COLDSHITH, (a/k/a COLDSMITH, III, of 137 Pine Tree Drlvc, Newville, PA, referred to as CONTRACTOK, r- ,> r'. , ROB~T J. hereinllfter ::L and - <..n ...., ROBERT J. COLDSHITH, a/k/a ROBERT J. COLDSHITH, III and ERIN C. COLDSHITH, husband and wife, of 137 Pine Tree Drive, Newville, PA, hereinafter referred to os OWNERS whereby the former undertook and agrecd to ercct and construct improvements to a dwelling house on the certain lot of ground situate in Penn Township, Cumberland County, PennsylvanIa, more fully bounded and described on the attached Exhibit "A". NOW THEREFORE, THIS AGREEHENT WITNESSETH: That the said CONTRACTOR, for and in consideration of the sum of ($ 1.00) Dollar to himself in hand paid by OWNERS, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for himself and his subcontractors, and all parties acting through or under him, covenant and agree that no mechanic's liens or claims shall be filed or maintained by him or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said CONTRACTOR, for himself, his subcontractors and others under him hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said real estate and/or buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. Spencer, Jr., recorded in the Recorder of Deeds office in and for Cumberland County in Plan Book 51, Page 115, being more particularly bounded and described as follows, to wit: BEGINNING at a railroad spike in the centerline of U.S. Route 11, South 31 degrees 22 minutes 55 seconds East, a distance of 429.66 feet passing through an iron pin set 29.66 feet from the property corner to an iron pin; thence along Lot No. 13 of the aforesaid Subdivision Plan, North 58 degrees 37 minutes 05 seconds East a distance of 150.00 feet to an iron pin; thence con- tinuing along Lot No. 13 of the aforesaid Subdivision Plan, North 31 degrees 22 minutes 55 seconds East a distance of 429.74 feet to a railroad spike passing through an iron pin set 29.74 feet from the aforesaid railroad spike; thence over the centerline of U.S. Route 11, South 58 degrees 35 minutes 15 seconds West a distance of 150.00 feet to a railroad spike, the point and place of BEGINNING.
