A pretrial conference in the above-captioned
cases, which have been consolidated by separate Order of Court
for trial, was held in the chambers of Judge oler on Wednesday,
August 28, 1996. present on behalf of the plaintiffs was
Richard A. Sadlock, Esquire. Present on behalf of the
Defendant, and standing in for stephen L. Banko, Jr., Esquire,
who will be trying the case, was Lauralee B. Baker-Starr,
Esquire.
These cases are negligence actions for personal
injuries arising out of a one-vehicle accident in which
Defendant, Jerry W. Walker, was the driver, and plaintiffs were
paSsengers. The accident occurred on september 24, 1994, on
Route 641 in West pennsboro Township, cumberland county,
pennsylvania.
Defendant's defense is that the accident was
caused by a deer and not by his negligence. On the issue of
damages, Defendant maintains that plaintiff Kenneth D. pifer was
bound by the limited tort option on his automobile insurance
policy, and that his injury (a ruptured biceps tendon) was not
serious, so that non-economic losses are not recoverable. In
the case of plaintiff Melissa R. Walker, the same issue does not
exist, because she had elected the full tort option.
This will be a jury trial in which, pursuant to
an agreement of counsel, each side will have four peremptory
challenges, for a total of eight. The trial is estimated to be
of a duration of two days.
In the event that any deposition testimony to be
utilized at t~ial will require rulings by the Court on
evidentiary issues, counsel are directed to supply a copy of the
transcript in question to the court at least five days prior to
commencement of the trial term, with the areas of objection
still being pursued highlighted and with brief memoranda in
support of their respective positions. counsel are also
directed to furnish to the Court preliminary proposed jury
instructions and a preliminary proposed verdict slip with
respect to the issue of the damages of plaintiff Kenneth D.
pifer in connection with the limited tort option issue.
with respect to settlement negotiations,
plaintiff in the case of pifer v. Walker has demanded
$32,500.00, and Defendant has offered $6000.00; in the case of

1. Admitted.
2. It is admitted the instant action arises out a motor
vehicle accident which occurred on september 24, 1994, as a result
of the negligence of the instant Defendant. As a result of the
aforementioned accident, plaintiff Kenneth D. pifer sustained a
ruptured right biceps tendon requiring surgical repair.
3. It is admitted at the time of the aforementioned
accident, plaintiff's own motor vehicle insurance was provided by
the General Accident Insurance Company.

4. Deni~d. By way of amplification, plaintiff Kenneth D.
pifer is the 2nl:l named insured on the aforementioned General
Accident insurance policy. At no time applicable hereto did
plaintiff Kenneth D. pifer sign a tort option selection form.
Therefore, pursuant to the terms of the Pennsylvania Motor Vehicle
Financial Responsibility Law, plaintiff Kenneth D. pifer is deemed
to have the full tort option on his policy. ~, 75 pa.C.S.A.
51705(a) (3). A copy of Mr. pifer's declaration page is attached
hereto as Exhibit A. Further, attached hereto as Exhibit B is a
tort option selection form signed by Mr. pifer's ex-wife, Kathleen
Pifer. The pennsylvania Motor Vehicle Financial Responsibility Law
grants no power or authority to Kathleen pifer to sign a tort
option selection form binding the named insured on the General
Accident pOlicy, Kenneth D. pifer.
5.-7. As plaintiff Kenneth D. pifer has the full tort option
on his policy, Defendant's averment is irrelevant to the instant
proceeding.
S. It is admitted that the testimony of plaintiff's treating
physician was not taken until August 30, 1996. Further, documents
were not obtained from plaintiff's insurer, General Accident, until
it responded to plaintiff's Notice for Records Deposition on or
about September 11, 1995. As evidenced by plaintiff's Exhibits A
and B herein, Plaintiff never selected the limited tort option and
is therefore entitled to all rights of the full tort option.
9.-10. As Plaintiff Kenneth D. pifer has the full tort option
on his policy, Defendant's averment is irrelevant to the instant
proceeding.
11.-12. It is admitted Plaintiff previously gave deposition
testimony in the instant action. However, Plaintiff has the full
tort option herein and the instant Motion should be denied.
13. Admitted.
14. It is admitted that the plaintiff had physical therapy at
Keystone Rehabilitation Center.
15.-16. Dr. Mira's deposition testimony speaks for itself.
However, the testimony relates to the amount of damages sustained
by plaintiff herein. Further, as plaintiff has the full tort
option, the extent of plaintiff's damages remains a jury question.
17. Defendant's averment is a conclusion of law to which no
responsive pleading is required. To the extent the averment may be
deemed factual, it is hereby specifically denied. By way of
amplification, Plaintiff did sustain a serious injury and
permanent, serious disfigurement as a result of the motor vehicle
accident on september 24, 1994. Further, Plaintiff has the full
tort option and is therefore entitled to recover all dauCJ..
recognized by Pennsylvania Law.
WHEREFORE, Plaintiff respectfullY requests your Honorable
court to deny Defendant's Motion in Limine.

