Bar-Mar Leasing, Inc., Plaintiff, by Its allomeys, Donald L, Komfiald, Esquire, and Harry
L. McNeal, Jr., Esquire, brings this Complaint In Equily against Defendant, Cumberland-Franklin
Joint Municipal Authority, whereof the following is a ststemen\.
1. Plaintiff, Bar-Mar Leasing, Inc, ['Bar-Mar), Is a Pennsylvania corporation, with its
principal office at 77 Piney Gulch Drive, Waynesboro, PA 17268.
2, Defendant, Cumberland-Franklin Joint Municipal Authority ['Authority'), Is a
municipality authority, organized and existing under the Pennsylvania Municipality Authorities Act,
with Its principal office at 725 Municipal Drive, Shlppensburg, Cumberland County, PA 17257.
3. Bar-Mar Is the owner of a tract of land situate in Southhampton Township, Franklin
County, Pennsylvania, on the southeast ('orner of U.S. Route 11 [also known as the Moliy Pitcher
Highway) and Park Heights Avenue [also known as T-647).

A.
Authority owns and operates a sanitary sewer system for rendering sewage
service In and for certain portions of the Borough of Orrstown and the Township of Southampton,
both situated in Franklin County, Pennsylvania, and the Township of Shippensburg and the

Township of Southampton, both situated in Cumberlard County, Pennsylvania.
B. Sewage collected from properties served by the Authority's sanitary sewer
system is transported to and treated at lhe sewage treatment plant owned and operated by the
Borough of Shippensburg ['Shippensburg'), which is located in Cumberland County.
C. A sewer main that Is part of Authority's system lies within a portion of the
right.of.way of U,S. Route 11, which abulls Bar-Mar's property, no more than three feet [3') feet
from Bar-Mar's property line.
5. On December 19, 1990, Act 203 of 1990. P.L. 1227. was enacted, whereby
Clause (1) of subsection B of section 4 of the Pennsylvania Municipality Authorities Act of 1945,
53 P,S. 306(8)(t), was amended so as to authorize every Authority 10 charge a fee, composed
of a Connection Fee, a Customer Facilities Fee and a Tapping Fee, to property owners who
desire to or are required to connect to the authority's sewer system.
6. On November 14, 1991, Authority adopted Resolution No. 91-1. whereby it
imposed lhe following fees, pursuant to the authorization of Act 203, to wit, a Tapping Fee in the
amounl of $550 upon each unit connected directly or indirectly to its sewer system. a Connection
Fee in the amount of $150 for each connection by a domestic dwelling, non-domestic
establishment and mobile home park which shall be connected directly or indireclly to the sewer
system, and a Customer Facilities Fee for each building sewer connection to its sewer system
in the amount of $25.00 per unit connected, A copy of said resolution is allached hereto and
marked 'EXHIBIT A',

7. By letter to Shlppensburg, dated September 2, 1994, the Pennsylvania Department
of Environmental Resources rDER'] Imposed a ban on new connecllons to the sewer system
tributary to Shlppensburg's treatment plant, which Includes Authority's sewer system, because
Shlppensburg's 1993 Wasteload Management Annual Report to DER indicated that
Shlppensburg's treatment plant was hydraulically overloaded, A copy of said letter Is attached
hereto and marked' EXHIBIT B'.
8. On December 9, 1994, Authority adopted ResolutIon 94-3 entilled:
"A RESOLUTION OF CUMBERLAND-FRANKLIN JOINT
MUNICIPAL AUTHORITY SETTING THE POLICY FOR THE
APPLICATION AND PERMITTING OF SEWER CONNECTIONS
BY OWNERS AND/OR DEVELOPERS",
a copy of which Is attached hereto and marked 'EXHIBIT C, which provided, Inter alia, that an
application for a sewer connection must be accompanied by a fee of $750.00, and that a permit
shall expire six (6) months oller Issuance, with one three (3) month extension to be granted on
the payment of a fee of $250.00,
9. By letter to Shippensburg, dated December 14, 1994, DER modified the ban on
connections to the sewer system tributary to Shlppensburg's treatment plant, which includes
Authority's sewer system, so as to allow 60 new connections immediately and an additional 5
connections per month through March of 1995, and indicated it was considering whether any
addillonal connecllons are warranted. DER also authorized Shippensburg to allocate the
connecllons between Itself and the Authority. A copy of said letter Is attached hereto and
marked 'EXHIBIT D'.

