3. ~ copy of the complaint was served upon Martin F. Horn,
Commissioner of the Penney 1 van ia Department of
corrections, Kenneth Kyler, Superintendant at the state
correotional Institution at Camp lIill (hereinafter IISCI-
camp Hillll) and William S. Ward, Unit Manager at SCI-Camp
Hlll on July 21, 1995, by the cumberland county Deputy
Sheriff .
4. Defendants Horn, Kyler and Ward, acted in good-faith and
forwarded the Complaint that had been sorved upon them
through normal channels to the Ofr ice of Attorney General
in Harrieburg, Pa.
5. After coneidering the matter, the Office of Attorney
General elected to delegate the reeponsibility to
represent the Defendant's in thie action back to the
legal staff of the Pennsylvania Department of corrections
on or about August 2, 1995.
6. The case was delegated to this attorney on August 4,
1996.
7. A response to the Complaint ehould have been filed on or
before August 21, 1995.
8. On May 19, 1995, attorney Cheryl G. Young resigned from
employment as Chief Counsel for the Pennsylvania
Department of corrections.
9. Following the departure of Ms. Young, Attorney David B.
Farney was named Acting Chief Counsel.

la. Due to the reassignment, it become necessary for Acting
Chief counsel Forney to redistribute his CBse load among
the remaining staff attornoys.
U. A large portion of Actinq Chief counsel Farney's caSa
load was reossigncd to this attorney.
12. Many of the newly delegated cases to this attorney
required immediate attention.
13. The duties already imposed upon this attorney, in
addition to tho cases inherited from Attorney Farney
oreated 0 log-jam, making it impossible for this attorney
to review and respond to all of the cases in her existing
oase load and in the newly assigned case load in a timely
fashion.
14. Due to this aeries of events outlined above, counsel for
the Defendant's was unable to complete the responsive
pleading or answer in a timely manner.
115. Defendant/s failure to act timely was a result of
"inadvertence" or "excusable neglect". See Yonofski v.
Wernick, 362 Fed. SUpp. 1005 (1973) (S.D.N.Y.).
16. There will be no harm to Plaintiff by the granting of
this Motion.
17. Granting this Motion will not substantially delay the
disposition of this matter.

:I. The complaint ohallen(jes the Dete/ldat,ts' deoision to
reolassify Plaintift from Phase II to Phase IV within thll
Spsoial Mana(jement Unit ("SMU").1
3. Inmatss are (jiven the opportunity to progress through
.peoitio phasos within the SMU based on their behavior
and ability to adjust. Attaohed hereto as Exhibit "A" i.
a oopy ot the relevant portion of the SMU Inmate
Handbook.
4. Plaintiff alleges he was reolassified to Phase IV from
Phase II as punishment for having broken a window in the
SMU exeroise yard.
5. Plaintiff avers that the Defendants' dooision to
reolassify is a violation of his federal oonstitutional
and state constitutional rights to duo process and equal
protection.
6. In support of his olaims, Plaintiff avers that onoe he
confessed to breaking the window and was given a sanction
by a Hearing Examiner he should have been returned to
Phase II.
7. Plaintiff has failed to state a olaim for which relief
can be granted.
B. A prisoner enjoys no due process right to be plaoed in
any particular prison or to receive a hearing prior to an

administrative transfer from one prison to another,
inoluding a transfer for security reasons. Hentavns v.
Havnes, 427 U.S. 236 (1976) / Moachum v. Fane, 427 U.S.
215 (1976).
9. Plaintiff alleges his plaoement in phasll IV has resulted
in his loss of privileges which inclUde "2 hcur exeroise
yard, block-cut activity, janitorial jobs, television,
radio, commissary and use of telephones."
10. Plaintiff has set forth no facts that demonstrate that he
suffered a hardship that is atypical and significant in
relation to the ordinary incidents of prison life as
required by the Supreme Court's decision in Bllndin v.
~onner, 63 U.S.L.W. 4601 (June 19, 1995).
11. The changes in confinement conditions oomplained of by
Plaintiff do not implicate the Due Process Clause even if
such a change results in the imposition of more
burdensome conditions BinGe SUch a change is within the
normal range of custody and is authorized by Plaintiff'S
underlying conviction. Meachum v. Fan.Q, 427 U.S. 215
(1976) .
12. The sanction imposed in this instance was a necessary
incident of confinement and thus created no protected