2. plaintiff'S cause of action arises out of a motor
vehicle accident which occurred on september 24, 1994, from which
Plaintiff contends he sustained an acute ruptured right bicepS
tendon requiring surgical repair. ~ paragraph 10 of
plaintiff's complaint.
3. It is undisputed that at the time of the accident,
Plaintiff was insured by General Accident Insurance Company. A
copy of plaintiff's Answers to Interrogatories indicating his
affiliation with General Accident Insurance company is attached
hereto, incorporated herein by reference and marked Exhibit "B."
4. It is further undisputed that for the poliCY period
in effect at the time of the motor vehicle accident at issue,
Plaintiff had elected limited tort coverage. A copy of
plaintiff's tort election, which was provided and acknowledged by
Plaintiff, is attached hereto, incorporated herein by reference
and marked EJthibit "C."
5. The limited tort provisions of the pennsylvania
Motor Vehicle Financial Responsibility Law ("paMVFRLn) provide
for a reduced insurance premium in exchange for losS of the right
to seek recovery for pain and suffering or other non-economiC
damages arising out of a motor vehicle accident, unlesS the
injuries sustained fall within the definition of "serious
injury." 75 Pat C.S.A. !l1705(a) (1) (Al.
6. "Serious injury" is defined as a personal injury
that results in "death, serious impairment of body function or
permanent serious disfigurement." 75 Pa. C.S.A. !l1702.
7. In Dodson v. Elvev, Pa. Super. ___, 665 A.2d
1223 (1995), the superior Court held that the determination of
whether a limited tort plaintiff has suffered a serious injury
such that a full tort coverage would apply was initially a
question of law for a judge to determine.
8. Prior to this time this issue was not ripe for the
Court's review, as the testimony of Plaintiff's treating
physician was not taken until August 30, 1996.
9. In making a threshhold determination of whether a
serious impairment of body function exists, the Court makes two
inquiries: (a) what body function, if any was impaired because
of the injuries sustained in the motor vehicle accident! and (b)
was the impairment of body function "serious?" Dodson v. E1vev,
Pa. Super. ___, 665 A.2d 1223 (1995).
10. In further determining whether the impairment was
"serious," several factors should be considered: (1) the extent
of the impairment! (2) the particular body function impaired!
(3) the length of time the impairment lasted! (4) the

treatment required to correct the impairment; and (5) any other
relevant factors. podson, ~uora, at 1234.
11. In his deposition, Plaintiff testified that the
only injuries he sustained from this accident involved a tear of
his right biceps tendon and a bruise to his right shoulder:
Q. Now, in this accident as I understand it
one of your biceps .- you had a muscle
ripped off the bone and had to have that
repaired. Is that essentially the
injury that you had?
A. Correct.
Q. Other than that did you have any other
injuries?
A. I had an injury that was a bruise
(indicating), this part of my shoulder
from hitting the side of the truck.
Q. Now you're showing us the back of your
right shoulder?
A. Right shoulder, yes. Sorry.
Q. And the bicep injury was on what side?
A. To my right arm (indicating), right
there.