A.
On January 13, 1995, the Authority adopted the following resolullons:
i. Resolution 95.01, a copy of which Is attached hereto and marked
'EXHIBIT E', which was Identical to Resolution 94-3, Including the six [6] month life span and

the three (3) month extension of permits, except that the fee that must accompany an application
to connect to the sewer system was Increased from $750.00 to $1,200.00; and
II. Resolution 95.02, a copy of which Is attached hereto and marked
'EXHIBIT F', which amended Resolution No, 91.1 by Increasing the $550.00 Tapping Fee
Imposed thereby 10 $1,000.00.
B. Alter the adoption of Resolution 95.02, the 10tal amount of the fees
Imposed on the connection of a property to the sewer system by Resolution 91.1, as amended
by Resolution No. 95.02, was In the amount of 51,200.00 and equal to lhose set forth In the
Policy established by Resolution 95.01.
11. On January 24, 1995, Bar.Mar, while protesting the limited life span of the permits,
paid connection fees referred to in Paragraph 10, above, in the total amount of $6,000 and was
issued 5 permits to connect 5 units on its property located at the southeast corner of Route 11
and Park Heighls Avenue to the Authority's sewer system.
12. By letter dated March 24, 1995, DER approved 25 connections per monlh to the
sewer system tributary to Shippensburg's traatment plant, which includes the Authority's sewer
system, through March of 1996, A copy of said letter is attached hereto and marked 'EXHIBIT

13. A. Pursuanl to DER's letters of December 14, 1994 and March 24, 1995,
referred to in Paragraphs 8 and 12, above, a total of 300 connections to sewer systems lributary
to Shlppensburg's treatment plant, which includes Authority's sewer system, have been authorized
by DER through the end ofthe calendar year 1995,
B. i. Shippensburg has allocated to Authority 150 of the 300 connectiDns
DER has authorized through the end of 1995.

II. Through July 12, 1995, Authority has issued permits for only fifteen
[15] of the one hundred fifty [150] connections allocated to it through the end of 1995, five [5] of
which were those paid for by Bar.Mar and referred to in Paragraph 11, above.
14. On or about June 22, 1995, Bar.Mar received a notice from Authority advising, Inter
alia, that the sewer permits purchased January 24, 1995, will be expiring July 24, 1995, that a
three month extension will be granted for a fee of $250.00 per permit, and that if the extension
Is not applied for the permits and the permit fees will be forfeited. A copy of said notice Is
attached hereto and marked 'EXHIBIT H'.
15. Bar-Mar has expended substantial sums In the process of developing its property
pursuant to a land development plan approved by Southampton Township In October of 1993 and
has been negotiating with potential tenants
16. The forfeiture of Bar.Mal's ability to connect its property to the sewer system would
make it Impossible for Bar.Mar to continue lhe development of its property and the negotiation
of leases with potential tenants and, thus, cause Bar-Mar Irreparable Injury for which there Is not
an adequate remedy at law.
COUNT 1
17. The allegations of Paragraphs 1 through 16 are Incorporated herein by
reference.
18. The Authority's lhreat to forfeit Bar-Mal's five [5] permits to connect to the sewer
system and the fees it paid for the permits, if an additional fee of $250 per permit for the one [1]
permissible three [3] month extension is not paid,ls arbitrary, an abuse of discretion and contrary

to law, and thus a denial of due process of law, for the following reasons:
A. Although the Authority has sought to justify the limitation of the life span of
the permits on the grounds of a shortage of connection permits, the supply of permits far exceeds
the demand;
B. It fails to allow a property owner reasonable time 10 plan for a complete
development dependent on public sewage;
C, The forfeiture of a permit to connect a property to a sewer system, that was
issued upon the payment of a fee imposed on lhe connection of a property to the sewer system,
is repugnant to and an impermissible feature of the regimen of such a fee.
WHEREFORE, Bar-Mar prays that Your Honorable Court:
A. Temporarily enjoin Authority from forfeiting its connection permits; and
B. Permanently enjoin Authority from forfeiting its connection permits; and
C. Grant such other relief as it deems appropriate,

19. The allegalions of Paragraphs 1 through 18 are incorporaled herein by
reference.
20. Bar-Mar's payment of the fees that Authority has imposed on the conneclion of a
property to ils sewer system has created a vested rig hI and property interest in Bar-Mar to
connect its property to Authority's sewer system.
21. The forfeiture of Bar.Ma~s permits to connect Its property to Authority's sewer
system would be arbitrary. an abuse of discretion and contrary to law, and thus a deprivation

of Bar.Mar's vesled right and property interest to connect its property to Authority's sewer system,
without due process of law and a compensable taking,
WHEREFORE, Bar.Mar prays that Your Honorable Court:
A, Temporarily enjoin Authority from forfeiting Its connection permits; and
B. Permanently enjoin Authority from forfeiting its connection permits; and
C. Direct that Authority pay unto Bar.Mar such damages as it determines Bar.
Mar has suffered as a result of the forfeiture of its vested right and property
Interest in the connection of its property 10 Authority's sewer system,
Including any damages for a temporary taking suffered between the time
of any forfeiture and the invalidation of the forfeiture; and
D. Grant such other relief as It deems appropriate.

