ZEIGLER, Detendant 95-3804 I':\)UI'l'Y 'I'ERH QBDjJLQt' COURT AND NOW, thiB 4th day of Deoember, 1995, upon ccnsideration ot Plaintiff's Petition for Partition of Real and Psrsonal Property lIubsequent to Entry of Divoroe Deoree, and tollowinq a preliminary conference in chambers pursuant to Pennsylvania RUle of criminal Prooodure 1558 in which Plaintiff was represented by Donald T. Kissinger, Esquire, and Dofendant was represented by Keith B. DeArmond, Esquire, and pursuant to an aqreement of counsel, it is ordered and directed as followsr 1. Attorney DeArmond shall promptly contact the superintendent of the Florida condominium complex and the real estate aqent designated by Plaintiff in order to perform a preliminary investigation of the value of the 2063 West Lake View Boulevard, Unit B3, North Fort Myers, Florida, real estate parcel. Appropriate telephone numbers shall be provided immediately by Plaintiff. Parties shall then determine whether a stipulation as to the value of said real estate parcel may be accomplished without the necessity for appraisal. In the event ot an inability to reach a stipulation, the Plaintiff shall provide Attorney DeArmond names of three certified appraisers in the North Fort Hyers area, and Attorney DeArmond shall select one appraiser to complete an appraisal of the property as soon as practicable. The cost of said appraisal shall be borne by the parties from the jointly titled IDS account number 0115-3347611-0 002. I'll (" ..,,' ..' Defendant shall immedintely requost n market analyais of the real ostate parcel located at 90n Cocklin street, MeQhaniosburg, Pennsylvania. PArties shall then attempt to reaoh a stipulation as to the value of said real estate paroel based on results of said market analYBis. In the event of an inability of the parties to reach n stipulation, Attorney DeArmond shall propose three certified real oBtate nppraiBers in the Meohaniceburg area to Attorney KiBsinger, and Attornuy Kissinger and his olient shall select one appraiser to perform an appraisal of said real estate parcel, COBtB of said appraisal shall be borne by the parties from the above-referenced IDS account. 3. The partieB acknowledge and agree that Defendant shall receive the 905 Cocklin Street property and Plaintiff shall receive tho 2063 WeBt Lake View BOUlevard property as part of a final order directing partition. Parties further agree that Plaintiff Bhall receive the 1986 Pontiac 600LE automobile, the 1980 Fleetwood 32-foot camper, and the 1970 Surary pop-up camper as part of any ultimate partition order. , ~ I I 4. Parties stipulate and agree that the appraised values for the respective real estate parcels shall establish the values thereof for partition purposes. Parties agree that each shall propose values for the automobile and campers within 15 days from the date hereof, and they shall attempt to reach a stipulation as to a value for said automobile and campers for partition purposes. Plaintiff, Robert H, Zeigler, Jr., is an adUlt individual who presently resides at 43 Hellam Drive, Mechaniosburg, Cumberland County, Pennsylvania, 17055. ~, Defendant, Carol A. Zeigler, is an adult individual who resides at 905 Cocklin street, Cumberland County, Mechanicsburg, Pennsylvania, 17055. 3. 'l'he parties were married on July 11, 1964 and were diVorced by this Honorable Court on March 22, 1995. 4. At the time the divorce decree was entered, the parties owned various property, both real and personal as tenants by the entireties. 5, Accordingly, pursuant to 23 Pa.c.s.A. ~3507(a) said entireties property became, upon entry of the divorce deoree, property held by the parties as tenants in common ot equal one-half shares in value.