Exhibit "D."
12. AS far as the effect the aforesaid injury has had
on plaintiff's employment as a youth development counselor
supervisor, Plaintiff testified to the following:

as a lead in, so I approach the resident
from the side where I can do it, from
the left side of my body, and I am also
._ we use a system called safe physical
management. I am a certified instructor
for the state, and I really haven't been
able to be involved with hands on
instruction as much as I used to be
before the accident.

incorporated herein by reference and marked Exhibit "E."
13. Following the accident, Plaintiff received
treatment from Allen Mira, M.D.. and was ultimatelY discharged
from Dr. Mira'S care in approximatelY MaY 1995.
14. In addition to the treatment rendered by Dr. Mira,
Plaintiff underwent a three-month course of physical therapy at
KeyStone Rehabilitation center which ended in March 1995. ~
page 23 of plaintiff'S deposition which is attached hereto,
incorporated herein by reference and marked Exhibit "F."
15. At the time of his deposition for use at trial,
Dr. Mira testified that within eighteen monthS after the accident
plaintiff'S injury had plateaued, and that the range of motion
and function of the right arm had returned to ninety percent of
normal function. Dr. Mira did n2k testify in his deposition that
Plaintiff had sustained a permanent injury. ~ pages 15 and 22
and the entirety of Dr. Mira'S deposition which is attached
hereto, incorporated herein by reference and marked Exhibit "G."

16. Likewise, as to Plaintiff's surgical scarring
which involves a two-inch scar on the inside and outside of the
right elbow, Dr. Mira testified that the scarring was permanent,
but he did UQt opine that the scarring constituted a serious
disfigurement.
17. The foregoing testimony indicates that Plaintiff
did not sustain a serious injury or serious permanent
disfigurement as a result of the motor vehicle accident on
September 24, 1994.
WHEREFORE, Defendant, Jerry Walker, respectfully
requests this Court to enter an Order dismissing Plaintiff's
claims for non-economic damages ruling that Plaintiff did not
suffer a serious injury from the motor vehicle accident as a
matter of law. Alternatively, Defendant requests this Court to
issue an Order that the determination of whether or not the
Plaintiff sustained a serious injury such that non-economic
damages may be recovered is a question for a jury to resolve at
the time of trial of this case.

1. plaintiff Kenneth D. pifer is an adult individual,
citizen of the commonwealth of pennsylvania, who resides at R.D.
13, BOX 111C, Shelocta, Indiana county, pennsylvania.
2. plaintiff Jerry W. Walker is an adult individual, citizen
of the commonwealth of pennsylvania, who resides at 449 Hunters
Road, Newville, cumberland county, pennsylvania.
3. The facts and occurrences hereinafter related took place
on or about september 24, 1994, at approximately 11:10 a.m., on SR
641 _ Newville Road, west pennsboro Township, Cumberland county.
4. At that time and place, Defendant Jerry R. Walker was
operatinq a 1979 Ford F-250 pick-up truck and was travellinq east
on SR 641, West pennsboro Township, cumberland County.
5. At that time and place, plaintiff Kenneth D. pifer was a
passenqer in a vehicle beinq driven by Defendant Jerry R. walker.