22. The allegations of Paragraphs 1 through 21 are Incorporated herein by
reference.
23. Bar-Mar's payment of the fees that the Authority Imposed on the connection of its
property to the Authority's sewer system entitles Bar.Mar to all of the benefits flowing from
connection, Including all demonstrable profits of its development.
24. The forfeiture of Bar.Mar's permits to connect its property to Authority's sewer
system would be arbitrary, an abuse of discretion and contrary to law, and thus a deprivation of
Bar.Mar's benefits flowing from connection to the sewer system, including demonslrable profits
of its development, without due process of law and, thus, a compensable taking.
WHEREFORE, Bar-Mar prays that Your Honorable Court:

RESOLUTION 82 C, IMPOSING A TAPPING FEE AND
CONNECTING FEE AGAINST THE OWNER OF AN
IMPROVED PROPERTY PROPOSED TO DISCHARGE
SEWAOE INTO THE SEWER SYSTEM BY A SINGLE UNIT
DOMESTIC DWELLiNG, MULTIPLE uNIT DOMESTIC
DWELLING, NON.DOMESTIC ESTABLISHMENT AND EACH
SITE IN A MOBILE HOME PARK CONNECTING DIRECTLY
OR INDIRECTLY TO THE CUMBERLAND-FRANKLIN JOINT
MUNICIPAL AtITHORlTY SEWER SYSTEM, AND IMPOSING
A CUSTOMER FACILITIES FEE, ALL AS PROVIDED FOR IN
ACT 203 OF 1990,
WHEREAS, THIS AUTHORITY, pursuant to Authority vested in it by law, does
own and operate a sanitary sewer system for rendering sewage service In and for certain
portions of the Borough oC Orrstown and the Township of Southhampton, both situated in
Franklin County, Pennsylvania, and the Township of Shlppensburg and the Township of
Southhampton both situated In Cumberland County, Pennsylvania and
WHEREAS, THIS AUTHORITY has power and authority to impose Tapping
Fees, Connecllon Fees and Customer Facllilles Fees Cor the use of the Sewer System as
provided in the Pennsytvanla Munlclpat Authorities Act of 1945 approved May 2, 1945,
P.L. 382, as amended by Act 203 of 1990,53 P.S, 306B ("The Act")j
NOW, THEREFORE BE IT RESOLVED, by the Board of this Authority that
resolution 82 C Is amended as follows:
SECTION I. Unless the context specifies and clearly indicated otherwise, the
meaning of Items and phrases pertaining to this Resolution shall be as Collows:
EXHIBIT II
A. SINGLE UNIT DOMESTIC DWELLING shall be construed to meail any
building intended to provide living quarters for not more than one single
family unit.
B. MULTIPLE UNIT DOMESTIC DWELLING shall be construed tumean nny
building or gronp of buildings intended to provide living quartcrs for two ur
more single family units,
C. NON-DOMESTIC ESTABLISHMENT shall be construed to mean any hotel,
motel, condominium, boarding house, cooperative or association housing,
apartment, rental unit, office building, barber shop or beauty shop attached to
or forming part of the owners residence, st.1l1market or shopping center (per
individual retail store) containing sanitary sewage facilities.
D. MOBILE HOME PARK shall be construed to mean two or more contiguous
lots, tracts or parcels of land intended for mobile home placement. Each
mobile home site shall be construed to constitute one E.D.U.
E. EQUIVALENT DOMESTIC UNIT (E.D.H.) shall he construed to menn a
sewerage now of 265 gallons per day, with an average strength of 200
milligrams per liter B. O. D. and suspended solids, or equivalent.
F. All other definitions of terms not herein above defined shall be as set forth in a
Resolution (No. 78-2) duly adopted by the Board of this Authority on the 26th
day of October, 1978.
SECTION II. TAPPING FEE. This Authority docs hereby impose a tapping fee
upon every single unit domestic dwelling, each individual unit of a multiple unit domestic
dwelling, each individual unit or site within a mobile home park and e.1ch non-domestic
establishment or building connected, directly or indirectly to the Authorlty's sewer system
or any privately owned lines connccted to the Authority's system, such fee being authorized
under Section 4 B(I) of the Act.
A. The tapping fee is payable prior to connection to the Authority's sewer system.

