COMPLAINT PURSUANT TO Pa.R.C.P. 2961
CONFESSION OF JUDGMENT
1. Plaintiff. John B. Turo. is an adult individual with offices and principal place ofbusiness
at 3533 Logan Street, Camp Hill, Cumberland County, Pennsylvania.
2. Defendant. Robert Lincoln Kirk, is an adult individual with the last known address of 31
West Factory Street, Mechanicsburg, Cumberland County, Pennsylvania.
3. On or about April 30, 1993, the Plaintiff, John B. Turo, executed Articles of Agreement
together with James F. Simmons, Jr" to lease a first floor commerclaJ space at 16 North Market Street.
Mechanicsburg. Cumberland County, Pennsylvania for a period of three years beginning May 1, 1993 at
the rate of $800.00 per month.
4. On December 30, 1994. by virtue of an assignment of a lease, a copy of which is attached
and made a part hereto. the said James F. Simmons, Jr. assigned said lease, in its entirety to the
Defendant. Robert Lincoln Kirk.
5, By virtue of the assignment of lease. the said Defendant, Robert Lincoln Kirk, did accept
all responsibilities and rights pursuant to the Article of Agreement dated April 30, 1993.
6, Defendant failed to pay rent pursuant to the Agreement in the amount of $4,500.00.
7. Judgment on the aforesaid instrument has not been entered in any jurisdiction.
8. No default or other condition precedent is required in order to enter judgment on the
aforesaid instrument under the terms of that instrument.
9. As a consequence of the foregoing, the Defendant is liable to the Plaintiff in the amount ,
of $4,500.00 for unpaid rents from January through August 1995,

10. PlalntiIT has been advised and, therefore, avers that Defendant executed the Articles of
Agreement and Assignment of Lease referred to above for business purposes.
11. PlalntiIT has been advised. and, therefore, avers that Defendant's Income exceeds
$10,000.00.
WHEREFORE, John B. Turo. demands judgment In the sum of $4,500.00 against the Defendant,
Robert LIncoln Kirk, plus costs, as authorized by the Warrant of Attorney and the Instrument, a copy of
which is attached hereto,

1. A Lease WB8 executed on April 30. 1993 between landlord, u landlord, and Assignor u
tenant, by the terms of which a first Door commercialBpace at 16 North Market Street, wu leued to the
Aaalgnor u tenant, for a term of three (3) ye81'8 commencing on May 1. 1993 and ending on April 30, 1990,
subject to earlier termination 88 therein provided.
2. A copy of lI8id Lease dated April 30. 1993 Is attached hereto and made a part hereof.
3. The Assignor desires to 8lI81gn the Lease to the Assignee and the Assignee dealres to
accept the assignment and, further. the Lessor joina in this Assignment indicating his consent thereto.
4. For and in consideration of good and valuable consideration, receipt of which Is hereby
acknowledged, and the Agreement of the Aaalgnee, hereinal\er IIllt forth, the Assignor hereby 8lI81ll1\l1 and
tranafera to the Assignee and his heirs, executora, admlnlatratora, and IUIlIlllI\lI, all of this right. title, and
interest in and to the Lease herein before described and a copy of which Is attached hereto. and the
