3, On July B, 1995, J:>etitioner was mailed a notice of
suspension for allegedly failing to attend a departmental hearing,
A copy of said notice is attached hereto and made a part hereof as
Exhibit "A,"
4, J:>etitioner never received a copy of a notice to attend
such a departmental hearing, and therefore he was unable to attend
it.
5, The only correspondence the Petitioner received prior to
his notice of suspension was on May 15, 1995, when he received a
notice of three (3) points being assessed against his driving

In order to comply with this unction you are ,'uquired to
return any c~rrent driver's license, learner's pllrmit and/or
temporary driver's license (camera card) 1n your possulSsion
no later than the effective date li5teD. If YOU cannot com-
plY with the requirements stated above, you are required to
5ubmit a DL16LC Form or a letter acknowledging the sanction
of your driving priviluge. Failure to comply with this no-
tice shall relS~lt in this Bureau referring this matter to the
PennsYlvania State Police for prosecution under SECTION
1571(a)e4) of the Vehicle Code.
Although the law mandates that your driving privilege is un-
der suspension even if YOU do not surrendlr your liclnsu,
credit will not begin 'JOtil all current driver's lielnse
productes), the DL16LC Form, or a letter acknOWledging your
sanction is rlceived in this Bureau.
WHEN THE DEPARTMENT RECEIVES YOUR LICENSE OR ACKNOWLEDGEMENT,
WE WILL SEND YOU A RECEIPT. IF YOU DO NOT RECEIVE THIS RECEIPT
WITHIN l5 DAYS CONTACT THE DEPARTMENT IMMEDIATELY, OTHERWISE/
YOU WILL NOT BE GIVEN CREDIT TOWARD SERVING THIS SANCTION.