shall bc Five Hundred Fifty Dollars ($550.00); cltcept In the case of non.
domestic c~tabllshments, which fees shall bc eomp\lted as provided In "CO

multiplying $550 by Ihc cstirnated EDU's. Thc cstlmated EOU's for lhc
establishment shall be computed by dividing thc estimated daily flow by 265.
This result shall be calculated to the nearest one-tenth of an EOU and shall be
a minimum of onc EOU. This estimated tapping fee shall be adjusted by using
the actual average daily flow based on the water meter readings from the first
year of full production, usage and/or occupation.
SECTION III. CONNECTION FEE . A connection fec Is hereby impmed and shall
be collected by the Authority for e.1ch connection by a single unit domeslic dwelling,
multiple unit domestic dwelling, non-domestic establishment, and mobilc homc park, which
physically shall connect to the Authority's sewer systcm, whether such connection shall be
direct or Indireet, such fee being authorized under Section 4 B(l) of thc Act.
A. nlc connection fee shall be due and payable at the time application is madc to
the Authority to connect the sewer syslem by the owner of the improved
property. No sewer permit will be issued until the applicable connection
charge and prevailing tapping fee are paid to thc Authority.
B, The payment of the connection fee shall in no way be con~trued to eltclI1pt thc
applicability or payment of the prevailing Tapping Fec or Cu~toll1er Facilitics
Fee.
C. nlc all10unt of the connection fcc shall be One Hundred Seventy-fivc Dollars
($175.00) per connection of singlc \lnit domcstic dwclling, multi pic unit
domestic dwelling, non-domestic establishmcnt, and mobile home park to the
Authority's sewer syslcm, whether directly or indirectly.
D, The connection fee shall apply to all conncctions, whether direct or indircct, to
the sewer system through lines now ownrd hy the Authority or line~ uow
privately owned but Intended to be formally dedicated to the Authority and/or
lines that are to rcmain privately owned.
SECTION IV. ruSTOMER FACILITIES rEE . A Customcr racllitlc~ Fec 10
cover the cost of Inspection of each building sewer conncction is hereby imposed on every
single unit domestic dwelling, multiple unit domestic dwelling, each unit or site connected
within a mobile home park, and e,1ch non-domestic establlshmcnt. The fee shall be
Imposed for each building sewer connection to the Authority's sewer system through any
service line or main line, whether owned by the Authority or privately.
A. The fee Is payable prior to connection to the Authority's sewer system.
B. The amount of the Customer Facilities Fee is Twenty-live Dollars ($25.00) per
unit connected.
SECTION V. All fecs Imposed by this Resolution are imposed against the owners
of improved property connected directly or indirectly to the Authority's sewer system, or to
any privately owned lines connected to the Authority's systems.
SECTION VI. REIMBURSEMENT . Whcre a Properly Owncr constructs, or
causes to be constructed, at his or hcr expense any exlension of the sewer system of the
Authority, the Authority shall provide for the reimbursemcntto the Properly Owner when
the owner of another properly not in the development for which the extension was
constructed, connects a service line directly 10 the extension within tcn (10) years of the
date of the dedieation of such extension to the Authority.
Such reimbursemcnt shall be equal to the Collection Part of e,1ch Tapping Fre
collected as a result of subsequent connections, less an amount cqnalto live percent which
shall be deemed to represent the appropriate charge for admini~tmtlve expenses and
services rendered in calculating, eollrction, monitoring and disbursing the reimbursement
payments to the Property Owner entitled thcreto.
The Authority shall notify by Certified mall, to their last known address, the
Property Owner or Owners for whose benefit such reimbursement shall apply within thirty
(30) days of the Authority's receipt of any such reimbursement payment. In the event that
the Property Owner or Owners have not claimed a reimbursement payment within one
hundred twenty (120) days of the mailing of the notice, the payment shall revert to and
become the sole property of the Authority with no further obligation on the part of the
Authority to refund the payment to the property Owner or Owners.
SECTION VIr, This Resolution shall become effective Immediately.
SECTION VIII. In the event any provision, section, sentence, clause or part of this
Resolution shall be held to be Invalid, such invalidity shall not affect or impair any
remaining provision, section, sentence, clause or part of this Resolution, it being the intcnt
of this Authority that such remainder shall be and shall remain in full force and effect.
SECfION IX. TIlls Authority shall have the right of access at re.1sonable timcs to
any part of any Improved Property which shall be served by the sewer system as shall be
required for purposes of inspection, me.1suremcnt, sampling and testing and for
performance of other funclions relating to service rendered by this Authority through Ihe
sewer system.
SECTION X. This Authority reserves the right to adopt, from time to time, as
authorized by law, such additional rates and charges, classifications, rulcs and/or
regulations as It shall deem necessary and proper in connection with use and operation of
the sewer system, which additional rates and charges, classifications, rules and/or
regulations, shall become and shall be construed as part of this Resolution.

SECTION XI. All resolutions or parts of resolutions of thIs Authority whIch shall
be Inconsistent with this Resolution shall be and the s.1lne expressly are repc.1led.

