1. Plaintiff is Audrey A. Turner, an adult individual who
resides at 60 Regency South (Middlesex Township), Carlisle,
Cumberland County, Pennsylvania, 17013.
2. Defendant is Gary L. Turner, an adult individual who
resides at 60 Regency South (Middlesex Township), Carlisle,
Cumberland County, Pennsylvania, 17013.
3. Both the Plaintiff and the Defendant have been bona fide
residents of the COllUllonwealth of Pennsylvania for at least six
months illUllediately previous to the filing of this Complaint.
4. The Plaintiff and Defendant were married on April 17,
1972, in Dauphin County.
5. There have been no prior actions in divorce or annulment
between the parties.
6. The Defendant is not a member of the armed forces of the
United States or any of its allies.
7. The Plaintiff avers that the marriage is irretrievably
broken.
8. Plaintiff has been advised that counseling is available
and that Plaintiff may have the right to request that the Court
require the parties to participate in counseling. The Plaintiff
does not desire counseling.
9. plaintiff requests the Court to enter a Decree of Divorce.

following Pre-trial Statement:
1. LIST OF ASSETS, A partial list of assets is attached
hereto and made a part hereof (Attachment 1). Defendant reserves

have not yet been determined. It is anticipated that there may be

At the present time, the exhibits which Plaintiff
proposes to offer include:
1. Copy of Central Pennsylvania Teamsters Pension Fund Annual
Statement of Defendant's Pension, dated March 14, 1994,
identifying: (a) Benefit Level I - Part I, accrued pension,
at $250,58 per month, and (b) cash value of Pension Account
Benefit Level I - Part II, in the sum of $48,374.42.
2 - Copy of the Central Pennsylvania Teamsters Pension Fund
Report of Defendant dated April 6, 1995, identifying the
Level I . Part II value to be $54,733.47.
3 - Copy of Prudential Life Insurance Company Investment Value
Statement, dated February 24, 1994, identifying the cash
surrender value of the insurance policy of Gary L. Turner to
be $635.20.
4 - Copy of Pennsylvania State Employes Retirement System
statement of account for Plaintiff as of December 31, 1993,
revealing 4,5 years of service, with no vested benefit, but
revealing contributions and interest totaling $4,404.16.
5 - Copy of J.C. Penney credit card and account of Plaintiff
reflecting indebtedness of Plaintiff in July, 1994, to be
$427.88.
6 - Copy of CitiBank Preferred VISA account statement of
Defendant dated July 19, 1994, reflecting indebtedness of
Plaintiff to be $5,008.45.
7 - Copy of J.C. Penney National Bank credit account statement
of Plaintiff, dated May 24, 1994, reflecting an indebtedness
of $2,398.01.
8 - Copy of National Westminster Bank VISA statement of
Defendant dated July 4, 1994, reflecting indebtedness of
Plaintiff to be $896.73.

5. PLAINTIPP'S INcnMR
A copy of a pay stub of the Plaintiff from the
Commonwealth of Pennsylvania reveals her gross pay for each two.
week pay period to be $ 7 36 .50 i her net or "take home" pay to be
$536.17---or, a monthly net income of $1,161. (Exhibit 10)
6. UPENSE STATRII'RN'I'
Plaintiff is still in the process of producing a current
statement of her monthly and/or weekly expenses, has not
completed same, and reserves the right to submit such statement
hereafter, when completed.
7. VALmr OP PENSION
PLAINTIPP'S PENSION. Plaintiff is a member of the
Pennsylvania State Employes Retirement System. Her employment
began in July, 1988, and, upon the separation of the parties in
July, 1994, Plaintiff had not yet become vested (nor has she yet
become vested in her PSERS pension), Nonetheless, the total of
the contributions, plus accrued interest, made by Plaintiff
reveal a cash balance in the account of $4,404.16 as of December
31, 1993 (see Exhibit 4) ,
DEPENDANT'S PENSION. Defendant is a member of the
Central Pennsylvania Teamsters Pension Fund, The Teamsters
Pension Fund is divided into two parts, (al Part I is a formula-
based pension which was "frozen in place" as of December 31,
1986, and will provide to Defendant a monthly pension of $250.58