status. These inmateo will receive the required minimum ot
privileqe. and services established by Admini.trative Di-
rective 802. These inmates will have no .ervice, b.yond
~he Phase V inmates except to apply tor po.t hiqh schooL
corre.pondence courses throuqh the Education Department.
Security and oontrol are maintained at a maximum level.
Thi. is still considered to be administrative cu'tody, but
the inmate is eligible tor additional rrivUeqes and .ervi-
ce.. In this phase, in-oell proqramm ng will be increased
to allow the inmate .upervhed cell .tudy proqrams trom the
Education Department and the ability to order two leisure
trom the library per week.
This is the tirst time that the inmate will be allowed out
individually or in small groups without restraints. The
inmate is still listed as administrative custody status.
It will be his/ her introduction to out-ot-cell programminq
within the unit and to interaction with other inmateEl.
Secause these inmates are in a moditied release proqram,
small out-ot-cell group activities may be allowed. This
will, inolude group counselinq, small group yard activities,
education clalles and block-out. As inmates progress 1'n
this phase, they may be IIsiqned as block workers or
janitors. Completion ot this phase will be tollowed by a
tranater recommendation to the inmate's parent or other
desiqnated institution.
Phase I will be a control group unit in the inmate's desiq-
nated institution. Phase 1 is the only phase that has a
tixed time limit. The time limit is ninety (90) days, but
the desiqnated institution can extend this periOd with jUllt
caulle.

prior to advancament to the next program phase. Inmates will only be

GaHBaAL ROLIB AND alGOLATIONII
1. COOHT .ROCIDURIII All inmates will be required to stand oount
at their cell so that he is clearly visible to the otticer dur-
ing the 1700 and 2100 hours count. The night light will remain
on in all cell. at all times. Count will be announced rive min-
utes prior to count being conducted. progressive di.ciplinary
measures will be taken tor those tailing to comply.
2. IROWIRII Time will be determined by SHU statt and will be an-
nounced rive minute. prior to start. Inmate. will be allowed to
take a towel, washcloth and a bar ot loap to the shower. You
mUlt be ready tor inspection and standing at yoUt' cell door when
the Officer arrives tor handcuffing. Failure to comply will
result in your being by-passed tor .howen. Showers will be run
three (3) times per week, provided there are no security reasons
prohibiting it.
3. lHAVll1 Shaves will be ottered three (3) times e week. Indi-
vidual disposable razors will be marked and assigned to each
inmate. They will be stored by the Officers and will not be
USQd by any other inmate. Razors will be used three times and
then exchanged tor a new one.
4. VIIITII Type and trequency ot visits tor a SKU inmate will be
determined by his program phase Blsignment. Visiting privileges
tor program phase V through II are as tollowSI
PROGRAM PHASE VI NON-CON'rACTI 1 PER MONTH, IMMEDIATE FAMILY
ONLY AND LEGAL COUNSEL.
PROGRAM PHASE IVI NON-CONTACT, 1 PER WEEK, AND LEGAL COUNSEL.
PROGRAM PHASE IIII NON-CONTACT, 1 PER WEEK, AND LEGAL COUNSEL.
PROGRAM PHASE III NON-CONTACT, 1 PER WEEK, AND LEGAL COUNSEL.
All SKU inmate visits will take place in the security visiting
area located in the SKU. You will be escorted to and trom vis-
its by assigned otticers. Failure to comply with all rules and
requlations during visitations will result in the termination ot
.your visit. No personal items are permitted. Legal materials
may be authorized tor legal visits with p~ior approval ot the
Deputy Superintendent. Length ot visits w~ll be one (1) hour.
You will be permitted to have one (1) adult and one (1) child
(under 18 years ot age) visit at anyone time. There is no
smoking in the visiting area either by you or your visitor.