SETTING THE POLICY FOR THE APPLICATION AND PERMITTING OF SEWER
CONNECTIONS BY OWNERS AND/OR DEVELOPERS
The Board of cumberland-Franklin Joint Municipal Authority
does hereby enact and resolve as follows:

1. An owner or developer shall make application for a
sewer connection permit at the office of the Cumber1and-
Franklin Joint Municipal Authority, hereinafter referred to as
"CFJMA", on a form provided by CFJMA. A fee of $ -; f,,?, ,,'

c. To ensure the proper applicant, a copy of the deed of
ownership must accompany each permit application.

L. McNeal, Jr., Esquire, brings this Complain I In Eqully agalnsl Defendant, Cumberland-FrBnklin
Joint Municipal Authority, whereof the following Is a stalement.
1. Plaintiff, Bar-Mar Leasing, Inc. ['Bar-Mar'], Is a Pennsylvania corporallon, wilh its
principal ollice al 77 Piney Gulch Drive, Waynesboro, PA 1726B,
2. Defendant, Cumberland-Franklin Joint Municipal AUlhorlty ['Aulhority'], Is a
municlpalily authorily, organized and existing under the Pennsylvania Municipality Aulhorities Act,
with lis principal ollice at 725 Municipal Drive, Shlppensburg, Cumberland County, PA 17257.

3. Bar-Mar is the owner of a tract of land situate In Southhamplon Township, Franklin
County, Pennsylvania, on the southeasl corner of U.S. Route 11 [also known as the Molly Pilcher
Highway] and Park Heights Avenue [aiso known as T-647].

A.
Authority owns and operales a sanilary sewer syslem for rendering sewage
service In and for certain portions of Ihe Borough of Orrstown and the Township of Southampton,
both situated in Franklin County, Pennsylvania, and the Township of Shlppensburg and the

Township of Southampton, both situated In Cumberland County. Pennsylvania.
B. Sewage collected from properties served by the Authority's sanllBry sewer
system Is transported to and trealed at the sewage treatment plant owned and operated by the
Borough of Shlppensburg ['ShlppElnsburg'], which Is located In Cumberland County.
C. A sewer main that Is part of Authority's system lies within a portion of the
right-of-way of U.S. Route 11, which abulls Bar-Mar's property. no more than three feet [3') feet
from Bar-Mar's property line.
5. On December 19. 1990, Act 203 of 1990, P.L. 1227, was enacted, whereby
Clause (t) of subsection B of section 4 of the Pennsylvania Municipality Authorities Act of 1945.
53 P.S. 306(B)(t), was amended~o as to authorize every Authority to charge a fee. composed
of a Connection Fee, a Customer Facilities Fee and a Tapping Fee. to property owners who
desire to or are required to connect to the authority's sewer system.
6. On November 14, 1991, Authority adopted ResolutIon No. 91.1, whereby it
imposed the following fees. pursuant to the authorization of Act 203. to wit. a Tapping Fee in the
amount of $550 upon each unit connected directiy or Indirectly to its sewer system. a Connection
Fee in the amount of $150 for each connection by a domestic dwelling, non-domestic
establishment and mobilehome park which shall !le connected directly or Indirectiy to the sewer
system, and a Customer Facilities Fee for each building sewer connection to its sewer system
In the amount of $25.00 per unit connected. A copy of said resolution is allached hereto and
marked 'EXHIBIT A',

7. By lelter to Shlppensburg, dated September 2, 1994, the Pennsylvania Department
of Environmental Resources ['DER') Imposed a ban on new connections to tho sewer system
tributary to Shlppensburg's treatment plant, which includes Authority's sewer system, because
Shlppensburg's 1993 Wasteload Management Annual Report to DER Indicated that
Shlppensburg's treatment plant was hydraulically overloaded. A copy of said lelter is altached
hereto and marked' EXHIBIT B',
8. On December 9, 1994, Authority adopted Resolution 94.3 entitled:
"A RESOLUTION OF CUMBERLAND.FRANKLIN JOINT
MUNICIPAL AUTHORITY SETTING THE POLICY FOR THE
APPLICATION AND PERMITTING OF SEWER CONNECTIONS
BY OWNERS AND/OR DEVELOPERS",
a copy of which is allached hereto and marked 'EXHIBIT C, which provided, inter alia, that an
application for a sewer connection must be accompanied by a fee of $750,00, and that a permit
shall expire six (6) months after issuance, with one three (3) month extension to be granted on
the payment of a fee of $250.00.
9. By lelter to Shippensburg, dated December 14, 1994, DER modified the ban on
connections to the sewer system tributary to Shlppensburg's treatment plant, which includes
Authority's sewer system. so as to allow 60 new connections immediately and an additional 5
connections per month through March of 1995, and indicated it was considering whether any
additional connections are warranted. DER also authorized Shlppensburg to allocate the
connections betwaen Itself and the Authority, A copy of said lelter is allached hereto and
marked 'EXHIBIT 0'.

