COMPLAINT
AND NOW comes Plaintiff, Amy L. Cornman, by and through her
attorneys, The Law Office of Darrell C. Dethlefs, by Bryan W. Shook, Esquire
and makes within the Complaint against Defendant, Housing Authority of the
County of Cumberland, and in support thereof, avers as follows:
1. Plaintiff, Amy L. Cornman, is an adult individual currently residing at 1010
Hauck Road, Mechanicsburg, Cumberland County, Pennsylvania 17055.
2. Defendant, Housing Authority of the County of Cumberland alkla Cumberland
County Housing and Redevelopment Authority, is a Commonwealth entity
with offices located at 114 North Hanover Street, Suite 104, Carlisle,
Cumberland Pennsylvania 17013-2445
3. On or about December 10, 1999 Plaintiff, Amy L. Cornman entered into a
lease and/or Lease/Option to Purchase Agreement which was part of the
Homeownership Program with the owner and Defendant, herein, Housing
Authority of the County of Cumberland a/k1a Cumberland County Housing
and Redevelopment Authority, for the property located at and known as 614
. "
State Street, Lemoyne, Cumberland County, Pennsylvania 17043. (A copy of
the Lease, dated December 10, 1999, is attached hereto and made part
hereof as Exhibit "A").
4. On or about December 2,2003 Plaintiff exercised her option to purchase the
aforementioned premises.
5. The purchase price, paid by Plaintiff to Defendant was $65,905.00.
6. An agreement as to the understanding regarding the Defendant's decreasing
lien on the sale of premises is recorded in the Office of the Recorder of Deeds
for Cumberland County in Book 704 at Page 2378 (hereinafter referred to as
"Agreement"). (A copy of this Agreement is attached hereto and made part
hereof as Exhibit "B").
7. The Agreement states in paragraph 2A. that "[i]n the event Owners receive
net proceeds that do not exceed $65,905.00, then in that event, Owners shall
retain all net proceeds." (emphasis in original).
8. The Agreement states in paragraph 2B that "[i]n the event Owners receive net
proceeds that exceed $65,905.00, then and in that event, the difference
between the total amount of the net proceeds and $65,905.00 shall be
payable to the Authority.
9. On or about August 31, 2006, Plaintiff, Amy L. Cornman, conveyed the
aforementioned real property to Mark: B. Graybill and Jennifer D. Graybill, now
or formerly of Lewisberry, York County, Pennsylvania for the sum of
$73,200.00.
10. Plaintiff's net proceeds on the sale of the real property were less than
$65,905.00.
11.ln order to provide marketable title to the aforementioned property on August
31, 2006, Plaintiff, Amy L. Cornman, was forced to pay Defendant $7,295.00
for Defendant to remove its lien. (A copy of the United States Department of
Housing and Urban Development Settlement Statement, dated August 31,
2006 is attached hereto and made part hereof as Exhibit "C").
12. Plaintiff believes, and, therefore, avers, that pursuant to the Agreement, dated
December 2, 2003 and recorded in the Office of the Recorder of Deeds for
Cumberland County on December 4, 2003 at Book 704, Page 2378, Plaintiff
was not required, in this instance, to relinquish any of the $7,295.00 to
Defendant by reason that the net proceeds did not exceed $65,905.00
pursuant to paragraph 2 of the aforesaid Agreement.
13. Plaintiff believes, and, therefore, avers, that Defendant breached its contract
with Plaintiff with respect to the net proceeds from the sale of the
aforementioned real property.
WHEREFORE, Plaintiff, Amy L. Cornman, respectfully requests that This
Honorable Court enter judgment in her favor in the amount of $7,295.00 plus
interest and whatever other relief this Court deems necessary and just.

Program").
WHEREAS, Tenant has been deemed to be eligl"ble far participation by Landlord in the
Homeownership Program and further desires to enter into a Leae/Option to Purchase
Agreement. as hereinafter set forth.
NOW, TIiEREFORE, in consideration of the mutual covenants herein contained, it is undemood
and agreed by and between the parties as follows;
1. LEASED PREMISES AND TERM: In coDJideration of the timely payment ofr~nt, as

2. LEASE PAYMENTS: Tenant agrees to pay to Landlord a swn equal ro.j.l.J / O. 00

payment". The monthly payment herein shall be made on or before the first day of each month

