The Plaintiff/Petitionor is Cumberland Truck Equipment company, a Pennsylvania corporation, with its principal place at business at 25 Roadway Drive, carlisle, cumberland county, Pennsylvania. 2. The Defendant/Respondent is Dauphin Excavating, Inc., a Pennsylvania corporation, with its principal place of business at 1097 Cherry Hi 11 Drive, Harrisburg, Dauph in county, Pennsylvania. J. On June 22, 1995, the 1'laintHf/Patitioner obtained a judgment in its favor and against the Defendant/Respondent from District Justice Susan K. Day, a copy of said judgment being attached hereto as Exhibit "A" and incorpor.ated herein. 4. On or about July 17. 1995, the Defendant/Respondent filed an appeal of said judgment with the Court of Common Pleas of Cumberland county to the above term and number and had a Rule issued by the Prothonotary upon the plaintiff/Petitioner to file its complaint within twenty (20) days or suffer entry of a judgment of non pros. 5. On July 28, 1995, the Plaintiff/Petitioner, then pro se, by its President, Joseph M. Peduzzi, tiled a Complaint with the p~othonotary of cumberland county against tho Defendant/Respondent. ^ copy of said complaint is attached hereto as Exhibit "B" and incorporated herein. 6. Baid complaint was inadvertently docketed as a neW aotion to 95-4016 civil Term rather than to the above term and number. 7. By letter dated July 24, 1995, but mailed July 2B, 1995, a copy of said complaint was Bent to ciounsol of record for Defendant/Respondent. A copy of said letter is attaohed hereto as Exhibit "c" and incorporated herein. B. on August 22, 1995, the Defendant/Respondent through its oounsel of record had a judgment of non prOD entered against the plaintiff/petitioner to the above term and number. 9. Plaintiff/petitioner, then pro se, reasonably believed it had done all that war required to proceed with litigation against Defendant/Respondent when, through its President, it filed the complaint on July 2B, 1995. 10. plaintiff/petitioner has promptly filed a Petition to open the judgment of non pros. 11. Defendant/Respondent will not be prejudiced by the opening of the judgment of non pros.