On January 13, 1995, the Authority adopted the following resolutions:
i. Resolution 95-01, a copy of which Is altached hereto and marked
'EXHIBIT E'. which was Identical to Resolution 94.3, Including the six (6) month life span and

the three (3) month extension 01 permits, except that the lee that must accompany an application
to connect to the sewer system was Increased Irom $750.00 to $1,200.00; and
II. Resolution 95.02, a copy 01 which Is aUached hereto and marked
'EXHIBIT F', which amended Resolution No. 91.1 by increasing the $550.00 Tapping Fee
Imposed thereby to $1,000.00.
B. Aller the adoption 01 Resolution 95.02, the total amount of the lees
imposed on the connecllon of a property to the sewer system by Resolution 91.1, as amended
by Resolution No. 95.02, was in the amount 01 $1,200.00 and equal to those set forth In lhe
Policy established by Resolution 95.01.
11. On January 24, 1995, Bar.Mar, while protesling the limited life span 01 the permits,
paid connection fees relerred to In Paragraph 10, above, In the total amount 01 $6,000 and was
Issued 5 permits to connect 5 units on its property located at the southeast comer 01 Route 11
and Park Heights Avenue to the Authority's sewer system.
12. By leUer dated March 24, 1995, DER approved 25 connections per month to the
sewer system tributary to Shippensburg's treatment plant, which Includes the Authority's sewer
system, through March 011996. A copy of said leUer Is aUached hereto and marked 'EXHIBIT
G'.
13. A, Pursuant to DER's leUers 01 December 14, 1994 and March 24, 1995,
relerred to in Paragraphs 8 and 12, above, a total of 300 connections to sewer systems tributary
to Shippensburg's treatment plant, which includes Authority's sewer system, have been authorized
by DER through the end oflhe calendar year 1995,
B. I. Shippensburg has allocated to Authority 150 01 the 300 connections
DER has authorized through the end 011995.

II. Through July 12, 1995, Authority has Issued permits for only fifteen
[15] ofthe one hundred fifty [150] connections allocated to It through the end of 1995, five [5] of
which were those paid for by Bar-Mar Bnd referred to In Paragraph 11, above.
14. On or about June 22, 1995. Bar-Mar received a notice from Authority advising, Inter
alia, that the sewer permits purchased January 24, 1995. will be expiring July 24, 1995, that a
three month extension will be granted for a fee of $250.00 per permit, and that if the extension
Is not applied for the permits and the permit fees will be forfeited. A copy of said n01lce Is
aUached hereto and marked 'EXHIBIT H'.
15. Bar-Mar has expended substan1lal sums In the process of developing Its property
pursuant to a land development plan approved by Southampton Township In October of 1993 and
has been neg01la1lng with poten1laltenants
16. The forfeiture of Bar-Mar's ability to connect Its property to the sewer system would
make it Impossible for Bar-Mar to continue the development of Its property and the negotiation
of leases with potential tenants and, thus, cause Bar-Mar irreparable Injury for which there is not
an adequate remedy at law.

17. The allegations of Paragraphs 1 through 16 are incorporBted herein by
reference.
18. The Authority's threat to forfeit Bar-Mar's five [5] permits to conneclto the sewer
system and the fees it paid for the permits. if an addi1l0nal fee of $250 per permit for the one [1]
permissible three [3] month extension is not paid, Is arbitrary, an abuse of discretion and contrary

to law, and thus a denial or due process or law, ror the rollowlng reasons:
A. Although the Authority hBS sought to justlly the limitation or the lire span or
the permits on the grounds or a shortage or connecllon permits, the supply or permits rar exceeds
the demand;
B. 11 rails to allow a property owner reasonable lime to plan ror a complete
development dependent on public sewage;
C. The rorfelture or a permit to connect a property to a sewer system, that was
Issued upon the payment or a fee Imposed on the connection or a property to the sewer system,
Is repugnant to and an impermissible reature or the regimen of such a fee.
WHEREFORE, Bar-Mar prays that Your Honorable Court:
A. Temporarily enjoin Authority from forfeiting Its connection permits; and
B. Permanenlly enjoin Authority from fOrfeiting its connecllon permits; and
C. Grant such other relier as It deems appropriate.

19. The allegallons of Paragraphs 1 through 18 are Incorporated herein by
reference.
20. Bar-Mar's payment of the fees that Authority has Imposed on the connection of a
property to its sewer system has created a vested right and property interest in Bar-Mar to
connect Its property to Authority's sewer system.
21. The forfeiture of Bar-Mar's permits to connect Its property to Authority's sewer
system would be arbitrary, an abuse of dlscrellon and contrary to law, and thus a deprivation

of Bar.Mar's vested right and property interest to connect 115 properly to Authority's sewer system,
without due process of law Bnd a compensable laking.
WHEREFORE, Bar-Mar prays that Your Honorable Court:
A. Temporarily enjoin Authorlly Irom lorfeltlng 115 connection permits; and
B. Permanently enjoin Authority Irom forfeiting its connection permits; and
C. Direct that Authority pay unto Bar-Mar such damages as it determines Bar-
Mar has surrered as a resull 01 the lorfeiture of Its vesled right and properly
Interest in the connection of its property to Authority's sewer system.
Including any damages for a temporary taking suffered between the time
01 any forfellure and the invalidation 01 the forfeiture; and
D. Grant such other relief as it deems appropriate.

