Plaintiff is Walkers General Contractors, Inc. (hereinafter Walkers), a corporation organized and existing under the laws of the Commonwealth of Pennsylvania with offices located at 15 Conifer Lane, Mechanicsburg, Cumberland County, Pennsylvania 17055. 2. Defendant Taco Bell Corporation (hereinafter "Taco Bell"), is a corporation organized and existing under the laws of the state of California with offices located at 11 Eves Drive, Suite 170, Marlton, New Jersey 08053. 3. Defendant Construction Contractors Management, Inc. of New Jersey (hereinafter "CCM"), is a corporation organized and existing under the laws of the state of New Jersey with offices located at 144 Goltra Drive, Basking Ridge, New Jersey 07920. 4. On or about June 2, 1993, Plaintiff Walkers and Defendant CCM executed a written contract for the construction of concrete curbing at Defendant Taco Bell's project #217 in York, Pennsylvania. A true and correct copy of the contract between Plaintiff Walkers and Defendant CCM is attached hereto as Exhibit "A" and incorporated herein by reference. 5. Defendant CCM acted as general contractor for Defendant Taco Bellon the project which is the subject of the contract between the parties. 6. On or about June lS, 1993, Plaintiff sUbstantially completed performance under the contract. 7. During the week of July 12, 1993, Plaintiff received a telephone call from a representative of Defendant CCM advising Plaintiff that another contractor had hit and damaged some of the curbing and that a small portion of curbing was unsatisfactory. S. Pursuant to Defendant CCM's request, plaintiff repoured the damaged portion of the curbing on or about July 12 and 13, 1993. 9. On or about July 19, 1993, Plaintiff received a telegram from CCM advising Plaintiff that it had forty-eight (4S) hours to correct the portion of curbing that ~ad been marked as unsatisfactory by Defendants. 10. On or about July 23, 1993, plaintiff complied with Defendant CCM's request and replaced the curbing marked unsatisfactory by Defendants, and all work required by the contract was completed. 11. The terms of the contract provided that nineteen thousand five hundred dollars ($19,500.00) was to be paid to Plaintiff upon the completion of its duties under the contract. 12. The Plaintiff received payment under the contract in the amount of fourteen thousand three hundred dollars ($14,300.00). . . , , :1\ 13. To date, Oefendant CCM has failed to pay the balance of five thousand two hundred dollars ($5,200.00) due and owing under the contract. 14. On or about September 13, 1993, Plaintiff notified Defendant CCM by certified mail and demanded the payment of the balance due and owing under the contract. 15. Oespite Plaintiff's repeated demands made to CCM and Taco Bell for payment, CCM and Taco Bell have refused and failed to pay the balance due and owing under the contract. 16. The total amount in controversy in this action does not exceed Twenty-Five Thousand Dollars ($25,000.00), therefore, this case shall be submitted for compulsory arbitration. WHEREFORE, it is respectfully requested that Your Honorable Court find for Plaintiff, Walkers General contractors, Inc., and against Defendants, and enter judgment in favor of Plaintiff in the amount of $5,200.00 together with costs and expenses as allowed by law, and grant such other relief as the Court deems just and proper. CCM executed a written contract for the construction of concrete Pennsylvania. curbing at Defendant Taco Bell's project #217 in York, A true and correct copy of the contract between Plaintiff Walkers and Defendant CCM is attached hereto as Exhibit "A" and incorporated herein by reference. ,. 5. Defendant CCM acted as general contractor for Defendant Taco Bell on the project which is the subject of the contract between the parties. 6. On or about June 18, 1993, Plaintiff SUbstantially completed performance under the contract. 7. During the week of July 12, 1993, Plaintiff received a telephone call from a representative of Defendant CCM advising Plaintiff that another contractor had hit and damaged some of the curbing and that a small portion of curbing was unsatisfactory. 8. Pursuant to Defendant CCM's request, Plaintiff repoured the damaged portion of the curbing on or about July 12 and 13, 1993. 9. On or about July 19, 1993, Plaintiff received a telegram from CCM advising Plaintiff that it had forty-eight (48) hours to correct the portion of curbing that had been marked as unsatisfactory by Defendants. 10. On or about July 23, 1993, Plaintiff complied with Defendant CCM's request and replaced the curbing marked unsatisfactory by Defendants, and all work required by the contract was completed. 11. The terms of the contract provided that nineteen thousand five hundred dollars ($19,500.00) was to be paid to Plaintiff upon the completion of its duties under the contract. 12. The Plaintiff received payment under the contract in the amount of fourteen thousand three hundred dollars ($14,300.00). 13. To date, Defendant CCM has failed to pay the balance of five thousand two hundred dollars ($5,200.00) due and owing under the contract. 14. On or about September 13, 1993, plaintiff notified Defendant CCM by certified mail and demanded the payment of the balance due and owing under the contract. 15. Despite Plaintiff's repeated demands made to CCM and Taco Bell for payment, CCM and Taco Bell have refused and failed to pay the balance due and owing under the contract. 16. The total amount in controversy in this action does not exceed Twenty-Five Thousand Dollars ($25,000.00), therefore, this case shall be submitted for compulsory arbitration.
