Defendant
COMPLAINT
AND NOW, this 1st day of August, 1995, comes James C. Felmlee,
by and through his attorneys, Mancke, Wagner, Hershey & Tully, and
avers as follows:
1. Plaintiff is James C. Felmlee, an adult individual with
a residence at 133 Locust Point Road, Mechanicsburg, Cumberland
County, Pennsylvania 17055.
2. Plaintiff is an independently employed, and licensed
distributor of paraphernalia for small games of chance.
3. Defendant is the Veterans of Foreign Wars/Post #7415, a
non-profit organization with an address of 109 Third Street, New
Cumberland, Pennsylvania 17070.
4. From approximately June 12, 1992, up through and
including September 26, 1994, the aforementioned parties engaged in
an ongoing business relationship whereby Defendant would purchase
small games of chance from Plaintiff for use within the
establishment pursuant to a small games of chance permit possessed
by Defendant.
5. As part of that business relationship, Plaintiff would
deliver to Defendant games of chance whenever requested, with the
understanding that the invoices would be paid within a reasonable
t.
time thereof.
6. Over the course of this business relationship, Defendants
fell behind in their payments, and began to make accelerated
payments starting with the more recent invoices and working their
way back to the older invoices.
7. Defendants have paid all of the invoices except two.
B. On August 21, 1992, plaintiff delivered to Defendant
assorted games of chance, and Defendant, through its agents, signed
said invoice in the amount of $165.36. A copy of said invoice is
attached hereto and made a part hereof as Exhibit "A."
9. On August 31, 1992, plaintiff delivered to Defendant
assorted small games of chance, and Defendant. through its agents,
signed said invoice in the amount of $540.60. A copy of said
invoice is attached hereto and made a part hereof as Exhibit "B."
10. Defendant has consistently failed to honor plaintiff's
request for payment on these amounts, and plaintiff continues to be
due the amount of $715.96 for the merchandise delivered, but not
paid for.
WHEREFORE, plaintiff respectfully requests This Honorable
Court to enter a judgment in his favor in the amount of $715.96,
together with any and all other relief the Court deems appropriate.