22. The allegations of Paragraphs 1 through 21 are incorporated herein by
reference.
23. Bar-Mar's payment of the fees that the Authority Imposed on the connection of 115
property to the Authority's sewer system entllles Bar-Mar to all of the benafits flowing from
connection, including all demonstrable profits of its development.
24. The forfeiture 01 Bar-Mar's permits to connect lis properly to Authority's sewer
system would be arbitrary, an abuse of discretion and contrary to law, and thus a deprivation of
Bar-Mar's benelils flowing Irom connection to the sewer system, Including demonstrable profits
of its development, without due process of law and, thus, a compensable taking.
WHEREFORE, Bar-Mar prays that Your Honorable Courl:

WHEREAS, THIS AUTHORITY has power and authority to Impose Tapping
Fees; Connection Fees and Customer Facilities Fees for the use of the Sewet System as
provided In the Pennsytvanla Municipal Authorities Act of 1945 approved May 2. 1945,
P,L. 3821 as amended by Ad 203 of 1990,53 P.S. 306B ("The Act")j
NOW; THEREFORE BE IT RESOLVED, by the Board of this Authority that
resolution 82 C Is amended as Collows:
SECTION I. Unless the context speclnes and clearly Indicated otherWise, lhe
meaning of items and phrases pertaining to this Resolution shall be as follows:
EXlII13IT 1\
A. SINGLE UNIT DOMESTIC DWELLING shall be construed to meail any
building Intended to provide living quarters for not more than one single
family unit,
B, MULTIPLE UNIT DOMESTIC DWELLING shall be construed to mcml any
building or group of buildings intended to provide living quarters for two or
more single family units.
C. NON-DOMESTIC ESTABLISHMENT shall be construed to mean any hotel,
motel, condominium, boarding house, cooperative or association housing,
apartment, rental unit, office building, barber shop or beauty shop attached to
or forming part of the owners residence, stall market or shopping center (per
individual retail store) containing sanitary sewage facililies.
D, MODlLE HOME PARK shall be construed to meml two or more contiguous
lots, tracts or parcels of land Intended for mobile home placcment. E.1ch
n.lobile home site shall be construed to constitute one E.D.U.
E. EQUIVALENT DOMESTIC UNIT (E.D.U.) shall be construed to mean a
sewerage now of 265 gallons per day, with an average strength of 200
mllligrams per liter B.O.D. and suspended solids, or equivalent.
F. All other definitions of terms not herein above defined shall be as set forth in a
Resolution (No. 78-2) duly adopted by the Board of this Authority on the 26th
day of October, 1978.
SECTION II. TAPPING FEE. This Authority does hereby impose a tapping fee
upon every single unit domestic dwelling, each Individual unit of a multiple unit domestic
dwelling, each individual unit or site within a mobile home park and each non-domestic
establishment or building connected, direcliy or indirectly to the Authority's sewer system
or any privately owned lines connected to the Authority's system, such fee being authorized
under Scclion 4 B(t) of the Act.
A. The tapping fee is payable prior to connection to the Authority's sewer system.

B. The amount of the tapping fee for c.1ch unit connected to the sewer system
shall be Five Hundred Fifty Dollars ($550.00); except In the case of non.
domestic cSlabllshments, which fees shall be computed as provided in "CO
below.
C. The l.1JlJllng fees for non-domestic establishments shall be determined by
multiplying $550 by the estimated EDU's. The estlrnated EDU's for the
eslabllshment shall be computed by dividing the estimated daily flow by 265,
TIlls rcsult shall be calculated to the nearcst one-tenth of an EDU and shall be
a minimum of one EDU. This estimated tapping fee shall be adjusted by using
Ule actual average daily flow based on the water meter readings from the first
year of full production, Us.1ge and/or occupation.
SECfION III. CONNECfION FEE . A connection fee is hereby imposed and shall
be collected by the Authority for e.1ch connection by a single unit domestic dwelling,
multiple unit domestic dwelling, non-domestic establishment, and mobile home park, which
physically shall connect to the Authority's sewer system, whether such connection shall be
direct or Indirect, such fee being authorized under Section 4 B(t) of the Act,
A. The connection fee shall be due and payable at the time application is made to
the Authority 10 connect the sewer syslem by the owner of Ihe improved
property. No sewer permit will be issued unlilthe appllcable connection
charge and prevailing tapping fee arc paid to the Authority.
B. The payment of the connection fee shall in no way be constmed to excmJltthe
applicability or payment of the prevailing Tapping Fee or Customcr Facilities
Fee.
C, The amount of the conncction fec shall be One Hundred Scvcnty-five Dollars
($175.00) per connection of single unit domeslic dwelling, multiple unit
domcstic dwclling, non-domcstic establishmcnt, and mobile home park to the
Authority's scwcr systcm. whcthcr directly or indirectly.