upon his normal retirement date on August 1, 2010. Part II is a
cash contribution account maintained for each union member by the
Pennsylvania Teamsters Pension Fund, initiated on January 1,
1987, into which the employers of the Defendant have contributed.
This cash account reflects total contributions and earnings as of
the end of calendar year 1993 in the sum of $48,374.42 (see
Exhibit 1), and a cash value at the end of calendar year 1994 in
the sum of $54,733.47 (see Exhibit 2).
8 . COtnl'SB:L PB:B:S.
Plaintiff makes no claim for counsel fees.
9. TAHGIBLB: PBRSONAL PROPBRTY.
Plaintiff presently anticipates no dispute with regard
to tangible personal property; however, Plaintiff reserves the
right to off~r testimony in the event a dispute arises.
10. ~ .RITAL DB:BTS
In July, 1994, the parties separated within the marital
home; Defendant closed the marital banking account; and,
thereafter, Plaintiff and Defendant lived separate personal and
financial lives. As of July, 1994, Plaintiff undertook to pay
indebtedness which was identified in her name, but which she
acknowledges was marital indebtedness. The total of that marital
indebtedness undertaken to be paid by the Plaintiff totaled
$10,451 in July, 1994, and is reflected in Exhibits Nos. 5
through 9.

Plaintiff has not had any access to information
regarding any other indebtedness or credit accounts of the
parties which may be called marital indebtedness and which may
have existed in July, 1994. It was in July, 1994, that Defendant
terminated the maritally-owned accounts (both asset and debt)
after which, plaintiff had no further access to or knowledge of
the status of any of those accounts. Nevertheless, plaintiff
will present her testimony, indicating that the balance of the
marital indebtedness of the party over which Defendant assumed
control in July, 1994, was in the sum of $17,000,

plaintiff notes the following facts in support of her
proposed resolution:
(a) Defendant's earnings are approximately two and one-
half times those of the Plaintiff;
(b) Defendant's pension accounts are quite substantial
and are fully vested, whereas, any potential pension
entitlement of plaintiff is not only modest but has not yet
vested;
(c) the parties were married in 1972, separated in
1994, after 22 years of marriage; and,
(d) plaintiff bore and raised two children of Plaintiff
and Defendant, both of whom are now adults.

Plaintiff and Defendant have amicably adjusted between
themselves, upon a relatively equal basis, the values and items
of indebtedness which would be exclusively associated with the
marital home, automobiles of the parties, and tangible personal
property of the parties. The only items remaining to be
addressed by the Master are the pension interests of the parties
and insurance cash surrender value (contained on Plaintiff's list
of marital assets-.-paragraph 1).
Plaintiff proposes the distribution of indebtedness to
be: Defendant is to pay those items of indebtedness which
existed in his name as of July, 1994, and that Plaintiff pay
those items of indebtedness which were listed in her name in
July, 1994.
Plaintiff proposes that the marital assets be divided
as follows:
(e) that there be awarded to the Defendant the entirety
of his accrued Teamsters Pension of $250.58 per month (but
not payable until August 1, 2010);
(f) that Plaintiff be awarded the entirety of her
contributions and accrued interest in her PSERS retirement
account;
(g) that Defendant be awarded the cash surrender value
upon his Prudential Life Insurance policy; and
(h) that the Level I - Part II Cash Pension Account of

WITNESSETH:
WHEREAS. in conoequence of disputeo and unhappy
differences, the parties have been living separate and apart
from each other; and
WHEREAS, the partieo desire to confirm their separation and
make arrangements therewith, including the division of their
marital property and other rights and obligations growing out of
their marriage,
NOW THEREFORE, in consideration of the covenants and
promises hereinafter to be mutually kept and performed by each
party, as well as for other good and valuable consideration and
intending to be legally bound it is agreed as follows:
(1) It shall be lawful for each party at all times
hereafter to live separate and apart from the other party at
such place or places as he or she from time to time may choose
or deem fit.
(2) Except a8 herein otherwise provided, each party hereby
releases the other from any and all claims, or demands up to the