3. ESCROW ACCOUNT: A 8Wn equal to forty per cent (40%) of the rent/escrow
payment paid to Landlord pursuant to the provisions of Paragraph 2 above. shall be placed by
landlord into an interest. bearing e.crow accoWlt to be used for the purchase of the leased
premises in accordance with the tenn. of Paragraph 15 herein. The funds in the e.crow accoWlt
may be expended by Landlord for maintenance of this premises. at Landlord', sole discretion.
Upon Tenant's inability to purchase the premise, through no mult of the Tenant to be detennined
by the Landlord all accwnulated .funds in the eserow accoWlt, including acemed interest, shall be
returned to Tenant, less, however, any funds expended on maintenance or to cover
reimbursement of the cost ofrepairing any intentional or negligent damage to the leased premises
caUled by Tenant, his family. or dependents.
4. UTILITIES: Tenant shall assume and promptly pay for any and all utilities including but
not limited to cable TV, telephone. electricity. gas, oil, water and sewer charges. and rubbish
removal.
s. HOMEOWNERSHIP TRAINING: AJ a condition of this Lease, the Tenant must
attend any and all homeownenhip trairting classes which landlord, at its .ole discretion,
detennines that Tenant shall attend. Said homeownership training classes shall either be those
classes sponsored by Landlord or IUch pmon or entity that Landlord shall so designate. Tenant
shall ~o aubmit a completed budget fonn each month with their rent. This fonn shall be
provided by the Landlord's Homeownership Counselor. Tenant shall also meet with the
Landlord's homeownenhip counselor for a minimwn of four '''lions and then as deemed
necessary by the Homeownership Counselor. The Tenant .hall further be subject to
hOUleJceeping inspections two time. per year.
6. FINANCIAL CONDITION OF TENANT: Tenant acknowledges that it Jw been

7. EXTENSION OF TERM: If at the conc1uaion of the tenn of thiJ Leue, the Tenant is
not deemed by landlord to be in a polition to aaume the dutie. of homeownerahip and, in
particular, h81 not met the conditions of Paragraph 6, then at the .ole discretion of Landlord, the
term ofthil Lease Ihal1 extend for an additional one year. Ifat the conclusion of the additional
one year tenn Tenant is stilI not deemed ready, at the 801e discretion of landlord, for
homeownership, then this Lease Agreement shall terminate and the Tenant shall be given a
Section 8 Certification or Voucher and shall vacate the premises at the conclusion of the
additional one year term. Any and all fimds held in the interest-bearing escrow account shall be
retained by Landlord.
8. OBLIGATION OF TENANT: Tenant ,hall have the following obligations under this
Lease Agreement:
A. Not to provide accommodations for boarders or lodgers. Boarders or lodgers shall
be defined to be any person to stay overnight in excess of three days in anyone
month or 14 days in anyone year period.
B. To use the premise. .olely as a private dwelling for Tenant and Tenant's
household, as defined in the Lease, not to use or pennitted to Ole for any other
purpose.
C. To abide by n~essary and reasonable regulatioDJ promulgated by Landlord for
the benefit and well-being of the Tenant. Any violation of any of the provisions
and regulations of Landlord constitutes a violation of this Lease.

the premises for the purpose of perfonning periodic inspections, for making
improvements, routine maintenance, or to show the premise. for re.leasing.
M. To properly noti1Y Landlord of known need for any repairs to the leased premises,
particularly of conditions hazardous to life, health or safety of the occupants and
to notifY Landlord.
N. Not to make any repairs or alteratioIlJ without the written consent of Landlord.
O. To pay all necessary legal fees expended by Landlord for enforcement of the
provisions ofthir Leue Agreement.
9. FIXTURES: Anything installed upon or affixed to the leased premises which cannot be
removed without significant damage to the leased premise. shall be considered a fixture and shall
be deemed a part of the Landlord's real estate. Any item not immediately removed from the
leued premi.te. upon teonination of the tenancy ,hall be conclusively presumed to have been
abandoned by the Tenant and shall b~ome the property of the Landlord.

