I
Before the court is the license suspension appeal of Riohard
GibBon. We held a hearing on August 31, 1995, from whioh we made
the following findings at fact.
FINDING~K~~
1. Richard Gibson ("Gibson", is an adult male residing at
3824 Trindle Road, Camp lIill, Cumberland County.
2. Gibson is the owner of a Nissan Sentra sedan,
Pennsylvania license number ATR 1112.
3. On March 11, 1995, Allstate Insurance notified the
Department of Transportation, Bureau of Driver Licensing ("the
Department") that Gibson's insurance for the aforementioned
Nissan had lapsed as a result of his failure to pay the required
premium.
4. On that date, Gibson wae vacationing in Florida. He did
not learn of the insurance lapse until he returned to
PennBylvania in late April.
5. Gibson testified that upon his return, on April 24,
1995, he immediately reinstated his auto insurance and inBtruoted
his insurance agent to notify the Department.

6. On June 19, 1995, the Department mailed an official
notice to Gibson that hie license would be suspended effective
July 22, 1995, for a period of 3 months AS A result of his
violation of seotion 1796 of the Vehiole Code. 75 Pa.C.S.A. 5
1796.
7. Gibson indioated that he neither used nor permitted use
of his vehicle during the time that it was uninsured.
9. Gibson represented himself at the hearing.
PISCUSSION
The seotion of the Vehiole Code at issue in this oass stat..
in pertinent part
(a) aeneral rule.- Every motor vehiole of
the type required to be registered under this
title whioh is operated or ourrently
registered shall be covered by financial
responsibility.
....
(d) Suepeneion of registration and operating
privilege.- The Department of Transportation
shall suspend the registration of a vehicle
if it determines the required finanoial
responsibility was not seoured as required by
this chapter and shall suspend the operating
privilege of the owner or registrant for a
period of three months if the department

determinee that tho owner or regiatrant haa
operated or permitted the operotJ.on of the
vehiole without tho required financial
reaponaibility,..Whenever the department
revokes or suspends tho regiatration of any
vehiole under thiR chapter, the department
shall not reRtore the ragiRtration until the
vehiole owner furnisheR proof of financial
responsibility in a manner determined by the
department and submits an application for
registrstion provided by section 1960. This
subseotion shall not apply in the following
circumotances I
(1) The owner or registrant proves to the
satisfaction of the department that the lapse
in financial responsibility was for a period
of less than 31 days and that the ownsr or
registrant did not operate or permit the
operation of the vehicle during the period of
lapse in financial responsibility.

The only possible ground upon which Gibson can base hia
appeal is all argument that his aituation fits in to exception
(d)(l) listed above. The facts, however, indicate tho contrary.
The law in this matter is clearly on the side of the