6. At that time and place, Defendant Jerry R. Walker
observed a deer on the left side of the roadway.
7. At that time and place, Defendant overreacted to the
presence of the deer, operated his vehicle at a high rate of speed,
unnecessarily swerved to avoid the deer, lost control of his
vehicle and struck a telephone pole on the right berm of the
roadway.
S. At that time and place, a violent collision occurred
between the left portion of the Ford truck and the telephone pole.
9. The ioreqoinq accident and all of the injuries and
damaqes sustained by Plaintiff Kenneth D. Pifer set forth
hereinafter, are the direct and proximate result of the negliqent,
carel..., wanton and reckless manner in which Defendant Jerry R.
Walker operated the 1979 Ford F-150 truck as follows:
(a) failure to have the vehicle under such control as
to be able to stop within the assured clear
distance ahead;
(b) failure to keep alert and maintain a proper watch
on the hiqhway;
(c) failure to stay within his lane of travel;
(d) failure to apply his brakes in sufficient time to
avoid collidinq with the deer and telephone pole;
(e) failure to keep proper and adequate control over
his vehicle;
(f) failure to travel at a safe speed;

failure to drive his vehicle with due regard for
the highway and traffic conditions which were
existing and of which he was aware or should have
been aware;
(h)
failure to take reasonable evasive action to avoid
the accident; and
( i)
driving his vehicle upon the highway in a manner
endangering persons and property and in a reckless
manner with carele~s disregard to the rights and
safety of others and in violation of the Motor
Vehicle Code of the Commonwealth of Pennsylvania.
As a result of the aforementioned accide~t, Plaintitt

Kenneth D. Pifer sustained painful, severe and serious injurie.,
including but are not limited to, an acute ruptured right biceps
requiring surgical repair.
11. By reason of the aforementioned injuries sustained by
Plaintiff Kenneth D. Pifer, he was forced to incur liability for
medical treatment, medications, hospitalizations, and similar
miscellaneous expenses in an effort to re.tore himself to health,
and claim is made therefor.
12. Because of the nature of his injuries, plaintiff Kenneth
D. pifer has been advised and, therefore, avers that he may be
forced to incur similar expense. in the future, and claim is made
therefor.
13. As a result of the aforementioned injuries, Plaintiff
Kenneth.D. Pifer has undergone and in the future will undergo great

physical and mental suffering, great inconvenience in carrying out
his daily activities, loss of life's pleasures and enjoyment, and
claim is made therefor.
14. As a result of the aforementioned injuries, Plaintiff
Kenneth D. Pifer has been and in the future will be .ubject to
great humiliation and embarrassment, and claim is made therefor.
1!l. As a result of the atorementioned injuries, Plaintitt
Kenneth D. Piter has sustained work loss, loss ot opportunity and
a permanent diminution of his earning power and capacity, and claim
is made theretor.

D. Pifer ha. sustained uncompensated work loss, and claim i. made
therefor.
17. Plaintiff xenneth D. Pifer continues to be plagued by
persistent pain and limitation and, therefore, avers that his

for the remainder of his litetillle, and claim is made therefor.

1. Plaintiff Kenneth D. Pifer is an adult individual,
citizen of the Commonwealth of Pennsylvania, who resides at R.D.
#3, Box 111C, Shelocta, Indiana County, Pennsylvania.
2. Plaintiff Jerry W. Walker is an adult individual, citizen
of the Commonwealth of Pennsylvania, who resides at 449 Hunters
Road, Newville, Cumberland County, Pennsylvania.
3. The facts and occurrences hereinafter related took place
on or about September 24, 1994, at approximately 11:10 a.m., on SR
641 - Newville Road, West pennsboro Township, Cumberland County.
4. At that time and place, Defendant Jerry R. Walker was
operating a 1979 Ford F-250 pick-up truck and was travelling east
on SR 641, West pennsboro TownShip, Cumberland County.
5. At that time and place, Plaintiff Kenneth D. Pifer was a
passenger in a vehicle being driven by Defendant Jerry R. Walker.

