V, DISCUSSION:
The Defendant has not raised any issue regarding the purchase and receipt of
the goods set forth on the Plaintiff's Invoices. w. lch will be entered into evidence on
behalf of the Plaintiff, The only substantive issue that has been raised by the
Defendant. with the exception of a claim of a partial payment in the amount of
$2.601.11. is whether the Plaintiff is entitled to interest (finance charges) at the rate
of 2% per month, The Defendant will assert that there is no agreemont specifically
providing for the payment of interest or finance charges, Plaintiff concedes that there
is not a specific written agreement signed by the parties providing for the payment of
interest. However. all of the Plaintiff's Invoices that were submitted to the Defendant
with each purchase of merchandise bore a clear and conspicuous notation that a 2%
service charge \/'Iill be added to all past due accounts, All of Plaintiff's Invoices for
merchandise clearly and conspicuou~ly set forth the due date, Consequently. the
Defendant was fully cognizant of the Plaintiff's payment terms and was completely
aware or should have been aware of the consequences of not making payment within

the prescribed due date, The Defendant had two simple options. The Defendant
could pay his bill on time or the DefencJant could choose to "use Plaintiff White Oak
Manufacturing as a bank" and elect not to pay timely, but with full knowledge that a
price would have to be paid for utilizing Plaintiff's money, that is, the imposition of a
service charge of 2 % per month,
Courts in Pennsylvania have regularly upheld a credito,'s right and entitlement
to pre'judgment interest, The Pennsylvania Appellate Courts have repeatedly held that
the award of pre'judgment interest does not depend upon disc,etion, but is a legal
right and mllst be awa,ded despite the good faith of a pa,ty contesting a claim for
monies due, Verner v,Shaffer, 500 A,2d 479 (Pa,Super, 1985); Gold & ComDanv v,
Northeast Theater CorDoration, 421 A,2d 1151 IPa,Super, 1980),
Pre'judgment inte,est has been defined as compensation allowed by law 0'
fixed by contract for the use or detention of a plaintiff's prope'ty by a defendant,
Fernandez v, Levine, 548 A,2d 1191, 519 PA, 375 (1988); yerner v, Shaff9r, 500
A,2d 479 (Pa,Super, 1985),

which held that pre'judgment interest in a contract action is awarded to a party who
establishes the breach of an agreement to purchase goods f,om the time the seller
should have received payment for the goods despite the existence of a bona fide
dispute as to the amount due, In other words, it has been determined that a jury's
reduction of a contract claim for a sum certain does not transfer a liquidated sum into

an unliquidated sum, and that the ju,y's verdict Is still subject to the addition of pre-

VI. CONCLUSION:
Based upon the foregoing Plaintiff submits that the Plaintiff is entitled to
Judgment against the Defendant in the amount of $24,777,99, plus Interest from May
31, 1996 at the rate of 2% per month,
