1. First Nationwide Bank (hereinafter referred to as
"Plaintiff") is a Bank conducting business under the laws of the
Commonwealth of Pennsylvania and brings this aotion to foreclose
the Mortgage between Charles R. Gerow and Ellene S. Gerow,
Mortgagors (hereinafter referred to as "Defendants") and itself as
mortgagee by Auignment. Said Mortga,ge was dated March 4, 1908
and is recorded in the Office of the Recorder of Deeds and
Mortgages in and for Cumberland County, Pennsylvania in Mortgage
Book 096, page 600 and was subsequently assigned in Assignment
Book 354, page 1160 and last assigned in Assignment Book 405, page
437. A oopy of the Mortgage is attaohed hereto and made a part
hereof as Exhibit "A".
2. The Mortgage seoures Defendants' Note dated Maroh 4,
1988 in the amount of $116,250,00 payable to Plaintiff in monthly
installments with an interest rate of 8.625t, A oopy of the Note
i. attaohed hereto and made a part hereof as Exhibit "B".
3. The land subjeot to the mortgage iSI
ALL THAT CBRTAIN piece or paroe1 of land, situate in the Town.hip
of Hampden, countr of Cumberland, and state of Penneylvania,
bounded and desor bed as follows, to witl
BBGINNING at a point on the eastern lino of Thomu Prive, said
point being at the dividing line between Lots NaB. 5 and 6 on the
hereinafter mentioned Plan of Lots, thence along eaid dividing
line North 84 degrees 32 minutes Bast, one hundred eighty-eight
and sixty-eight hundredths (118.681 feet a point, thence South 10
degrees 20 minutee Bast, seventy-e ght and twenty-one hundredths
(78.211 feet to a point on the northern line of Charles Road,
thence continuing along the northern line of Charles Road South 64
degree I 09 minutes West, fifty-eight and thirty-one hundredths
(58.31) feet to a point, thence oontinuing along the northern line
of Charles Road on a ourve to the right having a radius of two
hundred fifty (250) feet, an arc distance of eighty-eight and
ninety~four hundredths (88.94) feet to a point, thence continuing
along the same South 84 degrees 32 minutes West, fifty-three and
fifty-eight hundredths (53.58) feet to a point on the eastern line
of Thomas Drive, thence continuing along the eastern line of
Thomal Drive North 05 degrees 28 minutes West, one hundred
thirteen and ninety hundredths (113.90) feet to a point, the place
of BBGINNING.
BEING LOT NO. 6 Block "J" on Plan No. 5 of Del-Brook Manor, laid
plan being reoorded in the Cumberland County Reoorder'. Offioe in
Plan Book 12, page 37.
BAVING THEREON ERECTED a two story briok and frame dwelling house,
being known and numbered as 4725 Charles Road, Meohanicsburg,
Penney1 vania.
4. The Defendants, Charles R. Gerow and Ellene S. Gerow
are the real owners of the land subjeot to the mortgage and the
Defendants' address is 4725 Charlel Road, Msohaniosburg, PA 17055.
5. The Mortgagu is now in default due to the failure of
the Defendants to make payments as they beoame due and owing. The
following amounts are duel

6. III aooordanoe with the provisions of the Aot of January
30, 1974, P.L. 13 No.6, seotion 403 (41 P.S. 4031, a Notioe of
Intention to Foreolose Mortgage and a Notioe of Emergenoy Housing
Assistanoe was forwarded to the Defendants, by regular and
certified mail on May 11, 1995. A oopy of the notioes are
attaohed hereto and made a part hereof as Exhibit "CU. Defendants
have not oured the default.
WHBRBFORE, Plaintiff requests the Court enter Judgment in
Mortgage Foreclosure for the sale of the mortgaged property in
Plaintiff's favor and against the Defendants, Charles R. Gerow and
Bllene S. Gerow in the sum of $123,456.14 together with interest
from 6/29/95 at $26.77 per day, oosts of suit and attorney fees.

"Plaintiff" I is a Bank oonduoting business under the laws of the
Commonwealth of Pennsylvdnia and brings this action to foreclose
the Mortgage between Charles a. Gerow and Ellene S. Gerow,
Mortgagors (hereinafter referred to ao "Defendants") and itself as
mortgagee by Assignment. Said Mortgage was dated Maroh 4, 1988
and is reoorded in the Offioe of the Recorder of Deeds and
Mortgages in and for Cumberland County/ Pennsylvania in Mortgage
Book 896, page 608 and was subsequently assigned in Assignment
Book 354, page 1168 and last assigned in Assignment Book 485, page
