Cornman, by and through her attorneys, The Law Office of Darrell C. Dethlefs, by Bryan W. Shook, Esquire and makes within the Complaint against Defendant, Housing Authority of the County of Cumberland, and in support thereof, avers as follows: 1. Plaintiff, Amy L. Cornman, is an adult individual currently residing at 1010 Hauck Road, Mechanicsburg, Cumberland County, Pennsylvania 17055. 2. Defendant, Housing Authority of the County of Cumberland alkla Cumberland County Housing and Redevelopment Authority, is a Commonwealth entity with offices located at 114 North Hanover Street, Suite 104, Carlisle, Cumberland Pennsylvania 17013-2445 3. On or about December 10, 1999 Plaintiff, Amy L. Cornman entered into a lease and/or Lease/Option to Purchase Agreement which was part of the Homeownership Program with the owner and Defendant, herein, Housing Authority of the County of Cumberland a/k1a Cumberland County Housing and Redevelopment Authority, for the property located at and known as 614 . " State Street, Lemoyne, Cumberland County, Pennsylvania 17043. (A copy of the Lease, dated December 10, 1999, is attached hereto and made part hereof as Exhibit "A"). 4. On or about December 2,2003 Plaintiff exercised her option to purchase the aforementioned premises. 5. The purchase price, paid by Plaintiff to Defendant was $65,905.00. 6. An agreement as to the understanding regarding the Defendant's decreasing lien on the sale of premises is recorded in the Office of the Recorder of Deeds for Cumberland County in Book 704 at Page 2378 (hereinafter referred to as "Agreement"). (A copy of this Agreement is attached hereto and made part hereof as Exhibit "B"). 7. The Agreement states in paragraph 2A. that "[i]n the event Owners receive net proceeds that do not exceed $65,905.00, then in that event, Owners shall retain all net proceeds." (emphasis in original). 8. The Agreement states in paragraph 2B that "[i]n the event Owners receive net proceeds that exceed $65,905.00, then and in that event, the difference between the total amount of the net proceeds and $65,905.00 shall be payable to the Authority. 9. On or about August 31, 2006, Plaintiff, Amy L. Cornman, conveyed the aforementioned real property to Mark: B. Graybill and Jennifer D. Graybill, now or formerly of Lewisberry, York County, Pennsylvania for the sum of $73,200.00. 10. Plaintiff's net proceeds on the sale of the real property were less than $65,905.00. 11.ln order to provide marketable title to the aforementioned property on August 31, 2006, Plaintiff, Amy L. Cornman, was forced to pay Defendant $7,295.00 for Defendant to remove its lien. (A copy of the United States Department of Housing and Urban Development Settlement Statement, dated August 31, 2006 is attached hereto and made part hereof as Exhibit "C"). 12. Plaintiff believes, and, therefore, avers, that pursuant to the Agreement, dated December 2, 2003 and recorded in the Office of the Recorder of Deeds for Cumberland County on December 4, 2003 at Book 704, Page 2378, Plaintiff was not required, in this instance, to relinquish any of the $7,295.00 to Defendant by reason that the net proceeds did not exceed $65,905.00 pursuant to paragraph 2 of the aforesaid Agreement. 13. Plaintiff believes, and, therefore, avers, that Defendant breached its contract with Plaintiff with respect to the net proceeds from the sale of the aforementioned real property. WHEREFORE, Plaintiff, Amy L. Cornman, respectfully requests that This Honorable Court enter judgment in her favor in the amount of $7,295.00 plus interest and whatever other relief this Court deems necessary and just. Not to provide accommodations for boarders or lodgers. Boarders or lodgers shall be defined to be any person to stay overnight in excess of three days in anyone month or 14 days in anyone year period. B.
