AND NOW oomes the Plaintiff, EICHELBERGER CONSTRUCTION, INC.,
by and through itll attorneys, Reager & Adler, p.e" and states as
follows I
1. 'l'he Plaintiff is IICHl!JLDl'lftGl!JR CONSTRUCTION, INC.
(hereinafter "Eichelberger") / a corporation organized and exillting
under the laws of the commonwealth of Pennsylvania, with its
principal office located at 54 Old 'lork Road, Dillllburg, York
county, Pennsylvania 17019.
2, The Defendant is BARRY L. HOLLINGl'lR, t/d/b/a BARRY
HOLLINOl!JR l!JLl!JCTRICAL CONTRACTOR (hereinafter "Hollinger"), with a
residence at 123 south Oak Btreet, Manheim, Lancaster eounty,
Pennsylvania 17545.
3. On or about Uovember 21, 1994, Eichelberger and Hollinger
entered into a written contract relating to a project known as
Warehouse converllion and Office Renovations, Building 307 Navy
Ships Parts Control center, located in Mechanicsburg, Cumberland
oounty, Pennsylvania. A true and oorrolot copy of th. contract b
attached hereto all Exhibit A,
4. Pursuant to the oontract, 1I011inger was to furnish and
inlltall a complete eleotrioal lIystem,
5, In oonllideration of the oompletion of the above-
reterenced serviolls, Eiohelberger was to pay to 1I011inger the sum
of $90,000,00.
6. Oespite his oontraotual obligation to do so, Hollinger
hall failed to oomplete the eleotrioal system.
7, As a result of Ilo11inger's failuru to oomplete the
contract work, Eiohelberger has been foroed to oomplete lIol11nger'_
ccntract work at a cost of $217,900.00,
8, HOllinger's failure to complete its oontraot work
conlltitutes a breach of the contract.
9. Eichelberger has performed all conditicns precedent for
the bringing of this action,
10. As a result of lIollinger's breach, EiChelberger has
suffered damages in the amount or $127,900.00, such sum being the
difference between the amount. for whioh Hollinger promised to
complete the work ($90,000.00) and the amount Eiohelberger was
foroed to expend to complete Hollinger'll work ($217,900.00).