D, The connection fee shall apply to all connections, whether direct or Indirect, to
the sewer system through lines now owned by the Authority or lines now
privately owned but intended to be formally dedicnted to the Authority and/or
lines that nre to remain privately owned.
SECfION IV. ~USTOMER FACILITIES FEE . A Customer Facilities Fee to
cover the cost of Inspection of each building sewer connection is hereby Imposed on every
single unit domestic dwelling, multiple unit domestic dwelling, ench unit or site connected
within a mobile home park, and each non-domeslle establishment. The fee shall be
Imposed for each building sewer connection to the Authority's sewer system through any
servlee line or main line, whether owned by the Authority or privately.
A, The fee Is payable prior to connection to the Authority's sewer system.
B, The amount of the Customer Facilities Fee Is Twenty-live Dollars ($25.00) per
unit connected,
SECTION V. All fees Imposed by this Resolution are imposed against the owners
of Improved property connected directly or indirectly to the Authority's sewer system, or to
any privately owned lines connected to the Authority's systems.
SECfION VI, REIMBURSEMENT , Where a Property Owner constructs, or
causes to be constructed, at his or her expense any extension of the sewer system of the
Authority, the Authority shall provide for the reimbursement to the Property Owner when
the owner of another property not In the development for which the extension was
constructed, connects a service line directly to the extension within ten (10) years of the
date of the dedication of such extension to the Authority.
Such reimbursemenl shall be equal to the Collection Part of e.1eh Tapping Fcc
collected as a result of subsequenl connections, less an amount equal to live percent which
shall be deemed to represent the appropriate charge for administrative expenses and
services rendered in calculating, collection, monitoring and disbursing the reltnbursemenl
payments to the Property Owner entitled thereto.
The Authorily shall nollfy by Cerllned mail, to their last known address, the
Property Owner or Owners for whose benent such relmbursemenl shall apply wilhln thirty
(30) days of Ihe Authority's receipt of any such reimbursement payment. In the eventlhat
the Property OWlier or Owners have not claimed a reimbursement payment within one
hundred twenty (120) days of the mailing of the notice, the payment shall revert to and
become the sole property of the Authority wllh no further obligation on the part of the
Authority to refund the payment to the properly Owner or Owners.
SECTION VII. This Resolulion shall become effeclive Immediately.
SECTION VIII. In the event any provision, seelion, sentence, clause or part of this
Resolution shall be held to be invalid, such Invalidity shall not affect or Impair any
remaining provision, section, sentence, clause or part of this Resolution, it being the inlent
of this Authority that such remainder shall be and shall remain In full force and effect.
SECTION IX. This Authorily shall have the right of access at rc.1sonable times 10
any part of any Improved Property which shall be served by Ihe sewer system as shall be
required for purposes of inspection, measurement, sampling and testing and for
performance of olher functions relating 10 service rendered by Ihis AUlhority through the
sewer system,
SECTION X. This Authority reserves the right to adopt, from time to time, as
aUlhorlzed by law, such additional rates and charges, c1asslncallons, rules and/or
regulations as It shall deem necessary and proper In connection with use and operation of
the sewer system, which additional rates and charges, c1asslncations, rules and/or
regulalions, shall become and shall be construed as pari of Ihls Resolulion.

SECfION XI. All resolutions or paris of resolutions of Ihls AUlhurlty which shall
be Inconsislent with Ihis Resolution shall be and the same expressly are repealed.

does hereby enact and resolve as follows:

1. An owner or developer shall make application for a
sewer connection permit at the office of the Cumberland-
Franklin Joint Municipal Authority, hereinafter referred to as
"CFJMA", on a form provided by CFJMJ\. A fee of $ 7 5' ,,7. .- i'

SECTION 1:
which read:
Whereas in Resolution No. 91-1, section II(B),
"B.
The amount of tapping fee for each until
connected to the sewer system shall be Five
Hundred Fifty Dollars ($550.00); except in the
case of non-domestic establishments, which fees
shall be computed as provided in "c" below."
shall be amended to read:
"B.
The amount of tapping fee for each until
connected to the sewer system shall be One
Thousand Dollars ($1,000.00); except in the case
of non-domestic establishment, which fees shall
be computed as provided in "c" below."
