COMPLAINT IN CIVIL ACTION
AND NOW, come the Plaintiff, SBRVPRO WEST SHORB, INC., by
and through the undersigned counsel, Allan G. Gallimore, Esq.~
Augusto N. Delerme, Esq., and DELERME & GALLIMORB, who file the
following Complaint in civil Action in response to Defendants'
Rule to file Complaint:
1. Plaintiff, SERVPRO WEST SHORB, INC., is a corporation
organized and existing under the laws of the Commonwealth of
Pennsylvania, with offices at 167-A S. Bnola Drive, Enola,
Pennsylvania, 17025.
2. Defendant, JIM COLLINS is an individual and citizen of
the Commonwealth of Pennsylvania with an address at P.O. Box 27,
Carlisle, Pennsylvania, 17013.
3. On or about November 15, 1994, at the defendant request,
plaintiff made certain structural and content cleaning to

defendants' property, and supplied the materials and labor for
the performance of said work as set forth in the contract and
service authorization, a true and correct copy is attached hereto
marked as Exhibit "A."

4. The prices which plaintiff charged for the labor and the
materials supplied in the performance of the work, were fair and
reasonable and were the ordinary market prices for labor and
materials of that character, and defendant promised and agreed to
pay the plaintiff the full amount thereof. A true and correct
copy of the final invoice is attached as Exhibit "B."
5. The total amount charged by the plaintiff for the
cleaning services done and material supplied was $7,305.92.
6. Defendant accepted the work and services performed and
material supplied by plaintiff.
7. The structural portion of the bill was covered by
insurance, and that amount of $3,684.54 was paid by the insurance
company.
8. The balance due and owing to plaintiff from defendant is
$3,621.38 plus interest and costs.
9. Defendant has neglected and still neglects to pay the
balance due or any part thereof, though plaintiff has made
frequent demands upon him to do so.
10. On June 22, 1995, plaintiff received a judgement of
$3,847.29 against defendant, a true and correct copy is attached
as Exhibit "C."
11. Dsfendant now appeals that judgement to this court.
WHEREFORE plaintiff requests this court dismiss defendants'
appeal, and order that the costs and attorneys fees of this
action be added to the judgement below.

communication with Defendant's insurance company. Plaintill's first communication, concerning
this matter, with Defendant's insurance comp"ny occurred on December 12. IlJlJ4at which time

covered by the insurancc policy for the work which had been completed. By way oflill'lher
answer, on Novcmbcr IS, 1994, whenlirst contacted by the Defendant, 11laintill'was of the belief
that Defendant's insurance company would not cover work to clean the personal property of
Delendant's tenants and informed Delendanl of this belief lit thllttime. With this knowledge
Defendant instructed Plaintitrto perlimn the restoration work to clean the personal property of
Dcfendant's tcnants.
16. Admitted in part and denied in part. It is admitted that Plaintill'required the $250.00
deductible be paid prior to starting Plaintill's services. It is denied Plaintill' advised Delendant
thatllll of Plaint ill's services would be covered by Defendant's Insurance Policy with State Farm
Insurance Company, except for the $250.00. Plaintitr turther advised Defendant that. in Plaintiff's
opinion, the insurancc policy would IllJ.1 cover the content c1caning of the personal property of
Defendant's tcnants. With this knowlcdge Defendant instructed Plaintitrto perform the
restoration work to c1can thc personal property of Defcndant's tcnants.
17. Denied. It is denied thatl'laintill'advised Defendant that Plaintitrrequired payment in
advance on all services not covered by insurance.
18. Denicd. Plaintill' never advised Delendantthat the only cost which would not be
covered by insurance was the $250.00 deductihle. By way oflurther response, Delendant was
informed that in Plaintiff's opinion the cleaning of Dc fend ant's tcnants pcrsonal property would
not be covercd by insurance and therelore pursuant to the servicc authorization signed by
Defendant that Defendant would be liable Ihr this work.
19. Denied. It is denicd that Defendant authorized PlaintilTto perlbrm only the structural
restoration services. By way of further respunse. Defendnntnuthorized I'lnintil1'lu perlhrm buth
stmctural and content restoration serl'ices. In addition, 1'lnintilTnever advised Defel1llnlllthnt
Defendant's only cost would be the $250.00 deductible nor that Plaintifi'required paymcnt in

content cleaning of the personal propcrly of Delcndant's tennnts.

authorization of Defendant and it is therefore denied that PlnintilT cleaned the personal property
graluitously for the benelit of Defendnnt"s tenants.

stmcture would not be covercd by Detcndnnt's insurance policy and alcrted Defendant to this fact
when Defendant lirst contacted Plninlil1's on Novcmber IS. 1994.
23. Denied. It is denied thnt l'lnintilrhlls heen paid for all scrvices authorized by the
Defendant. By wny of further response. Delcndllntlluthorized PlaintilTto perform both stmctural

WHEREFORE, Defendant requests that this Court find in favor of Defendant and against
Plaintiff.
NEW MATTER
12. Defendant is the owner of real property, and the residential structure thereon, located
on Penn Street in Shippensburg, Cumberland County, Pennsylvania. This residential structure, which
was a rental unit, had incurred smoke and soot damage as a result of a clogged chimney.
13. Subsequent to the clogged chimney, Defendant sought assistance in restoring his
rental structure property from his insurance company, State Farm Insurance Company.
14. State Farm Insurance Company directed him to Plaintiff, Servpro West Shore, Inc.
(hereinafter "Servpro"), which is in the business of fire/smoke restoration.
15. At all times relevant hereto, Plaintiff was in communication with Defendant's
insurance company and was aware of what services would be covered by the insurance policy
afforded by State Fann Insurance Company.
16. Plaintiff advised Defendant that the cost for its services would be covered by the
policy issued by State Fann Insurance Company, except for the $250.00 deductible. Plaintiff
required the $250.00 deductible to be paid prior to starting its service.
17. Plaintiff advised Defendant that Plaintiff requires payment in advance on all services
which are not covered by insurance.
18. Plaintiff further advised Defendant that the only cost which would not be covered by
insurance was the $250.00 deductible.
19. In reliance on that advise and with that understanding, Defendant authorized Plaintiff
to perfonn the structural restoration service covered by said insurance.
20. Defendant never authorized Plaintiff to conduct content cleaning of the personal
property of tenants located at the rental unit.
20. Defendant received no benefit from Plaintiff's services with regard to cleaning the
contents of the property, which were not owned by Defendant, but by the tenants.

21. Plaintiffs cleaning of the tenant's contents in the property was done gratuitously for
the benefit of the tenants.
22. PlaintitTknew or should have known that the cleaning of the contents of the structure
would not be covered by the insurance policy.
23. PlaintitT has been paid for the services which Defendant authorized it to perform.
WHEREFORE, Defendant requests that this Court find in favor of Defendant and against
PlaintitT.
