Clerk, Defendant T!K'OBARX-l8QTICTIO~BDJB AND NOW, thia _U_ day of August, 1995, upon presentation and consideration of the within Petition, and upon finding that the plaintiff, Vona M. clark, and the minor child, now reaiding at 171 A old Gap Road, Carliale, Cumberland County, Pennsylvania, are in immediate and preacnt danger of abuae from the defendant, Tony R. clark, the following Temporary Order is entered, The defendant, Tony R. Clark, (SSNl 193-60-7058 and Date of Birthl 8/16/(4) now residing at 171 A Old Gap Road, Carliale, Cumberland County, Pennsylvania, is hereby enjoined from phyaically abusing the plaintiff, Vona M. Clark, or her minor child, or placing them in fear of abuse. The defendant is excluded from the plaintiff'S residence located at 171 A old Gap Road, carlisle, cumberland county, Pennaylvania, a residence which is jointly leased by the partiea. The defendant is ordered to refrain from having any direct or indirect contact with the plaintiff or the minor child incLUding, but not limited to, telephone and written communications. The defendant is enjoined from haraasing and stalking the plaintiff and from harassing the plaintiff'a relativea, or the minor ch ild. The defendant ia enjoined trom removing, damaging, deatroying or selling any property owned jointly by the parties or owned solely by the plaintiff. Clark, (SSNI 193-60-705B) (Date of Birthl B/16/64), is an adult individual residing at 171 A Old Gap Road, Carlisle, cumberland county, PennsYlvania, 17013. 3. The defendant is the plaintiff's husband. 4. since approximately January 1995, the defendant hali attempted to cause and has intentionally, knowingly, or recklessly caused bodily injury to the plaintiff, committed spousal sexual assault, falsely imprisoned the plaintiff, physically abused the minor child, placod the plaintiff and her minor child in reasonable fear of imminent serious bodily injury, and knowingly engaged in a course of conduct or. repeatedly committed acts toward the plaintiff and the minor child under circumstances which have placed the plaintiff and the child in reasonable fear of bodily injury. This has included, but is not limited to, the following specifio instances of abusel a. on or about July 26, H196, the defendant threatened the plaintiff saying, "I want a pieoe and I'm going to take it," and forced her to have seK, oausing her pain. b. On or about July 19, 1996, the defendant repeatedly and forcefully hit the plaintiff's six year old son with a belt causing redness about his buttooks. o. On or about July 3, 1995, the defendant aa lled the plaintiff and her Bon vile names, raised his fist, drew it back, and threatened her saying, "I ought to punoh you bitch," causing the plaintiff to fear for her safety and that of her son. d. Since approximately January 1995, the defendant has on several different occasions threatened to kill the plaintiff and has pulled his fist back in a threatening manner causing the plaintiff to fear for her safety. 6. The plaintiff believes and therefore avers that she and her minor ahild are in immediate and presp.nt danger of abuse from the defendant should they remain in the home without the defendant's exclusion and that they are in need of protection from such abuse. 6. The plaintiff desires that the defendant be prohibited from having any direct or indirect contact with the plaintiff or her minor child including, but not limited to, telephone and written oommunioations. 7. The plaintiff desires that the defendant be enjoined from harassing and stalking the plaintiff, and from harassing the plaintiff's relatives, or her minor child. B. The plaintiff desires that the defendant be restrained from ~ntering her place ot employment or the school at her minor ohild. 9. Tho plaintiff desires that the defendant be enjoined from removing, damaging, destroying or selling any property owned jointlY by the parties or owned solely by the plaintiff. D. The plaintiff currently haa no place to stay with her ohild except the marital home, and the defendant has his parents and several cousins, as well as, friends in the area witn whom he oan stay. 12. The plaintiff desires possession of the mobile home so an to give the greatest degree of continuity to the life of the ohild and to allow him to continue his education at his school and to continue his school and social activities. O. BUPPORT 13. The defendant has a duty to support the plaintiff. 14. The plaintiff is in need of financial support from the defendant including, but not limited to: health insurance cov.~aqe, payment of un~eimbu~~ed medical eHponse~ fo~ the plaintiff, the rent payment on the residence at 171 A old Gap Road, Carlisle, Cumberland county, renn~ylvaniB. 1~.
