STIPULATION AGAINST LIENS
WHEREAS, Wheatland Custom Homes, Inc., a Pennsylvania Corporation, of
Pennsylvania, is about to execute contemporaneously herewith, a contract with Wheatland Custom
Homes, Inc., a Pennsylvania Corporation of Lancaster County, Pennsylvania, for the erection of a
dwelling upon a lot of land situate as follows:
ALL THAT CERTAIN lot or tract of land located in East Pennsboro Township,
Cumberland County, Pennsylvania in accordance with a Final Subdivision Plan of Penn Valley,
Phase V, as prepared by Hartman & Associates, Inc., Engineers and Surveyors, Camp HilI,
Pennsylvania and recorded in Plan Book 89, Page 123, more particularly bounded and described as
follows, to v..it:
BEGINNING at a point on the northern right-of-way line of Redwood Drive (a fifty
foot right-of-way), said point being located the following four (4) courses from the terminus of a
curve connecting said right-of-way with the eastern right-of-way line of Larch Lane (a fifty foot
right-of-way) 1) North fifty-seven degrees, twelve minutes, forty-eight seconds East, a distance of
seventy-five (75.00) feet to a point; 2) by a curve to the right, having a radius of two hundred forty
feet (240.00), an arc distance of two hundred twenty-eight and eighty-five hundredths feet (228.85)
to a point; 3) by a curve to the left, having a radius of three hundred (300.00) feet, an arc distance
of one hundred sixty-five and forty-seven hundredths (165.47) feet to a point; 4) North eighty
degrees fourteen minutes forty-five seconds East, a distance of sixty-four and eighty-eight
hundredths feet (64.88) to a point; thence from said point of Beginning by Lot No. 83 North nine
degrees, forty-five minutes, fifteen seconds West, a distance of one hundred seventy feet (170.00)
to a point; thence by the same South eighty-six degrees, six minutes, twenty seconds West, a distance
of thirty-five (35.00) feet to a point; thence by Lot No. 84 the following two (2) courses: 1) North
two degrees, thirty-one minutes zero seconds West, a distance of ninety-seven and twenty-one
hundredths (97.21) feet to a point; 2) North fifty degrees thirty-one minutes fourteen seconds East,
a distance of fifty and eighty-four hundredths (50.84) feet to a point on the southern right-of-way line
of Sycamore Court; thence by said right-of-way line, by a curve to the left having a radius of fifty
(50.00) feet an arc distance of fifty-two and sixty hundredths (52.60) feet to a point; thence by the
same North eighty degrees, fourteen minutes, forty-five seconds East, a distance of twenty-five
(25.00) feet to a point; thence by Lot No. 78 South nine degrees, forty-five minutes, fifteen seconds

East, a distance of two hundred seventy (270.00) feet to a point on the northern right-of-way line of
Redwood Drive; thence by said right-of-way line South eighty degrees, fourteen minutes, forty-five
seconds West, a distance of ninety (90.00) feet to a point, the Place of BEGINNING.
BEING Lot No. 77 as shown on the Final Subdivision Plan of Penn Valley, Phase
V. Recorded in Plan Book 89, Page 123.
CONTAINING approximately 28,003.66 square feet or 0.643 acres, more or less.
UNDER AND SUBJECT to a twenty-five foot drainage easement, as shown on the
above mentioned plan.
NOW, the ':5 ~ day ofJanuary, 2007, at the time of and immediately before the
execution of the principal contract, and before any authority has been given by the said WheatIand
Custom Homes, Inc., a Pennsylvania Corporation to the said WheatIand Custom Homes, Inc., a
Pennsylvania Corporation to commence work on the said building, or purchase materials for the
same in consideration of the making of the said contract with WheatIand Custom Homes, Inc., a
Pennsylvania Corporation and the further consideration of One Dollar, to WheatIand Custom Homes,
Inc., a Pennsylvania Corporation paid by WheatIand Custom Homes, Inc., a Pennsylvania
Corporation it is agreed that no lien shall be filed against the building by the contractor, or any sub-
contractor, nor by any of the material men or workmen or any other person for any labor, or materials
purchased, or extra labor or materials purchased for the erection of said building, the right to file
such liens being expressly waived.
WITNESS, our hand and seals the day and year aforesaid.
