COMPLAINT
1. Plaintiff is Meridian Bank, a Pennsylvania banking
corporlltion with its principal office at 35 North sheth street,
Reading, Pennsylvania, 19601
2. The Defendant, Harry J. l<ling is an adult individual with
a last known address of P.O. Box 213 I Shippensburg, Cumber.land
county, Pennsylvania 17257.
3. On or about March 1, 1991, Defendant, executed and
delivered to Meridian Dank, a Note J.n the original principal amount
of $36,800.00 (the "Note>>). A true and corroct copy of the Note is
attached to and incorpor[ltod by r.eference in this Complaint as
Exhibit "A".
4. The Note is se.:Jurod by that clll:tain Mortgago executed and
delivered by the Defendant to Meridian Bank dated March 1, 1991 and
filed on March 6/ 1991 at Volume 1004, page 613 ~ DmI./ Cumberland

herein by refe~ence and any judgmont in thia action shall relate

5. 'rho Dofendant defuulted with regard to tho Note and
related loan dooumonts in that tho Dofendant failed to pay when due
the monthly installments from Januury 1, 1995 to date.

Aot of 19B3, written notice of counsaling wae given to the
Dafendant.
A copy of tho aforeeaJ.d notice of counseling is
attached hereto, marked ExhJ.bit IIlJlI and incorporated herein by
reference. Plaintiff avers that the Defondant failed to meet tho
t.l.me limitations for the opportunities afforded in such Act 91 or
did not qualJ.fy for such assistance.
7. Pursuant to Act of January 30, 1974 P.L. No.6 (41 P.B.
101 ft.t. lUl!;l.), written notice of Intention to foreclose was given to
the Defendant by certified mail. A copy of the aforesaid notioe of
intention to foreclose ie attached hereto, marked Exhibit lie>> and
incorporated herein by reference.
B. The Defendant is liable to the Plaintiff under the Note
and related loan documents as followsr
