AND NOW, December 4, 1995, by agreement of counsel and the parties, the
father and mother shall have )olntlegal custody of their children, Zachary, born
7/2186, and Jacob, born 1/16/89,
The father shall have primary physical custody of the children, subject to
partial custody in mother, as followr:l:
1, Commencing Friday, December 8, 1995, from 6:00 p.m. until Sunday at
7:00 p,m. and alternating weel<ends thereafter.
2, Commencing the first Friday at 6:00 p.m. after the close of school for the
summer vacation until August 8th at 7:00 p.m.
3, The alternating weekend schedule set forth In paragraph 1 above shall
be resumed thereafter. The alternating weekend schedule shall be arranged In
such a manner so as 110ttO conflict with mother's husband's weekend schedule of
partial custody with his child.
4, The father shall have alternating weekends as set forth In paragraph 1
above during the summer school vacation with the same conditions as set forth In
paragraph C3 above.
6. During the fall If the mothers alternating weekend falls on a day when the
ohlldren have a football game, father shall be entitled to pickup the children to take
them to the game and return them within two hours of the end of the game.
6. The Christmas vacation shall be divided Into two periods; period A from
6:00 p.m. the close of scl100l for the Christmas vaoallon until 3:00 p.m, December
25th: and period B, from 3:00 p.m. December 25th unlll 3:00 p.m. December 31 st.
Mother sl1all have period A In even-numbered years and period B In odd-numbered
years. Father shall have period A In odd-numbered years and period B In even-
numbered years.
7, Mother shall have the children for the Thanksgiving holiday from Bchool,
oommenclng at 6:00 p.m. the day school closes for the Thanksgiving holiday, untIl
noon the following Saturday (the Saturday after Thanksgiving).
8. The parties shall alternate Memorial Day, Fourth of July, and Labor Day,
with mother having Memorlal Day and Labor Day In odd-numbered years, and
Fourth of July In evan-numbered years. Father shall have Memorial Day and
Labor Day In aven-numbered years and the Foul1h of July In odd-numbered years.
Should any of these three holidays fall the day before or the day after a regularly
scheduled weekend, the party who has that weekend and that holiday shall be
enlltled to the extended weekend until 7:00 p.m. the end of the holiday weekend,
Should the holiday not fall on a weekend of regular visitation, the period of partial
custody shall be from 9:00 a.m. until 7:00 p.m. the day of the holiday.

the parties and the children submit themselves for a oustody evaluation done by
Guidance Associates of Pennsylvania. For the boneflt of Guidance Associates, the

entertained argument from each counsel, the father's visitation with his two sons,

l. HISTORY OF THE CASE
The Order of September 29, 1995, herein requires a
Memorandum setting forth the history of the oustody in this case,
the issues presented and a list of witnesses with a summary of
the anticipated testimony of each,
The parents in this case were married on June 1, 1985,
Their two sons are Zachary Paul Sheaffor, born July 2, 1986, and
Jacob Richard Sheaffer, born January 16, 1989,
The partios separated from marital cohabitation in February
of 1990 when the father loft tho family home, They wore divorced
on June 27, 1991, by decroe of this Court at No, 2588 civil 1990,
At all times since tho date of soparation, the mother has
had primary custody of the children. This primary custody was
confirmed in a protective Ordor dated March 12, 1990, and
docketed in this Court to No, B73 civil 1990, custody was
renewed in the Ordor of June 10, 1991, oxtending the Protective
Order and further addressed in the Order of September 20, 1991,
holding the father in contempt for violation of the protective
Order.
The father has twice boen adjudicated in contempt by Judge
Bayley for violation of the protective Orders. lie was released
on each occasion on tho representation to the court that he was
goinq to relocate to the state of 'l'exas, lie never relocnted, and
his abusive conduct has created 60 much etress on the older boy
that it has beon necessary for the mother to pay tor do~ens of
counseling sessions for the child at capital Area psychological
Associates,
Th~ father'S custody has always been alternate weekend
partial custody as set forth in the rospective protective Orders,
except that, in practice, it would begin on Saturday mornings
rather than Friday evenings. In addition, the mother always
cooperated with additional custody requests for special
occasions.
The mother constructively addressed the needs of the
children by supporting them as a working single mother for five
years until the summer of this year. unfortunately, the father
has been chronically neglectful of the child support obligation
in permitting thousands of dollars of arrearages to accrue.
In July of 1994, the mother met her present husband, on
July 18, 1995, the mother notified the father in writing through