12. EMINENT DOMAIN: In the event that the entire leaaed premises it appropriated under

13. INSPECTION: Lancl1ord, its employee. and agents. 8ha11 be entitled to enter upon the
lease~ premises from time to time to inspect the condition thereof in compliance with the tenn.
of the Lease upon reasonable prior notice to the Tenant and in a reasonable m8JU1er. Twenty-
four (24) hoUI'l is deemed to be a reasonable notice. Landlord, its employees and agents. shall be
entitled to enter upon the leased premises at any time when the circ1Dllstances reasonably require
such ently to prevent imminent danger or des1Iuction thereof.
14. RENTAL APPLICATION: OCCUPANTS: Tenant warrants that all of the
infonnation furnished to Landlord in Tenant'. rental application is complete and accurate.
Tenant shall pennit no persons, other than the fonowing, to use and occupy the leased premises:

1 s. CONDITIONAL OPTION TO PURCHASE: Tenant has a conditional option to
purchase the leased premises. It is tmdmtood by Landlord and Tenant that Tenant has been
selected for occupancy of the leased premises for purpose. of purchase of the premises at the
conclusion of the tenn hereof. In the event that Tenant has satisfied all of the tenns and
condiMons of this Lease Agreement, to the satisfaction of Landlord, then Lancl10rd .hall sell,
grant and convey to Tenant who shall purchase and accept conveyance of the leased premises.

C. Settlement: Settlement aha11 be held at the expiration of the teon of this Leue
Agreement or any extension thereof. At settlement, realty trantfer taxes shall be divided.
Tenant shall, in addition, pay aU closing costs including expenses of title ~ title
insurance premiwn, and the COlt of recordation of deed and mortgages. In the event that
tender of good and marketable title by Landlord at the time of settlement is made and
Tenant fails to purchase or failJ to qualify for a mortpge from a conventional lender or
Pennsylvania Housing Finance Agency or Tenant'. breach of any of the conditioDJ of this
Lease Agreement, then the rights of the Tenant to purchase shall be deemed to be null
and void. The balance retained in Tenant'. escrow account ,haD, however, be returned to
Tenant, less any funds expended on any maintenance or to cover reimbursement of the
cost of repairing any intentional or negligent damages to the dwelling Mit If Landlord is
unable to convey as herein provid~ Tenant may require that all monie. in said escrow
account be returned by landlord to Tenant, subject to Landlord retaining any sums to
cover any maintenance costs or other charges to be reimbursed to landlord, and this
Agreement shall be deemed null and void.
D. IDot of First Refusal: Landlord shall retain the right of first refusal to purchase
the leased premises if the Tenant wishes to sell the leased premises within five years of
T~nant's purchase ~fthe preI11.ises. Tenant shall noti1)r landlord in writing of his desire to
sell the premises. Landlord shall within ten (10) days of the date of receipt of Tenant's
written notification of its desire to sell the premises, of the Landlord's position with
respect to purchase of the premises. If Landlord elects t.;> purchase the premises from
Tenant, the purchase price to be paid by Landlord shall be equal to the principal amount
: remaining on the first mortgage plus an amount equal to the total principal payments
made by Tenant on the Landlord's loan and an amount equal to the value of any major
improvements undertaken by the Tenant since the date of purchase. The value of any
major improvements shall be detennined by a mutually-agreed upon appraiser, whose
detennination of the value of said improvements shnll be deemed to be final. The cost of
said appraisal shall be Landlord's obligation. In the event that landlord does not exercise
its right to purchase, then the net proceeds from any sale by Tenant within the firn five
years of Tenant's purchase of the premises shall be payable to the LancUord after all CO!ltll
of .ale,liens and mortgages have been satisfied.

18. WAIVER; It is Wldemood and agreed that Landlord's failure to tenninate th.iJ Lease
becaUJe of any breach on the part of Ten ant shall not be considered a waiver of any 8ubsequent
breach nor a modification of the teIl118 and conditions of this Lease. It is further Wlderstood and
agreed that this Lease may be modified only by written rather than verbal agreement.
19. OUIET ENJOYMENT: If the Tenant shall promptly and faithfully perfonn each of the
covenants and conditions set forth in this Lease, Landlord shall warrant and defend Tenant in the
quiet enjoyment and peaceable possession of the leased premises during the leased tenn without
disturbance by the landlord or any other penon lawfully claiming the leased premiBes.
20. LIMITED WARRANTY: It is Wlderstood and agreed that the Landlord herewith
providet the Tenant a limited warranty with respect to the following items only: A one year
limited warranty from completion of rehabilitation work with respect to the item, listed in the
rehabilitation specifications for the leased premises. The rehabilitation specifications are
available at the offices of the Landlord or its designated representative.
21. LANDWRD'S REMEDIES AND RECOVERY OF POSSESSION: Landlord may
file a Complaint to evict the Tenant and to recover any part or the entire rent due Wltil the