6. At that time and place, Defendant Jerry R. Walker
observed a deer on the left side of the roadway.
7. At that time and place, Defendant overreacted to the
presence of the deer, operated his vehicle at a high rate of speed,
unnecessarily swerved to avoid the deer, lost control of his
vehicle and struck a telephone pole on the right berm of the
roadway.
8. At that time and place, a violent collision occurred
between the left portion of the Ford truck and the telephone pole.
9. The foregoing accident and all of the injuries and
damages sustained by plaintiff Kenneth D. pifer set forth
hereinafter, are the direct and proximate result of the negligent,
careless, wanton and reckless manner in which Defendant Jerry R.
Walker operated the 1979 Ford F-150 truck as follows:
(a) failure to have the vehicle under such control a.
to be able to stop within the assured clear
distance ahead;
(b) failure to keep alert and maintain a proper watch
on the highway;
(c) failure to stay within his lane of travel;
(d) failure to apply his brakes in sufficient time to
avoid colliding with the deer and telephone pole,
(e) failure to keep proper and adequate control over
his vehicle;
(f) failure to travel at a safe speed;

failure to drive his vehicle with due regard for
the highway and traffic conditions which were
existing and of which he was aware or should have
been aware;
(h)
failure to take reasonable evasive action to avoid
the accident; and
driving his vehicle upon the highway in a manner
endangering persons and property and in a reckless
manner with careless disregard to the rights and
safety of others and in violation of the Motor
Vehicle Code of the Commonwealth of Pennsylvania.
As a result of the aforementioned accident, Plaintiff

Kenneth D. Pifer sustained painful, severe and serious injuries,
including but are not limited to, an acute ruptured right biceps
requiring surgical repair.
ll. By reason of the aforementioned injuries sustained by
Plaintiff Kenneth D. Pifer, he was forced to incur liability for
medical treatment, medications, hospitalizations, and similar
miscellaneous expenses in an effort to restore himself to health,
and claim is made therefor.
12. Because of the nature of his injuries, Plaintiff Kenneth
D. Pifer has been advised and, therefore, avers that he may be
forced to incur similar expenses in the future, and claim is made
therefor.
13. As a result of the aforementioned injuries, Plaintiff
Kenneth D. Pifer has undergone and in the future will undergo great

physical and mental sUffering, great inconvenience in carrying out
his daily activities, loss of life's pleasures and enjoyment, and
claim is made therefor.
14. As a result of the aforementioned injuries, Plaintiff
Kenneth D. Pifer has been and in the future will be subject to
great humiliation and embarrassment, and claim is made therefor.
15. As a result of the aforementioned injuries, Plaintiff
Kenneth D. Pifer has sustained work loss, loss of opportunity and
a permanent diminution of his earning power and capacity, and claim
is made therefor.
16. As a result of the aforesaid injuries, Plaintiff Kenneth
D. Pifer has sustained uncompensated work loss, and claim is made
therefor.
17. Plaintiff Kenneth D. Pifer continues to be plagued by
persistent pain and limitation and, therefore, avers that his
injuries may be of a permanent nature, causing residual problems
for the remainder of his lifetime, and claim is made therefor.
18. As a result of the aforesaid accident, Plaintiff Kenneth
D. Pifer has sustained scars which will result in a permanent,
serious disfigurement, and claim is made therefor.
19. As a result of the aforesaid accident, Plaintiff Kenneth
D. Pifer sustained serious injuries resulting in a serious
impairment of body function, and claim is made therefor.

In civil cases such as this one, the plaintiffs have the

When a party has the burden of proof on a particular

expectancy of all persons of Plaintiff Ken D. Pifer's age at the
time of accident, sex and race was 32.5 years, and the average life
expectancy of all persons of Plaintiff Melissa R. Walker's age at
the time of accident, sex and race was 55.0 years. This figure is
offered to you only as a guide, and you are not bound to accept it
if you believe that the Plaintiffs would have lived longer or less
than the average individual in their category. In reaching this
decision you are to consider the Plaintiffs' health prior to the
accident, their manner of living, their personal habit. and other
factors that may have affected the duration of their life.

for the disfigurement he has suffered in the past as a result of