counsel of her plans to remarry and relocate to Frederick,
Maryland where her new husband resides, When the father
indicated Ilis opposition, the mother initiated these proceedings
on August 1, 1995.
On August 4, 1995, the father requested emergency relief
inclUding temporary custody of the children pending the outcome

ot these prooeedings, I\n emergency hearing Wa~ held on August
17, 1996, At that heoring, temporary oustody wos, again,
oontirmed in the mother by agreement of the porties subjeot to
alternate weekend partial cuotody in the father pending the
outoome of a conciliation conferonce which wao to be held on
September 22,1995.
On September 1, 1995, the mother was rOI1Hlrried, and she
relooated with the childron to ~rederick, Maryland, on August 12,
1995, Since the mother has peen marriod, she has been able to
dlsoontinue her employment and be a fUll-time mother and
homemaker,
On September 28, 1995, YOUr Honorable Court ordered a
psyohological evaluation by agreomont of the parties, That
evaluation is not yet complete,
When the time came for the oonciliation conference, it was
not convenient for the father to appear, He requested that the
oase be forwarded immediatoly to the court for a hearing without
conoiliation. This request was granted by order of September 29,
1995.
The same Order of September 28, 1995, expanded the father/s
partial custody to two out of three weekends and confirmed the
mother/s stated willingness to transport the children to their
sports events here on h~r woekends,

Mother and fathllr are the parents of Zackery, born July 2,
1986, and Jacob, born January 16, 1989.
The mother and father had resided in cumberland county,
Pennsylvania, during which time the mother had the primary physical
oustody of the children,
Mother filed a pliltltion in cumberland county alleging that she
was going to relocate to Frederick, Maryland, on August 25, 1995,
by virtue of a remarriage,
Mother in fact moved in July, 1995, prior to filing the
petition.
The children have spent their. entire educational time in the
cumberland Valley school District up to the time of the move. They
have participated in athletic contests in the cumberland Valley
school District and by virtue of the interim custody order continue
to do $0 up until this time.
The Court had entered a series of interim orders addressing
temporary custody pending the outcome of the hearing of December 4,
19915, and rurther the parti811 agreed to submit themlelv811 to a
cUltody evaluation with Or. stanley sohneider or Guidmnoe
"llooiates.
The preferenoe of the ohildren is to remain in the Carlisle
area with their rather, continue in the school where they have
spent almost all. of their educational background and also to live
with their father who resides with his parents.
The paternal grandparents have had an active role in the life
of the two boye. Up until the time of the move by mother in July
of 1995, the pra~tice of the children each day would be to get on
the sohool bus at the paternal grandparents' home because mother
and father were working.

Has the mother fulfilled her burden of showing that her move
is designed to significantly improve the quality of life for the
ohildren and her motives in desiring to move were to enhance the
well being and best interests of the children. See Gruber vs.

III. ANTIOIPATID TIBTIKONY
1. Dennis Sheaffer, father.

general ability of the father to care for the ohildren as well as
the past history of tho mother in her care of the children.
5. Denise Mersberger of Frederick, Maryland, will testify
that she resided with Randolph James stewart, the ourrent husband
of the mothe~ until the summer of 1995, showing that the mother did
not become involved with her current husband until the summer of
1995, indicating that the move to Maryland was solely for the
benefit of the mother.
6. Beverly ~eater of Harrisburg, PA will testify that she
oonsistently the mother drinking and was constantly drunk. She
will further te~tify that on several occasions th~ boys were left
home alone.
7. Kate Dillard of Carlisle, PA., will testify that the
mother constantly left the boys alone, was drinking on a regular
basis, and was, on several occasions, drinking and driving with the
children in the car. She will further testify that she observed
the mother purchase drugs and use the same.

1. The pertinent information pertaining to the children who are
the subje~t of this litigation is as fol10wSl
CIVIL RULE OF PROCEDURE
Conciliator submits the
Zachary Paul Sheaffer, born July 2, 1986, and Jaoob Richard
Sheaffer, born January 16, 1989.
2. A Conciliation Confere/ce was scheduled for September 22,
1995. The Conciliator spoke with legal counsel for both
parties on the telephone and determined that a Conciliation
Conference was not neoessary because it is clear that a
Court Hearing will be required.
The parties separated and the Mother relocated to Maryland.
Pursuant to the August 17, 1995, tRn~orary Order, the
children were to remain in the Mother's custody and the
children could start sohoo1 in Maryland.

