4. Among the work to he performed was Ihe marking and slaking of 11101 previously
surveyed and designaled as Lol No, II) on the Subdivision Plan for L, B, Phillips. reelll'ded in
Cumberland COllnlY Plan Book 32. Pages 1)1) through I)I)C, A reduced copy of Page I)I)C of said
subdivision plan is allached hereto and incorporated herein by reference as Exhibil "A".
5, Plainliff also made availahle 10 Defendant survey data which Plainliff had previously
had performed for surrounding land of Plaintiff. Said survey data included boundaries common
with Lol No. II).
6. Defendanl represenled himself and held himself out to Plainliffs 10 be a licensed land
surveyor operating under Ihe business name of Grier and Associates and able to perfurmlhe work
aeeufUlely and in a workmanlike manner.
7. Defendanl breached his verlmlagreemel1lwith PlaintitTs hy faiting 10 properly perform
the work requesled. Defendant. in hreuch of his express representutions as 10 professional ubililies
and in breuch of his implied wurrunty to performlhe wllI'k in u wurknlllnlike nlllnner. improperly.
and with total disregurd tolhe dalamade uvailablc to him ul1ll10 licld dulll on Ihe property. murked
the lot, fuiling to place stakes ullhe Lot corners hut insleUlI placing slakes so that it appeured thai a
porlion of whal wus uctuully Lot III and Ihe lot known as the Richlallll School Lot were u part of
lot 19,
ll. Lot 19 \vus conveyed to Gregory J, Smith and Launl J. Smilh (hereinafter referred 10
as "Smiths") hy deed of Pluintiffs conlaining a special warnlllly of tille, Said deed was recorded in
Cumhcrlund Counly Deed Book "V". Volume 35, Page 261.
9. Bused on the improper nmrking of the lot, Smiths hud conslructed on what they
helieved to he their property, hut which was actuully olher property of Plaintiffs. a single family
dwelling which was completed on or ahout June I, 1993,
10. Because the lot was not marked properly. Smiths caused their home to he constructed
in such a manner that it encroached on huilding set back lines and was, therefore, in violation of
ordinances of Dickinson Township and in violation of building and use restriclions imposed on
lots in said subdivision.
II. When the error was discovered and the dwelling was completed as aforesaid, Smiths
demanded that Plaintiffs correct the error based on the speeial warranty of title to the land
contained in the aforementioned deed,
12, Plaintiffs employed Statler & Brehm Surveyors to resurvey the lot and prepare a
revised subdivision plan for the purpose of subdividing a lot from olher lands of Plaintiffs of
sufficient size to convey to Smiths land necessary so that their new home would be in conformity
with the applicable building and use restrictions and Township ordinances imposed on said lot.
13. Plaintiffs employed Dale E Shughart. Jr., Esquire to represent them in the
resubdivision process.
14. Plaintiffs were successful in ohtaining approval for the Subdivision Plan from the
Dickinson Township Planning Commission and Supervisors on or about January 16. 1995 and
thereafter the Plan was recorded on January Ill, 1995 in Cumberland County Plan Book 72, Page
48. A reduced copy of the Subdivision Plan is allachcd hereto and incorpontted herein by
reference as Exhihit "B",
15. On or ahout May 6. 1996, Plaintiffs conveyed the resubdivided lot addition to Smiths
to correct the error of Delcndant. A Ime and correcl copy of the Deed refonnation agreement
conveying said lots is alluched herelo und incorpllnlted herein by relcrence us Exhibit "C".
