NOW THIS AGREEMENT WITNESSETH: That Contractor for and in considtration of the
awarding to him by Owner of said contract as aforesaid, as well as the further consideration of One ($1.00)
Dollar to him paid at or belore the ensealing and delivery of these pres.nts, the receipt whereof is hereby
acknowl.dged, does htreby covenant, promise and agree that no mechanics' lien or claim or other Ii.n or
claim 01 any kind whatsoever shall be 61.d against the said building or buildings or the curtilage or curtilag.s
appurtmant thereto, by Contractor or by any sub.contractor, materialmen or laborers for work done or
materials furnish.d under said contract for and about said building or buildings or any part thereof, or on
c..dit thereof, and that all sub.contractors. mattrialmen, and laborers on said work shall look to and hold
Contractor personally liable for al\ sub.contracts, materials furnished and work and labor done, so that
there shall not be any legal or lawful claim of any kind whatever against Owner for any work done or
labor or mat.rials furnished under said contract for and about the erection, construction and completion
of said buildings as aforesaid, or undtr any contracts lor extra work, or for work supplemental thereto,
or otherwise
AND, in ordtr to give the Owntr full power and authority to protect himself and the lot or lots of
ground against any and all claims filed by the Contractor or anyone acting under or through him or it in
violation of the foregoing covenant, the said Contractor for himself, themselves, itself, hereby irrevocably
authorizes and empowers any AlIom.y of any Court of Common Pleas of the Commonwealth of Penn.
sylvania, to appear for him, them, it, or anr of them, in any of the said Courts of Common Pleas as
AlIomey for hIm, them or it and in his, their, its, name, mark satisfied of record at the cost and exptnse
of the Contractor or of any Sub.Contractor dr Mattrialman, or Materialmen, any and all claims or claim,
lim or Iims, filed by or lor the Contractor, or any Sub.Contractor or Materialman, or in his or thdr name
against said building or buildings, lot or lots of I,:round or any part thereof and for such act or acts this
shall be good and suffici.nt warrant and authont)', and a refermce to the Court, Term and Number in
which and whtr. this Agreement shall have been filed shall be a sufficient exhibit of the authority herein
contained to warrant such action, and Contractor for himself, themselves, itself, do hereby r.mise, reltas.
and quit.claim all rights and all ma r of errors, defects and imperfections whatsoever m entering such
satisfaction or in anywise touching r concerning the same.

ALL TIIAT CERTAIN piece, parcel or lot of land situate in Hampden 'lbwnship,
CUmberland County, pennsylvania, and bounded and described as follows:
BEGINNING at a point which is located on the Southern right-of-way line of
Englewoood Court, said point being located at the Southwestern corner of Lot lb.
28; thence extending along the Souelern boundary line of Lot No. 28 and through
a 30.00 foot sanitary sewer easement South 48 degrees 34 minutes 45 seconds
East, for a distance of 108,92 feet, to a point in line of Lot No. 27; then
along the western boundary line of Lot lb. 27 and passing through a 25.00 foot
sanitary sewer easement and a 50.00 foot buffer area South 21 degrees 25 minutes
15 seconds West, for a distance of 66.78 feet, to a point in line of lands now
or formerly of Russell F. and Ruth S. Radabaugh; then along the lbrthern
boundary line of said lands and partially along lands now or formerly of ~~rk A.
and Diana M. Bradley South 82 degrees 35 minutes 15 seconds West, for a distance
of 138.00 feet, to a point at the Southeast corner of Lot No, 30; then along the
Eastern boundary line of Lot No. 30 and through a 25.00 foot drainage easement
and a 50.00 foot buffer area North 12 degrees 48 minutes 15 seconds East, for a
distance of 139.82 feet, to a point on the right-of-way line of Englewood Court;
then along said right-of-way line on the arc of a circle curving to the left,
having a radius of 50.00 feet, an arc length of 53.57 feet, to a point and the
place of BEGINNlOO.
This piece, parcel or lot of land consists of approximately 15,937,72 square feet
of land, and is known and numbered as Lot No. 29 on the Final Approval Plan of
Phase lIB - Westbury, which is recorded In Cumberland County in Plan Book 69,
Page 15.
BEING PART OF TIlE SAME PREMISES which Jean I. Cignetto, widow, of 32 Ball lIai
Road, Mechanicsburg, Cumberland County, Pennsylvania, by Deed dated March 21,
1990, and recorded in Cumberland County in Book L34, Page 954, conveyed to The
~~Nauaghton Company, a Pennsylvania Corporation, Grantor herein.
