Whereas, Second Presbyterian Church, of 528 Garland Drive, Carlisle, Pennsylvania
17839 is about to execute contemporaneously herewith, a contract, with Tuckey Mechanical
Services, Inc., of 140 Stover Drive, Carlisle, Pennsylvania 17019 for additions and renovations.
ALL THAT CERTAIN tract of land with the improvements thereon erected situate in the
Borough of Carlisle, Cumberland County, Pennsylvania bounded and described in accordance with
the Final Subdivision and Land Development Plan for Carlisle Second Presbyterian Church
prepared by Brehm.-,.~i.~bo Engineering, Inc. recorded in the hereinafter mentioned Recorder's
Office in Plan Book~'~, Page ~, as follows:
BEGINNING at a point in the southern right of way line of Garland Drive at the point of
its intersection with Rock, ledge Drive; thence along the said southern right of way line of Garland
Drive the following eight courses and distances: 1. North 79 degrees 38 minutes 00 seconds east
a distance of 48.86 feet to a point; 2. By a curve to the right having a radius of 460.00 feet an arc
distance of 159.17 feet to a point; 3. South 80 degrees 32 minules 30 seconds east a distance of
36.10 feet to a point; 4. By a curve to the left having a radius of 254.56 feet an arc distance of
108.12 feet to a point; 5. North 75 degrees 07 minutes 20 seconds east a distance of 319.05 feet to
a point 6. By a curve to the right having a radius of 209.11 feet an arc distance of 161'.98 f6et to a
point; 7. South 60 degrees 29 minutes 40 seconds east a distance of 33.68 feet to a point; 8. By a
curve to the right having a radius of 40.00 feet an arc distance of 43.86 feet to a point in the Western
right of way line of 60 foot wide Sadler Drive; thence along the said western right of way line of 60
foot wide Sadler Drive the following throe courses and distances: I. South 02 degrees 19 minutes
36 seconds west a distance of 381.79 feet to a po!m; 2. By a curve to the left having a radius of
6,060.00 feet an arc distance of 87.43 feet to a polht: 3. South 01 degrees 30 minutes 00 seconds
west a distance of 49.91 feet to ~i point in the comer of lands now or formerly of Harold B. Kivlan,
III; thence along said lands now or formerly of Harold B. Kivlan. ill and others, north 88 degrees
30 minutes 00 seconds west a distance of 450.00 feet to a point in line of lands now or formerly of
Ruth E. Black; thence along said lands now or formerly of Ruth E. Black and continuing along
lands now or formerly of Kenneth C. Vincett and Roherta A. Vincett north 89 degrees 46 minutes
40 seconds w~t a distance of 232.98 feet to a point at the comer of lands now or formerly of Lovis
J. Pinto and Marie S. Pinto which point is also at comer of lands now or formerly of Paul Shenk;
along said lands now or formerly of Paul Shenk, north 09 degrees 00 minutes 20 seconds east a
distance of 181.26 feet to a point; thence along same north 86 degrees 26 minutes 40 seconds west
a distance of 170.00 feet to a point in the eastern ri[tht of way line of 50 foot wide Rockledge Drive;
along the said eastern right of way line of 50 feet wide Rock, ledge Drive by a curve to the left having
a radius e.f 958.(M feet ax arc d;.stanc~', of 145.16 fee~ to a point: thence by ~ame north l0 degrees
36 minutes I0 seconds wesi a distance of 127.60 feet to a point: thence by a curve to the right
having a radius of 25.00 feet an arc distance of 39.49 feet to a point in the southern fight of way
line of Garland Drive, the Place q[BEGINNING.
CONTAINING 9.706 acres and having a mailing address of 58 Garland Drive, Carlisle,
Pennsylvania.
Now, September 13, 2000, at the time of and immediately before the execution of the principal
contract, and before any authority has been given by the said OWNER to the said CONTRACTOR to
commence work on the said building, or purchase materials for the same in consideration of the making
of the said contract with Tuckey Mechanical Services, Inc. and the further consideration of One
Dollar, to Tuckey Mechanical Services, Inc. paid by THE OWNER, it is agreed that no lien shall be
filed against the building by the contractor, or any ~ul~contractor, nor by any of the material men or
workmen or any other person for any labor, or materials purchased, or extra labor or materials
purchased for the erection of said building, the right to file such liens being expressly waived.