The Father's position is that he should have primary physioal
oustody and the children should at tend school in pennsyl vania.
The Mother's position is that she should have pr.imary
physical custody and that the children should attend school
in Maryland. Obviously, an agreement cannot be reached and
a Hearing is neoessary.
The Mother's counsel expressed some concerns with respect to
the various problems that the plirties are having in dealing
with each other, especially on exchange of custody. Mother's
oounsel indicated that he may want to obtain a psychological
evaluation of the parties. Father's counsel merely wants to
proceed with a Hearing on the merits of the case.

the following Petition for Emergency Relief as f~llowsl
1. The Petitioner, Dennis 1'. Sheaffer, is the Defendant in
the above captioned custody action.
2. The Respondent, cynthia H. Sheaffer, is the Plaintiff in
the above captioned custody action.
3. The Respondent herein filed a Complaint for custody
alleging in the complaint that she is a resident of carlisle,
Pennsylvania and further alleging in paragraph 12 that she wants to
relooate the children to Maryland upon her remarriage on August 25,
1995.
4. contrary to the allegations that were f Hed by the
Respondent herein, veri f ied under oath, the Respondent herein
removed the children which are subject to the custody action,
Zaohary Paul Shoaf fer and Jacob Richard sheaffer on or about the
weekend of July 29, 1995 to a location unknown to the Petitioner
herein.
5. When Petitioner heroin attempted to exeroise hia partial
oustodial rights over the woekund of July 29th he was advised that
the ohildren are no longer in the area and that ho is not in a
position of being able to see thom,
6. Petitioner he lievos Rnd thorefore avers that the
Respondent herein falsified tho complaint for custody, removed the
ohildren from the jurisdiction of cumberland county without
permi~sion or authority and is locatod somewhere apparently in
Frederick, Maryland lit an address unknown to tho Petitioner herein
and at an address which has not been shared by the Respondent
herein.
7. The two children subject to the Order are engaged in
aotivities in the Cumberland county area, attend school in
Cumberland County, all of which cannot occur because of the action
of the Respondent.
Petitioner believes and therefore avers that the best interest
of the ohildren are served by directing that the children be
returned to cumberland county, Pennsylvania pending outcome of the
Complaint for CUstody and further believes that it is in the best
interest of the children that temporary physical custody be granted
to the Petitioner herein pending outcome of said Complaint.

AND NOW, Deoember 4, 1995, by agreoment of oounsel and the parties, the
father and mother shall have Joint legal custody of their ohlldren, Zaohary, bom
7/2/B6, and Jaoob, born 1/16/89.
The father shall have primary physloal oustody of the ohlldren, subject to
partial oustody In mother, as follows:
1. Commencing Friday, Deoember B, 1995, from 6:00 p.m. until Sunday at
7:00 p,m. and altematlng weekends thereafter.
2, Commencing the first Friday at 6:00 p.m. after the olose of school for the
summer vaoatlon until August 8th at 7:00 p.m.
3, The alternating weekend schedule set forth In paragraph 1 above shall
be resumed thereafter. The alternating weekend schedule shall be arranged In
such a manner so as not to conflict with mother's husband's weekend schedule of

partial custody with his child.
4, The father shall have alternating weekends as set forth In paragraph 1
above during the summer school vacation with the same conditions as set forth In
paragraph 3 abovl3.
5. During tho fall It tho mothor's allomat,lng weekend falls on a day when the
ohlldren havo a football garno, father shall be enlllled to plokup the children to take
thom to the game end return them within two hours of the end of the game,
6, The Christmas vaoallon shell be divided Into two periods; period A from
6:00 p.m, the olose of aohool for the Christmas vaoatlon untIl 3:00 p.m. Deoember

25th; and period S, from 3:00 p.m. Deoember 25th unlll 3:00 p.m. Deoember 31 at.
Mother shall have period A In evon-numbered years and period B In odd-numbered
years. Father shall have period A In odd-numbered years and period B In even-
numbered yeara.
7. Mother shall have the ohlldren for the Thanksgiving holiday from sohool,
oommenclng at 6:00 p.m. the day school closes for the Thanksgiving holiday, until
noon the following Saturday (the Saturday after Thanksgiving).
8. The parties shall alternate Memorial Day, Fourth of July, and Labor Day,
with mother having Memorial Day and Labor Day In odd-numbered years, and
Fourth of July In even-numbered years. Father shall have Memorial Day and
Labor Day In even-numbered years and the Fourth of July In odd-numbered years.
Should any of these three holidays fall the day before or the day after a regularly
scheduled weekend, the party who has that weekend and that holiday shall be
enlllled to the extended weekend until 7:00 p.m. the end of the holiday weekend.
Should the holiday not fall on a weekend of regular vlsltallon, the period of partial
custody shall be from 9:00 a.m. untIl 7:00 p.m. the day of the holiday.