(4) Except ao hereinafter provided, in the event that
either party contracted or incurred any debts oince the date of
separation, the party who incurred said debt shall be
responsible for the payment thereof regardless of the name in
which the debt may have been incurred,
(4.1) Husband agrees to assume responsibility for the
fOllowing debts:
Sears, Montgomery Ward, Chemical, Discover, First USA,
Mellon MasterCard and Commonwealth National Bank
Household Loan.
(4,2) Wife agrees to assume responsibility for the
fOllowing debts:
JC Penney, CitiBank Preferred VISA, JC Penney National
Bank, National Westminister Bank VISA, and Ford Citibank

(6) The partieo hereto mutually agree that they have

owner of all such property preoently in hio or her possession
whether oaid property was heretofore owned jointly or

the effect of an assignment or bill of sale from each party to
the other for such property ao lIIay be in the individual
possession of each of the parties hereto.
(7) Except ao hereinafter provided, each party hereby
relinquishes any right, title or interest he or she may have in
or to any intangible peroonal property currently titled in the
name of or in the posseooion of the other party, including, but
not limited to, stocks, bonds, insurance, bank accounto and
retirement accounts.

(7,2) Husband hereby releaaell any right, tit Ie Ol' intereat
he may have in Wife's pension by l'eauon of her employment by the
Commonwealth of Pennaylvania.
(7.3) Wife hereby releasea any right, title or intereat
ahe may have in Husband's pension offered by 'l'he Central
Pennsylvania Teamatera Defined Benefit Plan, Level I,
(7,4) Husband and Wife agree that The Central Pennsylvania
Teamstera Retirement Income Plan which had a balance of
approximately $48,374,00 on the date of aeparation shall be
divided between the parties by reason of a Qualified Domestic
Relations Order which shall award the sum of $27,500.00 to Wife
and the balance ahall be retained by Husband as his sole and
aeparate property.
(8) Husband shall not pay to Wife nor Wife to Husband any
sum whatsoever as alimony, alimony pendente lite, or for his or
her support or maintenance.
(9) Each party is now represented by counsel of his and
her own choice, and each ahall pay hiu or her own attorney for
all legal services rendered or to be rendered on his or her
behalf, Husband is represented by Robert C. Saidis, Esquire,
and Wife by Carl Wass, Esquire.
(10) Neither party shall contract or incur any debt or
liability for which the other party or his or her property or
estate may be responsible and shall indemnify and save the other
party harmless from any and all claims or demands made against
him or her by reason of debts or obligations incurred by the

time to time, and under the provisions of any similar
statute enacted by any other country, state, territory or
political subdivision;
I. All rights, claims, demands, liabilities and
obligations each party now has, or may hereafter have,
against or with respect to the other.
(16) This Agreement shall be construed under the laws of
the Commonwealth of Pennsylvania. If any provision of this
Agreement is determined to be invalid or unenforceable, all
other provisions shall continue in full force and effect.
(17) In the event that either of the parties shall recover
a final judgment or decree of absolute divorce against the other
in a court of competent juriSdiction, the provisions of this
Agreement may be incorporated by reference or in substance but
shall not be merged into such judgment or decree and this
Agreement shall survive any such final judgment or decree of
absolute divorce and shall be entirely independent thereof.
(18) In the event that either party breaches any provision
of this Agreement, and the other party retains counsel to assist

