintiff haB ample income to
support her litigation. Plaintiff continues to file frivolous
claims and actions to increase cOBtS which she believes defendant
will incur. Plaintiff has three times attempted to change venue/
haB forced defendant to obtain an emergency order for custody,
haB agreed to a custody evaluation and then demanded the most
expenBive evaluation knowing defendant had agreed to pay two-
thirdB of the cOBt. Plaintiff further agreed to mediation and
then refuBed to have said agreement entered into a court order.
7. Penied. Plaintiff as well as Attorney KollaB have
stated that Attorneys Kollas and Kennedy was representing her for
free.
8. Denied. Plaintiff is clearly able to pay her counsel
feeB, COBtB and expanseB of this action. Plaintiff merely
chooseB to have defendant charged with this additional
reBponBibility, Defendant is not able to pay plaintiff's counsel

fees and costs and expenses without extreme harduhip and a
dramatic and significant effect on hiB life.

court cauaing defendant to lncur attorneYB' fees to respond to

10. Plaintiff'B pay stubB show she works between five and
15 hours a week, at approximately $6 per hour. If plaintiff
worked a normal 40 hours, her income would be $12,500 annually.
11, Pefendant workB at night and plaintiff, when Bhe works/
works during the daYI there iB no child care cost aB defendant
cares for child while plaintiff workB and vice verBa. 'l'here iB
no reaBon for plaintiff to not work a normal work week.
12. Plaintiff's tncome and ExpenBe Statement Btates her
monthly expenBes are $90 a week or $389 a month and her income is
$115.52 (net a week, or $500 net a month).
13. Plaintiff'B Income and Expense Statement, Bubmitted to
the Court and Bworn by plaintiff, fails to include child support
and spousal support payments made to plaintiff.
14, Defendant pays to plaintiff child support and spousal
support of $433 a month. This iB an excess of $343 a month after
plaintiff'B monthly expenBeB without plaintiff's job income taken
into account. with plaintiff'B job income taken into account/
