~. A Conciliation Conference was held on May 16, 1996, with the
following individuals in aL•tendancer
The Mother, lfeidi Jaoquea Hinton, with her counsel, Maroua A.
MoKnight, and Steven Scott }/inton, with his counsel, Richard
P. Wagner.
3. The parties were before the Conoiliator previously in January,
et which time an agreement was reached. This was a temporary
arrangement. 9'he parties had separated in July 1995.
4. We ere cuc•rently in a dtspute in that the Mother wants to
modify the existing order in that she wants to become the
primary custodian. She wants to have the children attend
sohool in the Carlisle school district, rather than the
existing arrangement whereby Choy go to school in South
Middleton. Father is of the position that the existing order
should remain in effect. Essentially, the existing order
provides fora 50/50 division with respect to actual, phyeinal
custody. The partioa live on opposite ends of Carlisle, just
a few miles from each other.
5. The parties could not reach an agreement. A hearing ~s
necessary. A hearing should take no more than one day.
6. The Conciliator recommends an order in the form as attached.

A. Tha Father shall enjoy physical custody on weekdays
from Tuesday after school until Wednesday morning
and from Thursday aftor school until Friday morning.
The Father shall also enfoy physical custody every
other weekend from 7'l~ursday after school until
Monday morning. Tha week the Father has the ohlldren
on the weekend, his weelcnlght shall he Tuesday.
S. The Mother shall have physical custody of the minor
children at limos the children are not to the custody
of the Father as eel forth 1n Subparagraph A above.
3. In the event either parent ltas physical custody of the minor
children and that parent .is required to not be with the
children because of work or othor prolonged activities,
the custodial parent shall contact the non-custodial parent
and give that parent the option of providing childcare for
the children.
q. Reasonable telephone accasa shall be provided to the non-
custodial parent with a minimum of a telephone call every
Sunday evening soma tints between the hours of 6 P.M. and
8 P.M.
5. The above Order is temporary in nature in the sense that

manner and in the process nuengtted to wreck his vehicle placing the

attempted to back over the petitioner with his pickup truck.

PETITION FOR MODIFICATION OF CUSTODY
AND NOW comes the Plaintiff/Petitioner, Heidi J. Hinton, by her attorneys, Irwin &
McKnight, and presents the following Petition for Modification of Custody.
1.
The Petitioner is Heidi Hinton, an adult individual residing at 279 Plaza Drive, Mt. Holly
Springs, Cumberland County, Pennsylvania 17065.
2.
The Respondent is Steven S. Hinton , an adult individual residing at 200 Mill Street, Mt.
Holly Springs, Cumberland County, Pennsylvania 17065.
3.
The parties are the natural parents of one (1) minor child, namely Hillary Leah Hinton,
born February 13, 1990.
4.
The parties are currently govened by a custody Order of Court dated February 13, 199b,
a copy of which is attached hereto and marked as Exhibit "A".
5.
The Petitioner desires that primary physical custody of said minor child remain with
Petitioner, with joint legal custody and periods of temporary custody to Respondent as provided
above.
6.
The best interests and permanent welfare of said minor child require that the Court grant
the Petitioner's request as set forth above.
WHEREFORE, Petitioner, Heidi J. Hinton, respectfully requests that she retain primary
physical custody and shared legal custody of Hillary L. Hinton, as provided herein, with periods
of temporary custody to Respondent.

the attached Custody Conciliation Report, it is ordered and
directed as follows:
1. The Mother, Heidi Jacques Hinton, and the Father, Steven
Scott Hinton, shall enjoy shared Iega1 custody of
Christopher Steven Hinton, born April 3, 1987, and
Hillary Leah Hinton, born February 13, 1990.
2. Physical custody of the minor children shall be handled as
follows:
A. The Father shall enjoy physical custody on weekdays
from Tuesday after school until Wednesday morning
and from Thursday after school until Friday morning.
The Father shall also enjoy physical custody every
other weekend from Thursday after school until
Monday morning. The week the Father has the children
on the weekend, his weeknight shall be Tuesday.
B. The Mother shall have physical custody of the minor
children at times the children are not in the custody
of the Father as set forth in Subparagraph A above.
3. In the event either parent has physical custody of the minor
children and that parent is required to not be with the
children because of work or other prolonged activities,
the custodial parent shall contact the non-custodial parent
and give that parent the option of providing childcare for
the children.
4. Reasonable telephone access shall be provided to the non-
custodial parent with a min.tmum of a telephone call every
Sunday evening some time between the hours of 6 P.M. and
8 P.M.
5. The above Order is temporary in nature in the sense that
the parties will meet again for a Custody Conciliation
Conference on March 7, 1996, at 9:30 A.M. In the event
the parties are unable to reach an agreement on a
permanent Order, either party may advance any position
at a Court Rearing with respect to custody and shall not
be in any way prejudiced by the custody arrangement set
forth above to which the parties have agreed on a
temporary basis.
6. While each party has custody of the minor children, that
parent shall not have any paramour spend time overnight
at the respective custodial parent's home.