4, The name of the Plan to which this Order applies is the
Central Pennsylvania Teamsters Retirement Income Plan (hereinafter
referred to as the "CPTRIP"), Further, any successor plan or plans
to the CPTRIP shall also be subject to the terms of this Order,
Further, this Order shall also apply to the waiver and
relinquishment by Alternate Payee to any interest of Participant in
and to the Central Pennsylvania Teamsters Defined Benefit Plan,
5. This Order is entered in accordance with the Internal
Revenue Code of 1986.
6, This Order relates to the provisions of marital property
rights to the Alternate Payee as a result of a Property Settlement
and Separation Agreement ("Agreement") between Participant and
Alternate Payee, dated October 15, 1997, and a Divorce Decree
between Participant and Alternate Payee issued on November 18
1997, in the Court of Common Pleas of Cumberland County,
Pennsylvania, at No. 95,3947, Civil Term.
A. Under paragraph 7.3 of' the Agreement, Alternate Payee
(Wife) has released any intel'cRt in Participant's (IIusband's)
interest in Husband's pension under the Central Pennsylvania
Teamsters Defined Benefit Plan,
B. Under paragraph 7,4 of the Agreement, Alternate Payee
and Participant have agreed to an award of $27,500 to
Alternate Payee from the CPTRIP,
7, Amount of Alternate Payee's benefit: This Order hereby
assigns tO~Alternate Payee a portion of the Central PennsYlvania
Teamsters Retirement Income Plan as fOllows:
$27,500,00 thereof to AUdrey A, Turner, Alternate
Payee, and the balance of said benefit in its
entirety to Gary L, Turner,
8, Commencement date and form of payment to Alternate Payee,
There shall be established a separate account in the name
of the Alternate Payee within the plan, by the CPTRIP Plan
Administrator, as Soon as administratively feasible fOllowing the
date this Order is approved as a QDRO by said Plan Administrator.
To said separate account, there shall be transferred from the "fUnd
balance" of Participant, the principal Sum of $27,500, plus the
additional sum of interest calculated upon the foregoing principal
at the rate of six (6~) I'''rc''nt: from the date of the
Agreement (October 15, 1997) to the date of the transfer by the
Plan Administrator of the prinicipal sum to the separate account of
Alternate Payee. Thereafter, the separate accOunt of Alternate
Payee shall be maintained, managed, invested, and otherwise treated
in the same fashion as any other account maintained by and on
behalf of any participant in the CPTRIP,
9, This Order is not intended, and shall not be construed in
such a manner as to require the CPTPF:
(a) to provide any type or form of benefit option not
otherwise provided under the terms of the CPTRIP;
(b) to require the CPTRIP plan to provide increased
benefits determined on the basis of actuarial value; or
(c) to require the payment of any benefits to the
Alternate Payee that are required to be paid to another
alternate payee under another Order previously deemed to be a
QDRO.
10, Certification of Necessary Information: All payments
made pursuant to this Order, shall be conditioned on the
certification by the Alternate Payee and the Participant to the
Plan Administrator of such information as the Plan Administrator
may reasonably require from such parties to make the necessary
calculation of the benefit amounts contained herein,
11. Continued Qualified Status of Order: It is the intention
of the parties that this QDRO continue to qualify as a QDRO under
Section 414(p) <Jf the Internal Revenue Code, as it may be amended
from time to time, and that the Plan Administrator shall reserve
the right to reconfirm the qualified status of the Order at the
time benefits become payable hereunder.
12, Tax Treatment of Distributions Made under this Order:
for purposes of Section 402(a) (1) and 72 of the Internal Revenue
Code, any Alternate Payee who is the spouse or former spouse of the
Participant shall be treated as the distributee of any distribution
or payments made to the Alternate Payee under the terms of this
Order, and as such, will be required to pay the appropriate federal
income taxes on such distribution,
13. Constructive Receipt: In the event that the Plan Trustee
inadvertently pays to the Participant any benefits that are
assigned to the Al ternate Payee pursuant to the terms of this
Order, the Participant shall immediately reimburse the Alternate
Payee to the extent that he has received such benefit payments and
shall forthwith pay such amount so received directly to the
Alternate Payee within ten (10) days of receipt.
14. Continued JuriSdiction: The Court shall retain
juriSdiction with respect to this Order to the extent required to
maintain the original intent of the parties as stipulated herein,
15. Ef fect of Plan Termination: In the event that the
Participant's benefits, or any portion thereof, become payable to
the Participant as a result of the CPTRIP termination or
partialtermination pursuant to Title IV of ERISA, then the
Alternate payee shall be entitled to commence her benefits
illUllediately in accordance with the termS of this QDRO and in
accordance with the termination procedures of the CPTRIP Plan,

Retirement Income Plan, on December 31, 1993, was in the sum of

4, A Qualified Domestic Relations Order is required by the
United States Internal Revenue Code to effect such assignment

hereby to the administrator of the plan and the administrator has
determined that the proposed Order attached hereto would, once
entered, constitute a Qualified Domestic Relations Order that the
administrator could effectuate without adversely affecting the tax-
qualified status of the CPTRIP,
