DEFENDANTS
1. Plaintiff, LOMAS MOR'l'OAGE PAR'rNERSHIP, L,P" is a partnerahip,
with a servicing agent of Lamas Mortgage USA, Inc. with an of fice
located at 1600 Viceroy Drive, P. 0, Box 226407, Pallas, Texas 75222.
2. Defendants, George W, 8dmonson and Linda L. Edmonson, are adult
individuals whose last known address is 7 E Beale Avenue, Enola, P1\
17025.
3. On or about March 11, 1980, the said Defendants executed and
delivered a Mortgage Note in the sum of $33,500,00 payable to THE
KISSELL COMPANY, which Note is attached hereto and marked Exhibit
"A",
4, Contemporaneously with and at the time of the exocution of the
aforesaid Mortgage Note, in order to secure payment of the same,
Defendants made, executed and delivered to original Mortgagee, a
certain real estate Mortgage which is recorded in the Recorder of
Deeds Office of the within County and Commonwealth in Mortgage Book
676, page 785 conveying to original Mortgagee the subject premises,
The mortgage was assigned to The Kissell Company and reoorded as
aforesnid in Book 416, page 599 on April 20, 1992, The mortgage was
assigned to LOMAS MORTGAGE PARTNERSHIP, L.P" BY LOMAS MORTGAGE
SERVICES, INC" MANAGING GENERAL PARTNER and recorded as aforesaid in
Book "oil, page 115'1 Oil Apdl ~O, 1993, 'rhe Mortgage and Allllignment/.l
are incorporated herein by l'aference,
5, The land /.Iubject to the MOl'tgage illl 7 E Beale AVenue, Enola,
FA 17025 and ill 1I10re particularly deucribed in Exhibit "B" attaohed
hereto,
6, By deed dl;lted March 14,1983 and l.'Elcorded in Cumberland County
Peed Book E-30, page 656/ the oaid George W, Edmondson and Linda L,
Sdmondson conveyed the within premises SUBJSC'r TO 'l'JIE: MORTOAGJ;: to
George W, Edmondson,
7, George W, Edmondson io the real owner of the land subject to
the Mortgage,
B, The Mortgage is in default due to the fact that Mortgagors ha'fe
failed to pay the installment due on February 1, 1995, and aU
subllequent installmentll thel'eon, and the following amountll are due on
the Mortgage I
(a) Unpaid principal balance
(b) Interest at $9,11 per day
from 1/1/95 to 8/1/95
(based on contract rate of 13\)
(c) Accumulated Late Charges and

*Together with interest at the per diem rate noted in (b) above after

Mortgage documents and Pennsylvania law, and will be colleoted in the

oharged that are actually incurred by Plaintiff.
9. No Judgment hilS beon entared upon aaid Mortgage in any
jurisdiction.
10. Notice of intention to foreclose and to accelerate the loan
balance has been given to the Mortgllgors in accordance with Section
403 of Pennsylvania ^ct No, 6 of 1974, but the Mortgagors have failed
to reinstate the MOl'tgage in accol'dance with the provisions thereof.
A copy of the Notice is attached hereto and made a part hereof as
Exhibit "C".
11. Defendants are not members of the Armed Forces of the United
States of America, nor engaged in any way which would bring them
within the Soldiers and Sniloro Relief Act of. 1940, as amended.
12. Plaintiff has complied with the procedures required by
Pennsylvania Act 91 of 1983 (Homeowners' Emergency Mortgllge
Assistance Payments Program) and Defendants have either failed to
meet the time limitations as set forth therein or have been
determined by the Housing Finance Agency not to qualify for the
assistance.

1. Plaintiff has brought a mortgage foreclosure action
whereupon it seeks to foreclose against certain property owned by the
Defendants located at 'I East Beale ^vonue, Enola, PA 17025.
2. Defendant Linda I" Edmondson was personally served with the
complaint, July 31, 1995 at the proper.ty address and also accepted
service for Defendant George W. Edmondson. However, a final degree
of divorce is on record as of April 25, 1903 and sorvice on DEfendant
George \/. Edmondson may not be good.
3. Plaintiff has conducted an investigation in order to
determine the whereabouts of Defendant Goorge W. Edmondson as set
forth on the attached Affidavit.
