PETITION TO COMPEL ARBITRATION
Petitioner, through his undersigned counsel, petitions this
Court pursuant to 42 Pa,C.S.A. Section 7304(a) for an Order
compelling arbitration in this matter, and in support hereof
represents as follows:
1,
Petitioner is a citizen of the Commonwealth
of
Pennsylvania residing at 10 Windy Hill Road, Newville, Cumberland
County, Pennsylvania 17241.
2.
Respondent, State Farm Insurance Company, is
an
insurance
company
duly licensed to do business
in
the
Commonwealth of Pennsylvania with its principal place of business
at 1 Slate Farm Plaza, Bloomington, IL 61710.
3. Petitioner was seriously injured in an automobile
accident which occurred on June 10, 1992 on Newville Road in
North Middleton Township, Cumberland County, Pennsylvania.
4. Petitioner settled with the tort feasors automobile
insurance carrier for the applicable liability limits.
5, Petitioner's physical condition improved to the point
where he was able to return to work and he did, in fact return to
work, subsequent to the accident.
6. Petitioner has, however, been treating with a physician
throughout the time period from the date of the accident to
present
for the injuries sustained in automobile
vehicle

accident, Said physician noticed a deterioration in his
condition and advised him to seek accommodations in his
employment which would mitigate his deteriotating condition.
7. Petitioner ~ought such accommodations, however, it was
determined that they were not feasible.
8. Petitioner's physician then advised Petitioner to stay
off work indefinitely.
9. Petitioner believes that he will suffer wage lost and
further medical bills, pain, and sUffering, above and beyond the
liability policy limits.
10. At the time of the automobile accident, Petitioner was
a named insured on an automobile insurance policy which was
issued to Petitioner by Respondent and which was in full force
and affect at the date of the accident. A copy of the insurance
policy is attached hereto as Exhibit A.
11. The Petitioner demanded from the Respondent
underinsured motorists benefits to which he was entitled under
the insurance policy by written correspondence which
acknowledged by the Respondent.
12. Respondent offered to settle Petitioner's under insured
motorists benefit claim for an amount far below the policy amount
and the damages suffered by Petitioner.
13. As of the date of filing this petition, the
has not paid any under insured motorists benefits to
pursuant to Petitioner's insurance policy.
14. Section III - coverage U of Petitioner's insurance
policy with Respondent provides that either party may require the

other to submit to arbitration and any dispute involving a
party's legal right to recover bpnefits or other payments under
the policy.
15. Petitioner's insurance policy provides in paragraph
length that the arbitration shall be governed by The Pennsylvania
Uniform Arbitration Act.
16. On or about June 9, 1995, Petitioner mailed Respondent
demand for arbitration pursuant to the terms of the policy of
insurance.
Petitioner named in that demand its choice of
arbitrator on Petitioner's behalf. On or about June 20, 1995,
Petitioner sent a follow-up letter to Respondent requesting the
name of counsel responsible for the defense of the UIM claim.
17. To date, neither of Petitioner's demand nor request
have been answered by Respondent.
18. All conditions precedent to arbitration under the terms
of Petitioner's insurance policy with Respondent have been
satisfied.
19. Because Respondent has failed to arbitrate pursuant to
terms of its policy and Pa.C.S.A. Section 7304, Petitioner
requests that this Court appoint the remaining two arbitrators
pursuant to Pa.C.S.A. Section 7305.
20. Petitioner presents the following individuals to be
appointed as arbitrators in this matter:

arbitrators respectively.

Dear Mr. Cheffins:
I am in receipt of the Court's Rule in the above-
referenced matter. I have agreed to the appointment of Mr.
Faller to act on my behalf in the above-referenced matter. Mr.
Faller and Mr. Rector are in the process of appointing a neutral
arbitrator. Accordingly, with the concurrence of Attorney
Deitchman, as evidenced by her letter of July 28, 1995, a copy of
which is attached hereto, the issues raised in the Petition are
now moot and the Petition may be deemed withdrawn. Counsel for
Mr. Baughman reserves the right, however, to renew his Petition
